According to a witness, Nate Dinguss – as reported by the Washington Post and The Olympian – Reinoehl seemed to be unarmed. The witness averred that police shot Reinoehl without warning or trying to arrest him first. Dinguss's account contradicts the scenario described by federal authorities, who claim that Reinoehl drew a firearm as members of a fugitive task force tried to arrest him. Most of what we have from the Babylonians was inscribed in cuneiform with a metal stylus on tablets of clay, called laterculae coctiles by Pliny the Elder; papyrus seems to have been also employed, but it has perished. There were libraries in most towns and temples; an old Sumerian proverb averred that "he who would excel in the school of the scribes must rise with the dawn." Women as well as men learned to read and write, and in Semitic times, this involved a knowledge of the extinct Sumerian language, and a complicated and extensive syllabary. The Babylonians' very advanced systems of writing, science and mathematics contributed greatly to their literary output.

Arne Dekke Eide Næss ( ; ; 27 January 1912 - 12 January 2009) was a Norwegian philosopher who coined the term "deep ecology" and was an important intellectual and inspirational figure within the environmental movement of the late twentieth century. Næss cited Rachel Carson's 1962 book Silent Spring as being a key influence in his vision of deep ecology. Næss combined his ecological vision with Gandhian nonviolence and on several occasions participated in direct action. Næss averred that while western environmental groups of the early post-war period had raised public awareness of the environmental issues of the time, they had largely failed to have insight into and address what he argued were the underlying cultural and philosophical background to these problems.

By April 1862, while still a lieutenant, Melvin had received a commission as Adjutant general of Volunteers on the staff of Brigadier General Benjamin Franklin Kelley in the Department of West Virginia. On August 12, 1863, in his role as adjutant general, Melvin delivered orders to Major General William W. Averell for the procurement of the law books of the Library of the Supreme Court of Virginia in Lewisburg and to place officers in charge of them for their transport to safekeeping in Beverly. Because the library had been purchased for the western part of Virginia, Kelley averred that the library "rightfully belongs to the new State of West Virginia. Our judges need it very much".

However, Jansenists averred by referring to alleged long ecclesiastical precedence which (allegedly) allowed for ordination without Papal approval under particular circumstances.

Timeline of jazz education (a chronology of jazz pedagogy): The initial jazz education movement in North American was much an outgrowth of the music education movement that had been in full swing since the 1920s. Chuck Suber (né Charles Harry Suber; 1921–2015), former editor of Down Beat, averred that the GI Bill following World War II was a key impetus for the jazz education movement in higher education. During the WWII, the U.S. Armed Forces had been the nation's largest employer of musicians – including women musicians. After the War, many of those musicians sought to pursue music as a career, and, with assistance of the GI Bill, found colleges offering curricular jazz.

One of the most "popular and effective documents in American political history", Jackson outlined a major readjustment to the relative powers of the government branches. The executive branch, Jackson averred, when acting in the interests of the American people, was not bound to defer to the decisions of the Supreme Court, nor to comply with legislation passed by Congress. He believed that the Bank was unconstitutional and that the Supreme Court, which had declared it constitutional, did not have the power to do so without the "acquiesence of the people and the states". Further, while previous presidents had used their veto power, they had only done so when objecting to the constitutionality of bills.

The indicters seem to have understood Tany as some type of Ranter, as one of ungodly conduct who allegorized the Bible and internalized hell; as an antiscripturian universalist who repudiated gospel ordinances and averred that men might live as they wished; as one who glorified sin and maintained that the soul is God. In 1811, Arthur Hodge became the first (and only) British subject ever to stand trial for the murder of a slave. As part of his defence, Hodge argued that "A Negro being property, it was no greater offense for his master to kill him than it would be to kill his dog," but the court did not accept the submission, and point was dismissed summarily.Counsel for the prosecution averred that killing a slave had always been contrary to the common law, but cited no authority for this proposition. Counsel for the prosecution also obliquely referred to the Amelioration Act 1798 passed by the Legislature of the Leeward Islands, which applied in the British Virgin Islands.

