Krottelbach shared history in early modern times with the Duchy of Palatinate-Zweibrücken up until it was brought to an end by the French Revolution. In India, Vivekachudamani is widely believed to be authored by Adi Shankara (or Adi Shankaracharya). Paul Hacker, an Indologist and scholar of Advaita, set out a methodology for ascertaining authorship of Advaita texts and he concluded that though the Vivekachudmani is unusual in parts, it was likely authored by Adi Shankara. This Mankavil achen arrested the yakshi with his Divine power and the yakshi requested him to install her to a paala tree (Alstonia Scholaris) which he refused and her soul sent permanently to rest in peace.
The absence of reliable historical sources and factual information, aside from Islamic traditionists' sources and stories, make ascertaining the truth about the pre-Islamic way of life and culture almost impossible to substantiate. Some scholars rely on the Quran and Hadith to gain information about pre- Islamic Arabia. Since there was no fully developed system of writing in Arabia during this time period, the sources are limited to traditions, legends, proverbs and above all to poems; most of which were not recorded in writing for an additional two to four hundred years later, during the second and third centuries of the Hijrah. Late in May 1780, Trumbull sailed for her first foray into the Atlantic. Action was not long in coming. At 1030 on 1 June 1780, Trumbulls masthead lookout sighted a sail to windward. In order to remain undetected for as long as possible, the frigate furled her sails until 1130. For a defendant to be deemed negligent, he must have breached his duty of care towards the plaintiff. In order to be deemed as breaching the duty of care, his actions must be proven to fall below the standard of care likely to be taken by the reasonable man. Establishing a breach of duty and ascertaining the standard of care is complex and before establishing that the duty of care has been breached the plaintiff must first prove that the defendant owed him a duty of care. The beatification process commenced in Milan with a diocesan process that Blessed Cardinal Alfredo Ildefonso Schuster opened; the process spanned from 27 May 1931 until 22 September 1938. The process also saw the collation of Sala's writings that included personal reflections and letters as a means of ascertaining the depth of her spiritual life. The decree on her writings - as a sign of approval - was signed on 3 December 1944. The Oxford or Tractarian movement, named after their publication "Tracts for the Times", was formed at Oxford in 1833 as a new school of churchmanship. A Court of Arraye (or View of Men at Arms) was a method of ascertaining numbers of men capable of fighting in towns and cities before England had a standing army. The Jurors (Scotland) Act 1745 (19 Geo 2 c 9) was an Act of the Parliament of Great Britain, passed during the Jacobite Rising of 1745. Its long title was "An act for the more easy and speedy trial of such persons as have levied, or shall levy war against his Majesty; and for the better ascertaining the qualifications of jurors in trials for high treason or misprision of treason, in that part of Great Britain called Scotland." In Twinsectra Ltd v Yardley,[2002] UKHL 12 the House of Lords reviewed the law, and the leading judgment was given by Lord Millett, whose judicial analysis unsurprisingly closely mirrored what he had suggested twenty years previously. The key issue, according to Lord Millett, in upholding the trust concept is ascertaining where the beneficial interest in the money lies.

The Pennsylvania Council on the Arts (PCA) is an agency serving the U.S. state of Pennsylvania. Its mission is to strengthen the cultural, educational, and economic vitality of Pennsylvania's communities through the arts. The annular hurricane was first defined as a subset of tropical cyclones by John Knaff of Colorado State University and James Kossin of the University of Wisconsin–Madison in 2002 by use of infrared satellite imagery, which serves as the visual means of ascertaining annular characteristics within tropical cyclone. Knaff and Kossin defined an annular tropical cyclone as a tropical cyclone that maintains either an average or larger-than-average eye surrounded by deep convection containing the storm's inner core and a lack of convection occurring outside the central dense overcast for at least three hours. As a result, annular storms lack the rainbands characteristic of typical tropical cyclone. These features lend the storm an axisymmetric appearance common to annular tropical cyclones.

