NEW YORK (Reuters) - AT&T Inc, the No. 2 U.S wireless provider, said on Wednesday that it would roll out a new data plan that does away with overage fees and reduces data speeds for wireless customers who surpass their data allowance.

Those moments were exciting, and nothing says they cannot return, provided you rebut the notions that universal domination is a sane business model or that New York is forever condemned to becoming a playpen for overage toddlers living on Daddy or Mommy's dime.

Some of T-Mobile's earlier Un-carrier efforts — the end of two-year contracts and device subsidies, phasing out data overage charges, and zero-rating popular streaming services — have reverberated throughout the US mobile industry and led Verizon, AT&T, and Sprint to at times copy or put their own spin on T-Mobile's ideas for "shaking up" the carrier model.

Data overage charges have long been a gripe for wireless customers who increasingly spend time on their mobile devices watching streaming video services such as Netflix and playing games such as Pokemon Go. The move came after AT&T's bigger rival, Verizon Communications Inc, announced a feature last month called "safety mode" that protects users against data overages and slows down speeds.

The updated backup service promises a number of speed increases (with backup being up to 50 percent faster, depending on the network conditions) and less overhead, as well as the ability to keep the service from using certain networks to help users avoid overage charges when they are using a mobile hotspot, for example (or when their ISP only gives them a certain bandwidth allotment).

As such, you can be certain a Comcast-approved law wouldn't cover all of the areas where net neutrality violations are actually currently occurring, whether that's Comcast's use of arbitrary and unnecessary usage caps and overage fees (and zero rating of its own content), or the interconnection shenanigans we witnessed when ISPs let peering points congest to drive up costs for content and transit companies.

Caps and overage fees not only provide ISPs a nifty way to raise rates, they're useful as a weapon to make cord cutting more expensive by imposing additional fees on users who switch to alternative streaming services like Hulu, YouTube TV, or Sling TV. AT&T has long tried to use usage caps and zero rating to give its own content a distinct advantage in the streaming video market.

Blackburn's proposed law bans behaviors ISPs were never interested in (like the outright blocking of websites), but avoids doing anything about the numerous areas where net neutrality violations actually occur—from usage caps, overage fees and "zero rating," to efforts to charge for "paid prioritization" (letting one company buy an unfair network advantage over another.) That said, AT&T is the very last company that should be leading the conversation on consumer welfare online.