Bryant sued the Coopers & Lybrand, a firm of chartered accountants and auditors, in a Circuit Court for damages arising from an alleged breach by Coopers & Lybrand of a verbal agreement between them. Coopers & Lybrand, in a special plea to the Bryant's particulars of claim, contended that Bryant's claim was subject to the terms of a deed of cession concluded between him and Standard Bank, and that in consequence he had divested himself of locus standi to institute the action in question. In his replication to the special plea Bryant averred that the deed, on a proper construction, covered only his business debts. The court a quo dismissed the special plea with costs, and Coopers appealed.

In Abell v Strauss, Abel applied to sequestrate the estate of Strauss, a taxi driver, on the ground that he had committed an act of insolvency in terms of section 8(a), in that he had departed from his dwelling with the intention of evading or delaying the payment of his debts. The court considered that Strauss's frequent absences from his dwelling might be attributed as much to the demands of his occupation as to an intention to avoid payment. In the court's view, it could not be inferred that Strauss had committed the act of insolvency alleged. In Bishop v Baker, the creditor averred that the debtor had left South Africa with the intention of evading or delaying payment of her debts.

Richard Field (1561–1616) was an English ecclesiological theologian associated with the work of Richard Hooker. Whereas Hooker, eight years Field's senior, had written his Lawes of Ecclesiastical Polity to defend conformity against non-conformity, Field's major work, Of the Church (1606/10), was a defence of the Protestant Church of England under its Elizabethan settlement against the charge of Romanist opponents that it was no church at all. Field maintained that Anglican piety and polity continued the pre-Tridentine Catholic conciliar tradition. He argued that all the essential doctrinal points of Protestantism had been averred and defended constantly by certain theologians of the Roman Church throughout the preceding centuries, but that this fact had been increasingly overshadowed by the influence of the prevailing papist faction.

This would-be founder of an Imperial dynasty, praised by amongst others Goethe for his insight in literature, knew the danger that Tacitus's histories might pose to one who wished to go around grabbing for power. François de Chateaubriand, for one, had already compared the new Emperor of the French to the worst emperors of Rome, warning that a new Tacitus would someday do for Napoleon what Tacitus had done for Nero. The Emperor's reaction was vicious: to Goethe and Wieland he complained that "Tacitus finds criminal intention in the simplest acts; he makes complete scoundrels out of all the emperors to make us admire his genius in exposing them". To others he swore that Tacitus, ce pamphlétaire, had "slandered the emperors" whom, he averred, the Roman people had loved.

As crown prince, Prince Ying, along with his mother, would be the ones who would rule on important matters at the capital in his father's absence during various campaigns. When Ying Bu rebelled in 196 BC, Emperor Gao was ill and considered sending Prince Ying as the commander of the forces against Ying Bu rather than campaigning himself, but at the suggestion of Empress Lü (who averred that the generals, who were generally Emperor Gao's old friends, might not fully obey the young prince), went on the campaign himself. Prince Ying was instead put in charge of home territories around the capital Chang'an, assisted by Confucian scholar Shusun Tong (叔孫通) and strategist Zhang Liang (張良). He appeared to carry out the tasks competently but without distinction.

Morisi averred that while she was employed by the Mortaras, their infant son Edgardo had fallen gravely sick while in her care, leading her to fear that he might die.

The declaration concluded by highlighting the responsibilities that would be expected of the new leaders in the Puntland government. On 29 December 2013, incumbent President of Puntland Abdirahman Mohamed Farole and his predecessor Mohamud Muse Hersi (Adde) met privately at the State House in Garowe to discuss the 2014 election process. Hersi subsequently announced at a joint press conference attended by Puntland Security Committee chairman Said Dheere and Nuradin Aden Dirie, senior adviser to UN Special Envoy to Somalia Ambassador Nicholas Kay, that the two presidential leaders agreed that credible elections would be held and that both averred to work with the victorious candidate. Hersi also stated that he would support the Vetting and Conflict Resolution Committee's parliamentary selections, and commended the Puntland administration, security chief Dheere and UN officials for their cooperation to strengthen security.