Leaving Mexico in December 1919, Borodin, Roy, and Phillips travelled to western Europe, where they intended to spread the communist cause in the lead up to the congress, specifically hoping to establish a communist party in Spain. Arriving in Moscow in the weeks before the congress, Borodin introduced Roy to Lenin, after which he went on to become a major figure in the Comintern. Borodin later returned to Britain, where he was tasked with ascertaining the cause of the revolution's failure there, and reorganising the British Communist Party.
In a long and detailed article on this matter published in Australiana November 2014 Vol 36 No. 4, John Hawkins details the association between these two men and the probability that this instrument is one and the same, the world's first pocket chronometer originally destined for Cook's second voyage, purchased by Banks and lent to Phipps. In 1773, Captain Phipps made a voyage to the North Pole, taking with him not only his Arnold pocket timekeeper and an Arnold box timekeeper in gimbals, but also Kendall's "K2" timekeeper. After embarking a cargo of 82,266 barrels of wheat flour, West Compo left Portland on February 9 also carrying on board federal inspectors. He would make the animal insensible, effectively via almost suffocating it with carbon dioxide, then determine the effects of the gas by amputating one of its limbs. In 1824, Hickman submitted the results of his research to the Royal Society in a short treatise titled Letter on suspended animation: with the view of ascertaining its probable utility in surgical operations on human subjects.
On 7 May 2015, Chumani Maxwele was given a provisional suspension order because UCT authorities "considered his continued presence on the campus as being a threat to the maintenance of good order." The Albury was the first steamer known to visit Gundagai. The steamer Albury was tied up to an old gum tree at Gundagai by Mr Norton of Gundagai who two years previously had the honour of naming the boat that set off from Gundagai to survey the Murrumbidgee under the command of Captain Robinson, the Explorer. Captain Robinson's 1855 survey of the Murrumbidgee in the Explorer was "for the purpose of ascertaining If that river presents any serious impediments to internal navigation" and the incentive for that survey came from Captain Cadell. There are divergent opinions regarding how many people practice Afro-Cuban religions on the island. In the 1980s, the secretary-general of the Roman Catholic episcopate, Monsignor Carlos de Céspedes estimated that about 85 percent of Cubans practiced an Afro-Cuban religion. In 1991, the Cuban anthropologist López Valdés suggested that about 90 percent of Cuba's population practiced some form of religion and that of that 90 percent, a greater number practiced one of the Afro-Cuban religions than "pure Catholicism".

As none of the documents found on the dead had dates later than April 1940, the Soviet secret police planted false evidence to place the apparent time of the massacre in mid-1941, when the German military had controlled the area. NKVD operatives Vsevolod Merkulov and Sergei Kruglov issued a preliminary report, dated 10–11 January 1944, that concluded the Polish officers were shot by German soldiers. In January 1944, the Soviet Union sent another commission, the Extraordinary State Commission for ascertaining and investigating crimes perpetrated by the German-Fascist invaders to the site; the commission's name implied a predestined conclusion. It was headed by Nikolai Burdenko, the president of the USSR Academy of Medical Sciences (hence the commission is often known as the "Burdenko Commission"), who was appointed by Moscow to investigate the incident.
Tsushima approached Korsakov at 16:00 on 20 August 1904 and observed smoke rising from the harbor, ascertaining that it was from Novik. She then sighted Novik steaming south from Korsakov at 16:30 and opened fire on her. Born in Franklin County, Kentucky; completed preparatory studies; studied law; was admitted to the bar and practiced; moved to Pensacola, Florida in 1821; one of the commissioners under the act of Congress of May 8, 1822, "for ascertaining claims and titles to lands within the Territory of Florida"; elected to the Nineteenth United States Congress and to the five succeeding Congresses (March 4, 1825 – March 3, 1837); unsuccessful candidate for reelection to the Twenty-fifth United States Congress; author of a New Collection of Laws, Charters, etc., of Great Britain, France, and Spain Relating to Cessions of Lands, with the Laws of Mexico, in two volumes published in 1839. The field of Nirukta deals with ascertaining the meaning of words, particularly of archaic words no longer in use, ones created long ago and even then rarely used. The Vedic literature from the 2nd millennium BCE has a very large collection of such words, with nearly 25% of the words therein being used just once. By the 1st millennium BCE, interpreting and understanding what the Vedas meant had become a challenge, and Nirukta attempted to systematically propose theories on how words form, and then determine their meaning in order to understand the Vedas. Yaska, the sage who likely lived around the 6th-century BCE, approached this problem through a semantic analysis of words, by breaking them down into their components, and then combined them in the context they were used to propose what the archaic words could have meant.
The correspondence problem refers to the problem of ascertaining which parts of one image correspond to which parts of another image, where differences are due to movement of the camera, the elapse of time, and/or movement of objects in the photos. In 2019, while organizing an exhibition of her paintings at Ariana Gallery, a major art center in Tehran, Miliani was again accused of plagiarizing four different artists, including Matteo Arfanotti, Sara Riches, Richard Burlet and Masumeh Mehdizadeh. On July 22, 1933, using his trademark machine gun, George "Machine Gun" Kelly, along with Albert L. Bates, interrupted a bridge game at Charles F. Urschel's residence in Oklahoma City, abducting Urschel and his guest, fellow oilman Walter R. Jarrett (who would later relocate to Midland, Texas, where he died in 1947 aged 60), at gunpoint while their wives helplessly watched. This began a startling kidnapping case that evoked the new Lindbergh kidnapping laws, led to twenty-one convictions, coined a new name for Federal Bureau of Investigation agents, and culminated in one of the first filmed trials. Hearder was the inventor in 1842 of a magnetometer, which he created with the object of ascertaining the rate of magnetic development in iron.
Soon thereafter, she spotted a dinghy, awash in the sea, containing four men, 1,500 yards off her port bow, and three life rafts lashed together about 1,000 yards beyond. Andres then steered various courses and speeds, picking up men from the water; these proved to be the 31 survivors (28 merchant seamen and three members of the Navy armed guard detachment) of USAT Oneida, which, after straggling from a coastal convoy en route from New York to Guantánamo Bay, had foundered and sunk in bad weather at 0213 on 4 May, some 70 miles northeast of Cape Charles. The men had drifted nine and a half miles since the sinking. Completing the rescue effort at 1950, and ascertaining from the survivors than no additional boats and rafts had gotten clear of Oneida before she had gone down, Andres then resumed her voyage to Philadelphia.
Among the many works projected and carried out during these years under his supervision were the building of the large reservoir in Central Park, the enlargement of pipes across High Bridge, and the construction of the reservoir in Boyd's Corners, Putnam co. He aimed, as others had tried before him, to draw up in a single code all the laws of France, but was unable to accomplish his task. Investigators with the Deschutes County Sheriff's Office, assigned to process the scene of Robert "LaVoy" Finicum's shooting, were accounting for the two known sets of shots fired by the OSP officers during the event (the shots that killed Finicum, and the earlier shots that struck his vehicle) when they discovered a bullet that struck the roof of the truck at a different trajectory. After ascertaining the bullet's existence with cell phone video taken by Shawna Cox, investigators modeled the bullet's trajectory using computers, and determined that the bullet was fired from the direction where two FBI agents were standing. They later determined that an operator with a FBI Hostage Rescue Team fired twice at Finicum, missing and injuring militant Ryan Bundy in the process. The agent, whose identity was withheld, was under investigation, along with four other FBI agents who were suspected of attempting to conceal evidence of the gunshots.
Her third patrol was even more controversial, as a fruitless passage across the Atlantic brought her to the Brazilian coast in mid-August 1942. There she searched for Allied shipping hugging the coastline in Brazilian territorial waters heading for North America. Here she again saw unescorted ships and a lit coastline, and Schacht made the inexplicable decision to attack without first ascertaining the nationalities of her targets. The first was the Brazilian SS Baependy on 16 August, which was torpedoed and sunk with 270 civilian lives. A few hours later the SS Araraquara was sunk, killing 131 people, followed by the SS Annibal Benevolo, on which 150 civilians drowned. The next day the slaughter continued, the SS Itagiba sunk within sight of the city of Valença, killing 36, and the SS Arara similarly sunk with 20 deaths as she picked up the survivors of the Itagiba.
As time went on, the ethnographic studies and their resultant categorisations were embodied in numerous official publications and became an essential part of the British administrative mechanism; of those categorisations it was caste that was regarded to be, in Risley's words, "the cement that holds together the myriad units of Indian society". The desire for ethnographic studies was expressed by another Raj administrator, Denzil Ibbetson, in his 1883 report on the 1881 census of Punjab: Risley's survey task was aided when research papers of a recently deceased Indian Medical Service doctor, James Wise, were given to him by the doctor's widow. Wise had researched the people of Eastern Bengal and it was agreed that, after ascertaining the accuracy of his work, his research should be incorporated into Risley's survey results. In return, those volumes of the survey dealing with ethnographic matters would be dedicated to Wise.

