Furthermore, David Litwa argues that problematic parts of MacDonald's thesis include that he construes both large ranges of similarity in addition to large range of difference as evidence for parallel, that he alters his parallels in order to make them more convincing like suggesting that Jesus walking on water is comparable to Athena and Hermes flying above water, that he has an inconsistent application of his own six criteria (where he often uses only one or two to establish parallel and thus relies largely on loose structural standards of similarity), and that he often has completely unconvincing parallels such as his comparison of Odysseus on a floating island to Jesus sitting in a boat that floats on water.Litwa, M. Justice Byron White Writing for a four-justice minority, Justice White strongly criticized the majority because it "recognizes, as it must, that § 271 does not, on its face, exempt the broad category of nonstaple materials from the misuse doctrine, yet construes it to do so based on what it has gleaned from the testimony of private patent lawyers given in hearings before congressional Committees and from the testimony of Department of Justice attorneys opposing the bill." Despite the fact that nothing in support of the Court's construction could be "found in the Committee Reports or in the statements of those Congressmen or Senators sponsoring the bill," he added, the majority chose to rely "only on the opposing positions of nonlegislators . . . to extend the patent monopoly beyond preexisting standards." 448 U.S. at 223-24.

Then in Government of Zanzibar v British Aerospace (Lancaster House) Ltd [2000] 1 WLR 2333 the High Court held that a contract for sale of a luxury jet could not be rescinded, despite misrepresentations about the plane's airworthiness, because the plane had already been repossessed by the Government of Zanzibar's finance company. Because they could not give the plane back, in specie rescission was barred, and the court went on to consider whether damages were available under MA 1967 s 2(2) given rescission was barred and held they were not. A statement of opinion by an expert, which proves false, will be taken as a factual misrepresentation, as in Esso Petroleum Co Ltd v Mardon.[1976] EWCA Civ 4 Depending on how a court construes negotiations, a representation could become a term of the contract, as well as one giving rise to the right to rescind.

Averroes was another important philosopher, and while he was born shortly before Avempace's death, Averroes later in life would be in opposition to Avempace's theories the majority of the time. Avempace starts with a good kinematic definition of motion and construes it as a force. According to Avempace regarding freely falling objects, what is moved the as heavy body falls, is the heavy body and what moves it downward is its 'gravity' or its 'form' or 'nature'. Each quadruple consists of (i) a syntactic unit (or concatenation of units) of an idiolect system, (ii) a syntactic structure the unit or concatenation has in the system, (iii) an assignment of lexical meanings to the primitive constituents contained in the unit given the structure and the system (called a 'lexical interpretation'), and (iv) the system itself. The values of such grammatical functions are two-(or more)-place relations among constituents of the syntactic unit. (Grammatical functions are only one type of 'constituent functions,' which also include 'scope functions' like negation and qualification, and 'phoric functions' like antecedent; and there are other types of syntactic functions besides the constituent functions.) Syntactic functions play a central role, via their semantic content, in the composition process by which syntactic meanings of a syntactic unit are constructed from the lexical meanings of its primitive constituents. Incorporating features of Valency Grammar, Integrational Syntax construes subject and object functions as derived from more basic complement functions that simultaneously cover all complements of a single verbal nucleus; it generalizes the notion of valency to arbitrary lexical words, excluding purely auxiliary words.

The ideas that Lasker adopted at this early stage in his career brought an analytical approach to the supposedly outmoded practice of making a painting by hand. Lasker’s solution was to create a recurring vocabulary of motifs of texture, shape, color, and line that he would arrange and rearrange from painting to painting, as if they were a cast of characters entering and exiting a stage. In “Image Kit,” an essay the artist wrote in 1986 and later revised for a book of his complete essays published in 1998, he describes the distancing and self-consciousness on the part of both the artist and viewer that is fundamental to his work: > I often think of my paintings as a form of image kit or perhaps as jigsaw > puzzles, which offer components of painting as clues pointing the viewer, > not to a finished narrative (as when the last piece of the jigsaw puzzle > completes a picture of Notre Dame), but rather to a self-awareness of how > one construes a painting. The art historian and curator Robert Hobbs refers to the kind of painting practiced by Lasker and such peers as Ross Bleckner, Peter Halley, Mary Heilmann, and David Reed as meta-abstraction.