In the summer of 1790, twenty-seven Creek leaders led by Alexander McGillivray traveled to New York and signed a treaty on behalf of the "Upper, Middle, and Lower Creek and Seminole composing the Creek nation of Indians". Informed of European legal customs by his Scottish father, McGillivray provided his formal signature on behalf of the Creek delegation. Creek leaders ceded a significant portion of their hunting grounds, including land stretching to the Oconee River, to the United States and agreed to turn runaway slaves over to federal authorities, although the Creek leaders averred that convincing the Creek people to honor the new boundary lines or return African-American slaves would be difficult at best. The United States granted the Creeks the right to punish non-Indian trespassers in their territory but refused to allow the Creeks to punish non- Indians who committed crimes on Creek lands.

Moira Whelan, a former John Kerry 2004 presidential campaign staffer who left the department in July after serving as a deputy assistant secretary for digital strategy in the U.S. Department of State, averred that "anyone present for such a conversation between two heads of state should, at a minimum, have security clearance, and should also be an expert in Japanese affairs ... meeting of two heads of state [sic] is never an informal occurrence. Even a casual mention or a nod of agreement or an assertion left unchallenged can be interpreted in different ways". On December 6, Michael G. Flynn, the son of Michael T. Flynn, was forced out of the transition team. Spokesman Jason Miller did not identify the reason for Flynn's dismissal; however, The New York Times reported that other officials had confirmed it was related to a tweet he made regarding the Pizzagate conspiracy theory.

At the end of July 2019, a group of 78 parliamentarians, led by Scottish National Party (SNP) justice spokeswoman Joanna Cherry and barrister Jolyon Maugham , had made an application for judicial review to the Outer House of Scotland's highest court, the Court of Session in Edinburgh. The application was made to the court in Scotland because it sat during the summer—unlike its English counterpart—and was made in anticipation of a public u-turn on the matter from the government. The litigants sought a ruling that prorogation to avoid parliamentary scrutiny would be unconstitutional and unlawful. The government averred that the petition was "hypothetical and premature" and "that there was no reasonable or even hypothetical apprehension" that the government intended to advise that the Queen prorogue Parliament in order to prevent parliamentary scrutiny of its Brexit plans, and confirmed that averment on 23 August and 27 August.

The text of this paper was then published in collaboration with Chertok in 1987, with replies from many psychoanalysists, philosophers and sociologists, such as Georges Lapassade, Octave Mannoni and Franklin Rausky. In this paper, Borch-Jacobsen presented evidence that psychoanalytic transference is a form of altered state of consciousness, comparable with those that had existed in the work of psychotherapies which predate psychoanalysis, from Shamanism to the hypnotism of the Nancy School, by way of animal magnetism. He averred that "" ("On Freud's own admission, the phenomenon of transference is nothing other than the resurgence, in the bosom of [psycho]analytical] techniques, of the characteristic relationship (of 'rapport') of hypnosis techniques: dependence, submission, or again... exclusive worship of the doctor"). He emphasised that there is consequently an important risk of suggestion on the part of the psychoanalyst, even more so when the psychoanalyst himself is not conscious of these phenomena.

Altar of San Bartolomeo Basilica in Benevento, containing the relics of Bartholomew The 6th-century writer in Constantinople, Theodorus Lector, averred that in about 507, the Byzantine emperor Anastasius I Dicorus gave the body of Bartholomew to the city of Daras, in Mesopotamia, which he had recently refounded. The existence of relics at Lipari, a small island off the coast of Sicily, in the part of Italy controlled from Constantinople, was explained by Gregory of ToursGregory, De Gloria Martyrum, i.33. by his body having miraculously washed up there: a large piece of his skin and many bones that were kept in the Cathedral of St Bartholomew the Apostle, Lipari, were translated to Benevento in 838, where they are still kept now in the Basilica San Bartolomeo. A portion of the relics was given in 983 by Otto II, Holy Roman Emperor, to Rome, where it is conserved at San Bartolomeo all'Isola, which was founded on the temple of Asclepius, an important Roman medical centre.

James and Olds worked closely together for a year as a command team and developed both a professional and social relationship which was later renewed in combat. Olds formed a demonstration team for the F-101 using pilots of his wing, without command authorization, and performed at an Air Force open house at Bentwaters. He asserted that his superior at Third Air Force attempted to have him court-martialed, but the commander of USAFE, General Gabriel P. Disosway, instead authorized his removal from command of the 81st TFW, cancellation of a recommended Legion of Merit award, and transfer to the headquarters of the Ninth Air Force at Shaw Air Force Base, South Carolina.. Olds averred that he deliberately staged the incident to have his name removed from the 1965 selection list to brigadier general. Promotion would have meant the end of his flying career and refusal of the promotion would have resulted in his retirement from the Air Force.