On 3 March, the landing was preceded by a small reconnaissance patrol, consisting of an Australian officer – Marshland – an American and two indigenous scouts, which was put ashore by PT boat. After determining contacting friendly local inhabitants and ascertaining the strength and dispositions of the Japanese in the vicinity, the patrol had departed the peninsula and returned to Iboki around midnight on 3 March by PT boat. The following couple of days were used for battle preparation, after which the US force set off for the overnight journey on, embarking from the 5th Marines' base at the Iboki Plantation at 13:00 on 5 March 1944 upon a fleet of 60 assorted types of landing craft escorted by five PT boats.

To determine which is in front and which is behind, Clark proposed his SLOB rule, as a complicated set of three radiographs, but which can be simplified as follows using just two: :Expose another film while angle of the x-ray beam has been changed.
When Featherston read Potter's conclusions, he promoted his old enemy to Brigadier General and allowed Potter to manage operations against the US. Prior to Operation Blackbeard in June 1941, Potter and his agents were instrumental in keeping the US off-guard while ascertaining American strength and doctrine. Though Featherston acted too rashly for Potter's comfort (he was convinced that had his advice been acted on the invasion would have been a strategic as well as tactical surprise), Potter's competent organization of pro-Confederate saboteurs helped George Patton's army reach Lake Erie by August. These stories often featured contemporary forensic facial reconstructions of how the child had most likely appeared in life. All initial efforts proved unsuccessful with ascertaining the identity of Delta Dawn via this technique. The JSEC was announced at the same time as Joint Force Command Norfolk, established to help protect maritime transport and sea lines of communication between North America and Europe; Its design in modeled after a Bundeswehr Joint Support Service Command. The command was designed in light of growing hostilities between European countries and Russia since the annexation of Crimea in 2014 and in response to logistic and bureaucratic hurdles limiting military logistics in case of a crisis. A research paper by the German Federal Academy for Security Policy mentions specific logistical issue such as modernizing diplomatic clearances required for troop movement, loading capacity standards for trucks, ascertaining which roads, tunnels and bridges in Europe can withstand tank and other heavy vehicle's movement. The German Federal Academy for Security Policy's view is that the forming of JSEC is a possible driver for the establishment of a "Military Schengen".

For this reason, professionals are minded to keep detailed histories of care provision, which demonstrate the duration to which the child is exposed to periods of subnormal exposure to care, stimulation, and nutrition.
Bosio's Roma Sotterranea is entirely devoted to a description of the cemeteries with the end of ascertaining all that was possible regarding the history of each cemetery, by what name it was known in antiquity, who its founders were, and what martyrs and illustrious Christians were interred there. Many of his conclusions have in modern times been found to be erroneous, but Bosio's method is acknowledged to have been scientific within the shortcomings of the infant science of archaeology. The engravings that accompanied the volume are of little use to the modern archaeologist. An unfortunate result of the publication was that with the locations known, the catacombs were scoured for anything that might prove of value on the market; though much information on the condition of the catacombs and their inscriptions and frescoes in the early 17th century was preserved in Bosio's volume, much also was lost.
While Brown's Elementa Medicinae had been known in Germany, it was not made available until 1794, when Adam Melchor Weikard, former physician to Catherine the Great of Russia, arranged for its publication in Latin after having had it brought to his attention by Andreas Röschlaub, a medical student (who was himself given a copy in 1793 by a friend). In 1795, Weikard prepared and published a German translation. In 1796, a second German translation, by Christoff Pfaff, appeared and a second edition in 1798 came with a critical review. Röschlaub had also made a translation, but did not publish (in three volumes) until Weikard's second edition went out of print in 1806 which became the standard and last German edition (the year of Hahnemann's pivotal essay on the 'elements' of his new system, On A New Principle for Ascertaining the Curative Power of Drugs).

The beatification process commenced with an informative process that was assigned to collating all documentation pertaining to his life and documents that could attest to his potential sainthood – this local process spanned from 27 July 1930 and concluded its business on 22 November 1940. Theologians gathered all his writings and were tasked with ascertaining whether or not his views were in line with the magisterium of the faith; his writings received approval in a decree on 2 August 1942. These processes commenced despite the fact that formal approval of the cause from the Congregation of Rites – under Pope Pius XII – did not come until 22 June 1951 and bestowed Fusco with the posthumous title of Servant of God. There he meets a student who tells him about some of the recent discoveries made by Socrates, the head of The Thinkery, including a new unit of measurement for ascertaining the distance jumped by a flea (a flea's foot, created from a minuscule imprint in wax), the exact cause of the buzzing noise made by a gnat (its rear end resembles a trumpet) and a new use for a large pair of compasses (as a kind of fishing-hook for stealing cloaks from pegs over the gymnasium wall). In Ancient Greece, dokimasia (Greek: δοκιμασία) was the name used at Athens to denote the process of ascertaining the capacity of the citizens for the exercise of public rights and duties. If, for instance, a young citizen was to be admitted among the epheboi, he was examined in an assembly of his district to find out whether he was descended on both sides from Athenian citizens, and whether he possessed the physical capacity for military service. All officials, too—even the members of the Boule, the Council of 500—had to submit to an examination before entering upon their office. The purpose of this was to ascertain not their actual capacity for the post, which was presupposed in all candidates, but their descent from Athenian citizens, their life and character, and (in the case of some offices which involved the administration of large sums) even the amount of their property.

Further pursuing this line of thought, but utilizing the moral rationale of "ought", Kant's third critique, Critique of Judgement begins by examining the realm of aesthetics in route to ascertaining; as Wilber paraphrases it, "that the interior "ought" of moral reasoning could never get going in the first place without the postulates of a transcendental Spirit". Another important consideration in the context of animal research during spaceflight is that one can perform a straightforward experiment in which there is no requirement to provide some type of countermeasure intervention as there is for humans, and can thereby avoid the introduction of a confounding variable in ascertaining the true effects of spaceflight on a wide range of physiological variables. Also, given the remarkable agreement in the quantitative and qualitative nature of the findings observed in the spaceflight studies versus those obtained from ground-based HS studies, we have chosen to combine and integrate significant portions of the data that have been gathered in the last 25 years. This rodent data base in space life sciences research includes 14 flight experiments with 8 sponsored by the Russian Cosmos Program and 6 sponsored by NASA Space Life Sciences (SLS) and Space Transportation System (STS) missions. These flight experiments are complemented by numerous ground-based research studies that focused collectively on the topics described below.
But instead of the severe punishment that a junior officer like Ōshima might have otherwise received for his reckless dealings with a foreign head of government, Ōshima's advance was acknowledged positively by the Japanese hyper-militarists, who were sympathetic to Hitler's policies and impressed by Ōshima's successes. In late October 1935, the chief of the Japanese army's general staff, Prince Kan'in Kotohito, signalled that the army was positively predisposed towards a pact with Germany. Kotohito had been a close associate of Hiroshi Ōshima's father Ken'ichi Ōshima, Japan's Minister of the Army 1916–1918, and was thus positively predisposed towards Hiroshi Ōshima's activity in Europe, and likely one of Ōshima's protectors in the question of Ōshima stepping out of line of his initial assignments. Kotohito assigned a general staff intelligence officer, Tadaichi Wakamatsu, with a mission in Berlin that involved ascertaining the German attitude towards a German-Japanese agreement directed against the Soviet Union.