It does not appear that the provisions which prohibited cruel and unusual punishments were widely enforced. However, in at least one notable instance, the trial of Arthur Hodge for the murder of one of his slaves, the Act was cited obliquely. Hodge's counsel, at the bail hearing, had argued that "A Negro being property, it was no greater offense for his master to kill him than it would be to kill his dog," a submission that was ridiculed by the prosecution, but, being unable to cite authority to refute it, made reference to the Act and averred that it was completely inconsistent with being entitled to kill slaves. Use of the term "cruel and unusual punishments", derived from the English Bill of Rights might have also been influenced by its inclusion in the Eighth Amendment to the United States Constitution some ten years previously, whose text was well known to English- speaking jurists.

His Anticipations of the Reaction of Mechanical and Scientific Progress Upon Human Life and Thought: An Experiment in Prophecy, was first serially published in The Fortnightly Review in 1901. His appeal to the Full Bench was dismissed, whereupon he appealed to the Appellate Division. The court held that it had been common cause at the time of appellant's original application that it had been the respondent's intention to sell the land first, subject to lease, and only if the amount of the judgment debt was not realised, free thereof, and that this was in complete accordance with the common law as well as with the established legal procedure in sales in execution. Furthermore, the court held that, if the land was sold free of the partiarian lease agreement, the appellant's averred lien would lapse, and the holders of real rights of security in the land would become preferent creditors in respect of the proceeds of the sale. It was only where the appellant, as lienholder elected to lay claim to part of the proceeds, and the deputy sheriff had to decide whether or not to allow it, that an application for a declaratory order as to the existence of the lien (as prayed for in prayer 1) became necessary.

Prior to the closing ceremony of the Olympiad, FIDE vice president Zurab Azmaiparashvili was arrested by the local law enforcement as he attempted to ascend the stage. Security officers, in conjunction with local police, did not permit Azmaiparashvili access to tournament organizers, and a struggle ensued after which Azmaiparashvili, having sustained several injuries, was arrested; he secured his release on bail for €500 after having been held for 40 hours, and the charges against him were later dropped. A Georgian, Azmaiparashvili undertook to inform the presenter of the Nona Gaprindashvili Trophy that the latter ought more clearly to explain Gaprindashvili's contributions to the game of chess (Gaprindashvili had been World Champion for 17 years), but was barred by security. Azmaiparashvili and FIDE averred that Azmaiparashvili was detained and physically accosted despite his having properly and clearly [displayed] his VIP credentials , whilst representatives of the Spanish chess federation ("Federación Española de Ajedrez") and tournament organizers blamed Azmaiparashvili for the incident, saying that he without any previous provocation, assaulted [an] agent with a head butt to [the] mouth .

Malia states that "The Black Book offers us the first attempt to determine, overall, the actual magnitude of what occurred, by systematically detailing Leninism's 'crimes, terror, and repression' from Russia in 1917 to Afghanistan in 1989". Malia also argues against what he terms "the fable of 'good Lenin/bad Stalin'", stating that there never was a "benign, initial phase of Communism before some mytical 'wrong turn' threw it off track", claiming that Lenin expected and wanted from the start a civil war "to crush all 'class enemies'; and this war, principally against the peasants, continued with only short pauses until 1953". Malia further states that the Red Terror "cannot be explained as the prolongation of prerevolutionary political cultures", but rather as "a deliberate policy of the new revolutionary order; and its scope and inhumanity far exceeded anything in the national past". Malia laments that "'Positivist' social scientists [...] have averred that moral questions are irrelevant to understanding the past" and criticizes this perspective by arguing that it "reduces politics and ideology everywhere to anthropology".