Floyd is implicated in the scandal of the "Abstracted Indian Bonds", which broke at the end of 1860 as the Buchanan administration was reaching its end. His wife's nephew Godard Bailey, who worked in the Interior Department and who removed bonds from the Indian Agency safe during 1860, was also implicated. Among the recipients of the money was Russell, Majors, and Waddell, a government contractor that held, among its contracts, the Pony Express. In December 1860, on ascertaining that Floyd had honored heavy drafts made by government contractors in anticipation of their earnings, the president requested his resignation.

In inferential statistics, there exists a mantra 'correlation does not equal causation.' Just because rain and wet grounds do have a positive correlation (they tend to happen together), without more information it would be impossible to know whether or not it was in fact the rain which caused the ground to become wet, so the positive correlation is insufficient for causation. A dump truck could well have come by and dumped out a truckload of water onto the ground, or a man could have dropped his water, or any number of other possible antecedents could be responsible for causing the conclusion that the ground is in fact wet to be true. In this way, ascertaining cause and effect relations is quite hard and arguably impossible barring some variable uncertain degree of confidence in some specific possible cause in relation to all other uncontrolled for potentially equally or unequally probable but still possible causes (some non-100% degree of confidence, known as a confidence interval in inferential statistics).
Sauer published his account in London in 1802 under the title of An account of a geographical and astronomical expedition to the northern parts of Russia: for ascertaining the degrees of latitude and longitude of the mouth of the river Kovima, of the whole coast of the Tshutski, to East Cape, and of the islands in the eastern ocean, stretching to the American coast, performed ... by Commodore Joseph Billings, in the years 1785, &c; to 1794. Sauer says that his report was "taken from the journal written for Captain Billings, which I copied from the ship's journal kept by the Master Batakoff and his mates" (p.xiii). However, his narrative is also based on his own notes and recollections. He explicitly says, "During my travels, I was frequently necessitated to take notes on small pieces of paper; those I have faithfully transcribed; but in some instances I have been obliged to refer to memory" (p. xii).

His public autopsy was performed on January 28, but officials withheld the autopsy report from the press until March 8. Cause of death was listed as three gunshot wounds of the back, abdomen and chest. All wounds were specified as gunshot entry from the back (posterior left shoulder, left upper back and right lower back.) Investigators with the Deschutes County Sheriff's Office, assigned to process the scene of Finicum's shooting, were accounting for the two known sets of shots fired by the OSP officers during the event (the shots that killed Finicum, and the earlier shots that struck his vehicle) when they discovered a bullet that struck the roof of the truck at a different trajectory. After ascertaining the bullet's existence with cell phone video taken by one of Finicum's passengers, investigators modeled the bullet's trajectory using computers, and determined that the bullet was fired from the direction where two FBI agents were standing.
Volodymyr Zelensky with Donald Trump in New York City on September 25, 2019 On September 20, Roman Truba, head of the Ukraine State Bureau of Investigations, told The Daily Beast that his agency had not investigated the Biden–Burisma connection and there were no signs of illegality there. Anton Herashchenko, a senior advisor to the Ukraine interior minister, told The Daily Beast that Ukraine will open such an investigation if there is an official request, along with details of why an investigation is needed and what to look for. Trump's requests have come through unofficial representatives such as Giuliani. However, according to interviews and documents obtained by The New York Times, senior Ukrainian officials were aware that military aid was being withheld by the first week in August, and after initially having difficulty ascertaining what was holding up the aid, by September Trump's envoy to Ukraine Kurt Volker was in negotiations with Zelensky's senior aide Andriy Yermak over the wording of the proposed public statement.
There have been a number of cases that have come before the Constitutional Court requiring it to interpret and apply the rights and principles in the Constitution pertaining to ACL. In doing so, the CC has not only been faced with the challenge of elucidating the extent to which ACL is now recognised, but it has also had to address the issue of how to go about ascertaining what that law in fact is. The first such substantive case is Alexkor Ltd and Another v the Richtersveld Community and Others, which involved the appeal of a claim for restitution of land by the Richtersveld Community ('the Community'), an indigenous South African community, in terms of the Restitution of Land Rights Act. The Constitutional Court therefore had to examine whether or not the Community had rights in land in 1913 and, if so, whether or not it was subsequently dispossessed 'as a result of past racially discriminatory laws or practices.
The existence of section lines made property descriptions far more straightforward than the old metes and bounds system. The establishment of standard east-west and north-south lines ("township" and "range lines") meant that deeds could be written without regard to temporary terrain features such as trees, piles of rocks, fences, and the like, and be worded in the style such as "Lying and being in Township 4 North; Range 7 West; and being the northwest quadrant of the southwest quadrant of said section," an exact description in this case of 40 acres, as there are in a square mile. The importance of "sections" was greatly enhanced by the passage of "An Ordinance for ascertaining the mode of disposing of lands in the Western Territory" of 1785 by the U.S. Congress (see Land Ordinance of 1785). This law provided that lands outside the then- existing states could not be sold, otherwise distributed, or opened for settlement prior to being surveyed.
Highlighting the ship's deployment to the western Pacific, Warbler conducted numerous tours of duty on "Operation Market Time" patrols off the coast of Vietnam to aid in the interdiction campaign to cut off the flow of arms and munitions to the Viet Cong in South Vietnam. A small wooden craft especially designed for coastal minesweeping operations and deployments lasting from a few days to several weeks, Warbler and her sister minesweepers filled the gap between the heavier units of the fleet, like the destroyers and destroyer escorts, and the small craft used for patrol work, until built-for- the-purpose patrol craft could enter the fray. During her "Market Time" cruises, Warbler boarded many junks, ascertaining cargo and destination; investigated contacts of steel-hulled vessels picked up on radar; and endured what at times appeared to be "fearfully strong weather that seemed bent on total destruction" of the ship. At times, boarding of junks was an impossibility because of the vagaries of monsoon-type weather.

The case refers to vacant land at Woolloomooloo where a surveyor had difficulty in ascertaining the boundaries as he could not find a plan from the days of Governor Lachlan Macquarie. In the case it stated, "...and he pointed to some old stumps, which he said had been marked...defendant would not admit that the cross line marked by me on the plan was not part of his boundary...he said it ran to a black stump beyond the line, which he said had been marked...; he said the line was to run somewhere thereabouts; utmost extent claimed by defendant was the black stump of which I have spoken...made no claims beyond South Head road..." One theory states that the expression derives from the use of black stumps in the landscape as markers when directing travellers. Other explanations relate to historical events associated with places or geographical features with names incorporating the phrase "black stump".
In passing, the court cited Bates v Coe 98 US 31, 38 (1878), but otherwise does not focus on the intent of a Patentee, as discernible from a patent specification. > [I]n case of doubt or ambiguity it is proper in all cases to refer back to > the descriptive portions of the specification to aid in solving the doubt or > in ascertaining that true intent and meaning of the language employed in the > claims. For UK-EPC patents, while Article 69 prevents equivalence from extending protection outside the claims, equivalence can be an important part of the background of facts known to the skilled person which would affect what he understood the claims to mean. This is also expressly provided by the new Article 2 added to the Protocol by the Munich Act revising the EPC, dated 29 November 2000 (but which has not yet come into force): > (2) For the purpose of determining the extent of protection conferred by a > European patent, due account shall be taken of any element which is > equivalent to an element specified in the claims.
Saussure adapted the thermometer to many purposes: for ascertaining the temperature of the air he used one with a fine bulb hung in the shade or whirled by a string, the latter form being converted into an evaporimeter by inserting its bulb into a piece of wet sponge and making it revolve in a circle of known radius, at a known rate; for experiments on the earth and in deep water he employed large thermometers wrapped in non-conducting coatings so as to render them extremely sluggish, and capable of long retaining the temperature once they had attained it. With these instruments Saussure showed that the bottom water of deep lakes is uniformly cold at all seasons, and that seasonal changes in temperature take six months to penetrate to a depth of 30 ft. in the earth. He recognized the immense advantages to meteorology of high-level observation stations, and whenever it was practicable he arranged for simultaneous observations to be made at different altitudes for as long periods as possible.
Rateable value, the basis of assessment, is defined in Section 7(2) of the Rating Ordinance as: “…an amount equal to the rent at which the tenement might reasonably be expected to let, from year to year, if – (a) the tenant undertook to pay all usual tenant’s rates and taxes; and (b) the landlord undertook to pay the Government rent, the costs of repairs and insurance and any other expenses necessary to maintain the tenement in a state to command that rent.” Rateable value is in effect the estimated annual rental value in the open market. It is common practice supported by decided cases to assume a hypothetical tenancy, and the rateable value is an estimated annual rent which would have been agreed between a hypothetical landlord and a hypothetical tenant, on the assumption that the property in its actual physical state was vacant and to let. The landlord’s obligation to bear “the costs of repairs and other expenses necessary to maintain the tenement in a state to command that rent” implies that ordinary disrepair is disregarded in ascertaining the rateable value.

Sentencing is said to be more time-consuming for jurors than the relatively easy task of ascertaining guilt or innocence, which means an increase in jury fees and in the amount of productivity lost to jury duty. In New South Wales, a 2007 proposal by Chief Justice Jim Spigelman to involve juries in sentencing was rejected after District Court Chief Judge Reg Blanch cited "an expected wide difference of views between jurors about questions relating to sentence". Concerns about jury tampering through intimidation by defendants were also raised. Germany and many other continental European countries have a system in which professional judges and lay judges deliberate together at both the trial and sentencing stages; such systems have been praised as a superior alternative because the mixed court dispenses with most of the time‐consuming practices of jury control that characterize Anglo‐American trial procedure, yet serves the purposes of a jury trial better than plea bargaining and bench trials, which have displaced the jury from routine American practice.
Collections made by the Ship's Surgeon and other officers were government property, though the Admiralty was not consistent on this, and went to important London establishments, usually the British Museum. The Admiralty instructions for the first voyage had required officers "to use their best diligence in increasing the Collections in each ship: the whole of which must be understood to belong to the Public", but on the second voyage this requirement was omitted, and the officers were free to keep all the specimens for themselves. FitzRoy's narrative recalls that, when investigating islands on the first voyage, he had regretted that no-one on board had expertise on mineralogy or geology to make use of the opportunity of "ascertaining the nature of the rocks and earths" of the areas surveyed, and resolved that if on a similar expedition, he would "endeavour to carry out a person qualified to examine the land; while the officers, and myself, would attend to hydrography." This clearly indicated a need for a naturalist qualified to examine geology, who would spend considerable periods onshore away from the ship.