In 1777 after the Mansfield decision in England, a servant in Scotland, Joseph Knight, sought the freedom to leave the employment of John Wedderburn of Ballendean, and claimed in his pleadings that the very act of landing in Scotland freed him from perpetual servitude, as slavery was not recognised in Scotland (records do not now record whether this was on the basis of the Mansfield decision). Many years earlier Knight had been purchased by Wedderburn in Jamaica from a slave trader, although his status at the time of the trial was the subject of disagreement (Knight averred that Wedderburn wished to take him back to Jamaica to sell him on as a slave in the colonies, which Wedderburn denied). The case caused disagreement in the courts as Wedderburn, referred to through the document as "The Complainer", insisted that slavery and perpetual servitude were different states. He argued that in Scots law Knight, even though he was not recognised as a slave, was still bound to provide perpetual service in the same manner as an indentured servant or an apprenticed artisan.

The appellant government of South Africa had instituted action in a Local Division against the respondent, Fibrespinners & Weavers, for damages for the loss of certain grainbags which had been stored by the respondent for reward in terms of a contract of deposit. In terms of a letter written by the government, replacing the terms of the original contract, Fibrespinners was, in consideration for arranging and maintaining, inter alia, an all-risks insurance policy covering the grainbags, "absolved from all responsibility for loss of or damage howsoever arising in respect of" the grainbags "whilst in the care of your company and in or upon any premises owned or used by your company." Over a period of time a quantity of the grainbags had been stolen by three persons, one of whom was Fibrespinners' chief security officer. The government averred that Fibrespinners was liable on the following alternative grounds: # by reason of its breach of contract in failing, upon demand, to deliver to the government the grainbags in question; # by reason of gross negligence; # by reason of negligence; or # by reason of vicarious responsibility for the theft committed by its servant.

In June 2015, the special rapporteur from the United Nations' Office of the High Commissioner for Human Rights specifically mentioned Tor in the context of the debate in the U.S. about allowing so-called backdoors in encryption programs for law enforcement purposes in an interview for The Washington Post. In July 2015, the Tor Project announced an alliance with the Library Freedom Project to establish exit nodes in public libraries. The pilot program, which established a middle relay running on the excess bandwidth afforded by the Kilton Library in Lebanon, New Hampshire, making it the first library in the U.S. to host a Tor node, was briefly put on hold when the local city manager and deputy sheriff voiced concerns over the cost of defending search warrants for information passed through the Tor exit node. Although the DHS had alerted New Hampshire authorities to the fact that Tor is sometimes used by criminals, the Lebanon Deputy Police Chief and the Deputy City Manager averred that no pressure to strong-arm the library was applied, and the service was re-established on 15 September 2015.

The plaintiff was felt to have simply overdone the fictions, and was allowed to amend his declaration to allege the sale of a slave in the royal colony of Virginia, where slavery was recognised by colonial law, and the English courts would recognise and enforce the rights arising under Virginian law. Slaves were regularly bought and sold on the Liverpool and London markets, and actions on contract concerning slaves were common in the 18th century without any serious suggestion that they were void for illegality. Even the statement made in the various trover decisions appear to have been directed to good pleading rather than the legality of slavery: a pleading which averred the conversion of a "negro" rather than a "slave" would fail, as there was no inherent reason why a black person should not be a free man. In 1706 Chief Justice Holt refused an action for trover in relation to a slave holding that no man could have property in another,Smith v Gould 2 Salk 666 (1706); Ray 1274 but held that an alternative action, trespass quare captivum suum cepit, would be available, which was actually felt to have strengthened the legal position of slaveowners.

The complainants also claimed, under the stipulations of the mortgages, the amount of certain premiums of insurance paid by them. By an amended bill making the mayor and aldermen of Jersey City a defendant, the complainants alleged that the city claimed a lien on the mortgaged premises prior to that of the mortgages for certain water rents for supplying water to the occupants of the same for the year 1871, and from thence to the time of filing the bill; that this claim was made under an act of the legislature time of filing the bill; that this claim authorizing the construction of waterworks for the city, and the act revising the city charter, passed in March 1871. The bill denied the validity of this claim, and averred that those portions of the said acts which purported to give such a priority had the effect to deprive the complainant of its property in the mortgaged premises without due process of law, and were in violation of the Constitution of the United States as well as that of New Jersey, and the complainant prayed for a foreclosure and sale of the lot in question as against all the defendants.