Newton criticized all the methods, pointing out their weak points, and it is due mainly to his evidence that the Committee brought in the report which was accepted by the House, and shortly afterwards was converted into a Bill, passed both Houses, and received the royal assent. The report ran "that it is the opinion of this committee that a reward be settled by Parliament upon such person or persons as shall discover a more certain and practicable method of ascertaining the longitude than any yet in practice; and the said reward be proportioned to the degree of exactness to which the said method shall reach." Newton was in charge of the Board of Longitude, and it never gave a prize, but it did give some advance funds to the mathematician Leonhard Euler and some others for work on accurate lunar tables, and these did more or less solve the longitude problem.

The Act embodied previous legislation consequent upon EU directives concerning the mutual recognition of professional qualifications in the member states of the European Union and other EEA States, and certain changes which had been made to the previous legislation after the publication of the Warne Report in 1993. For the purpose of ascertaining the duties and functions which the Architects Registration Board is required to execute and perform under the Architects Act 1997, the constraints on the Board include the requirements judicially applicable in the name of administrative law. In May 2006 ministerial responsibility for the ARB was transferred from the ODPM to the DCLG (Department for Communities and Local Government). The DCLG website shows that of "four categories" of "non- departmental public bodies" (NDPBs) the ARB was being classified (at the end of May 2007) as one of two "public corporations", the other one being the Audit Commission,not to be confused with the National Audit Office (United Kingdom) a body of entirely different political and legislative origin, function and capacities, so that the two have practically nothing in common.
The inauthenticity of the music and the Irish and Scottish elements in it are explained by the fact that slaves were rarely allowed to play native African music and therefore had to adopt and adapt elements of European folk music.. Compounding the problem is the difficulty in ascertaining how much minstrel music was written by black composers, as the custom at the time was to sell all rights to a song to publishers or other performers.. Nevertheless, many troupes claimed to have carried out more serious "fieldwork".. Similar to American people who come from all over the world creating one big 'melting pot,' it is only fitting that some of the first forms of truly American music and drama are composed of elements from many different places. Early blackface songs often consisted of unrelated verses strung together by a common chorus. In this pre-Emmett minstrelsy, the music "jangled the nerves of those who believed in music that was proper, respectable, polished, and harmonic, with recognizable melodies.". It was thus a juxtaposition of "vigorous earth- slapping footwork of black dances … with the Irish lineaments of blackface jigs and reels.".
Notwithstanding these inventions of the Alexandrian school, its attention does not seem to have been directed to the motion of fluids; and the first attempt to investigate this subject was made by Sextus Julius Frontinus, inspector of the public fountains at Rome in the reigns of Nerva and Trajan. In his work De aquaeductibus urbis Romae commentarius, he considers the methods which were at that time employed for ascertaining the quantity of water discharged from ajutages (tubes), and the mode of distributing the waters of an aqueduct or a fountain. He remarked that the flow of water from an orifice depends not only on the magnitude of the orifice itself, but also on the height of the water in the reservoir; and that a pipe employed to carry off a portion of water from an aqueduct should, as circumstances required, have a position more or less inclined to the original direction of the current. But as he was unacquainted with the law of the velocities of running water as depending upon the depth of the orifice, the want of precision which appears in his results is not surprising.

For the purpose of ascertaining the possible span of life the Amsayu method should be adopted if at the time of birth the Lagna is vested with strength; the Pindayu method, if the Sun is strong, and the Nisargayu method, if the Moon is strong. If at the time of birth the lord of the 8th house counted from the lagna happens to occupy a kendrasthana the person will be long-lived; if the lord of the 8th house or the lord of the lagna is in the 8th house afflicted by inauspicious planets the person will be short-lived. The use of Nisargayu, the Pindayu, the Lagnayu, the Amsayu, the Rashmiayu, the Chakrayu, the Nakshatrayu and the Ashtakavargayu methods are employed for determining longevity, but longevity is determined on the basis of the strength of the horoscope in its entirety, and the dasa of planets.
In the third chapter Nicholson described, that in his days there was still a significant lack of knowledge on the subject of factory costs. Although the importance and desirability of accurate methods of ascertaining the cost of production is generally conceded, and while much attention has been devoted to this subject, and large sums of money expended annually in perfecting cost keeping records, there is a general lack of knowledge in many instances of the principles involved; and the problem now in hand is to present an analysis of the elements that go to make cost, and to indicate the lines along which methods must be devised to gather and classify the facts that are used in its actual determination. The accuracy and effectiveness with which this is done rests on, (1) the principles involved, and (2) the methods used.Nicholson (1909, 38-42) Nicholson explained, that the elements that comprise the cost in all manufacturing enterprises are made up of three principal divisions: Elements of Cost, 1909 # Material : Direct material is that element of material that enters into the product itself and can be charged accurately to the article.
Here Hahnemann was referring to basic principles that he had laid down in his foundational work, On A New Principle for Ascertaining the Curative Power of Drugs, 1796 concerning two 'sides' of disease, namely those of a fixed nature and those of a variable nature. Further, Hahnemann also had identified two sides to the life force (Lebenskraft) and two phases to the disease process: the initial (Erstwirkung) action of the disease agent impinging on the generative side (Lebens- Erzeugungskraft) of the life force, and the counter or after action (Gegenwirkung or Nachwirkung) of the sustentive side (Lebens-Erhaltungskraft) of that same life force (see Romantic Medicine: Details of Heilkunst). Thus, the concept of 'at a time' (auf einmal) meant for Hahnemann that one could not give a second remedy normally within the initial action of the first remedy. With crude doses, this initial action could be hours or minutes, but with higher potencies Hahnemann had discovered that the initial action was very short and almost instantaneous and thus could accept Aegidi's approach to the extent it also used remedies 'in smallest dose or by olfaction'.
In 1534, Cromwell undertook, on behalf of the King, an inventory of the endowments, liabilities and income of the entire ecclesiastical estate of England and Wales, including the monasteries (see Valor Ecclesiasticus), for the purpose of assessing the Church's taxable value, through local commissioners who reported in May 1535. At the same time, Henry had Parliament authorise Cromwell to "visit" all the monasteries, including those like the Cistercians previously exempted from episcopal oversight by papal dispensation, to purify them in their religious life, and to instruct them in their duty to obey the King and reject Papal authority. Cromwell delegated his visitation authority to hand-picked commissioners, chiefly Richard Layton, Thomas Legh, John ap Rice and John Tregonwell for the purposes of ascertaining the quality of religious life being maintained in religious houses, of assessing the prevalence of 'superstitious' religious observances such as the veneration of relics, and for inquiring into evidence of moral laxity (especially sexual). The chosen commissioners were mostly secular clergy, and appear to have been Erasmian in their views, doubtful of the value of monastic life and universally dismissive of relics and miraculous tokens.
If bad men among the Indians shall commit a wrong or depredation upon the person or property of any one, white, black, or Indian, subject to the authority of the United States, and at peace therewith, the Indians herein named solemnly agree that they will, on proof made to their agent and notice by him, deliver up the wrong-doer to the United States, to be tried and punished according to its laws; and in case they wilfully refuse so to do, the person injured shall be reimbursed for his loss from the annuities or moneys due or to become due to them under this or other treaties made with the United States. And the President, on advising with the Commissioner of Indian Affairs, shall prescribe such rules and regulations for ascertaining damages under the provisions of this article as in his judgment may be proper. But no such damages shall be adjusted and paid until thoroughly examined and passed upon by the Commissioner of Indian Affairs, and no one sustaining loss while violating or because of his violating the provisions of this treaty or the laws of the United States shall be reimbursed therefor.

Diplomatic missions between members of the British Commonwealth of Nations are not called embassies, but high commissions, for Commonwealth nations share a special diplomatic relationship. It is generally expected that an embassy of a Commonwealth country in a non-Commonwealth country will do its best to provide diplomatic services to citizens from other Commonwealth countries if the citizen's country does not have an embassy in that country. Canadian and Australian nationals enjoy even greater cooperation between their respective consular services, as outlined in the Canada-Australia Consular Services Sharing Agreement.
The Gettysburg Park Commission (GPC) was established by the United States Department of War on March 3, 1893, (NPS webpage for monument MN508) for "ascertaining the extent of...the trolley" (trolley track construction began April 1893). The Appropriations Act of 1893 on March 3 had funded $25,000, a June 9 supplemental act directed "acquisition and designation by tablets of the lines of battle", and the battlefield survey "was at once commenced" after topographer Emmor Cope was selected at the first commission meeting on July 1. Federal acquisition of land that would become the 1895 Gettysburg National Military Park began on June 2, 1893, with a tract of from John H. Miller & wife. By July 1893, GPC commissioner John B. Bachelder reported to the Secretary of War (local article, New York Times article) about battlefield railbed construction (notably planned along the west of The Angle's historic stone wall), and acting secretary Lewis A. Grant referred the complaint to the acting Judge Advocate General. Trolley right-of-way over the private 72nd Pennsylvania Infantry Monument tract at The Angle was denied by June 13, 1893; and the route was changed to instead use the Emmitsburg Road.
Denham had met the explorer Captain George Lyon on the latter's return to London from Africa, and became determined to join the British government's second mission to establish trade links with the west African states. Perhaps because of his influential acquaintances, Denham's wish was granted and, now promoted to Major, he was despatched by Lord Bathurst in the autumn of 1821 to join the other members of the mission, Dr Walter Oudney and Lt. Hugh Clapperton, arriving at Tripoli aboard the schooner Express on 19 November. Denham brought with him instructions from the Colonial Office indicating that Oudney should remain at Bornu as Vice-Consul, while Denham and Clapperton were to 'explore the Country to the Southward and Eastward of Bornu, principally with a view to tracing the course of the Niger and ascertaining its Embouchure'.
