Nelson states that Saruman's argument for the need for power "definitely echoes" Hitler's rationalisations for the Second World War, despite Tolkien's claims to the contrary. The Fellowship of the Ring, Foreword to the Second Edition The critic Patrick Curry rebuts the "common criticism" of Tolkien, levelled by literary critics such as the scholars of English literature Catherine Stimpson, that his characters are naively either good or evil. Curry writes that far from being "seemingly incorruptible" as Stimpson alleges, evil emerges among the wizards.
As she grows up, an overconfident Marji refuses to stay out of trouble, secretly buying Western heavy metal music, notably Iron Maiden, on the black market, wearing unorthodox clothing such as denim jackets, and celebrating punk rock and other Western music sensations like Michael Jackson. She is nearly taken into custody by female Guardians of the Revolution but escapes by lying. Marji is expelled from school when she openly rebuts a teacher's lies about government abuses. Fearing her arrest for her outspokenness, Marji's parents send her to a French lycée in Vienna, Austria.
If the defendant successfully rebuts the > presumption, the burden of producing additional evidence of anticompetitive > effect shifts to the government, and merges with the ultimate burden of > persuasion, which remains with the government at all times.908 F.2d at _ > (internal citations omitted). The government challenged the district court's conclusion that the defendants rebutted the presumption, arguing that as a matter of law a defendant "can rebut a prima facie case only by a clear showing that entry into the market by competitors would be quick and effective."908 F.2d at _.
The Court, in an opinion joined by five justices, held that the presumption against extraterritoriality applies to claims under the ATS, and nothing in the statute rebuts that presumption. The presumption against extraterritoriality is a canon of statutory interpretation that provides there is no extraterritorial application of a statute unless there is a clear indication otherwise. Writing for the Court, Chief Justice Roberts observed that while the presumption applies to merits questions and the ATS is strictly jurisdictional, the canon should still apply to the statute because of the danger of judicial interference in foreign policy.Kiobel v.
271, Martha Nussabaum, Harvard University Press Habib had a sustained commitment to secularism. He led the historians at the Indian History Congress of 1998 who moved a resolution against the "saffronisation" of history. He has said that the BJP government at the Centre which was in power from 1998–2004, especially the MHRD Minister himself, were responsible for inventing facts and dates to suit their interpretation of Indian history."Government trying to invent history, says Habib" To counter Irfan Habib, Murli Manohar Joshi released a book which rebuts the history of what the former minister calls '‘Habib & Co'’.
" Rabbi Blech affirmed the opinion of a Holocaust survivor friend that the book is "not just a lie and not just a fairytale, but a profanation." Students who read it, he warns, may believe the camps "weren't that bad" if a boy could conduct a clandestine friendship with a Jewish captive of the same age, unaware of "the constant presence of death." Holocaust scholar Henry Gonshak rebuts Blech's historical contention in his book, Hollywood and the Holocaust. He writes that "the rabbi found implausible Shmuel's very existence in the camp," but states that "Blech is factually incorrect.
The group participates in debates with a pro-Korean study group and a group of students visiting from South Korea – both made ignorant of history and unable to make logical arguments – and rebuts their pro-Korean opinions, humiliating them. The main topics of book include an alleged 2002 FIFA World Cup game scandal, Japanese compensation to Korea for colonial rule, opposition to Zainichi Koreans suffrage, alleged Korean plagiarism of Japanese culture, criticism of pro-Korean mass media in Japan, criticism of Hangul (Korean alphabet), Japan–Korea Annexation, Liancourt Rocks dispute, and criticism of the Korean Wave and its immense popularity in Japan.
Warren Buffett has also argued against EMH, most notably in his 1984 presentation "The Superinvestors of Graham-and-Doddsville". He says preponderance of value investors among the world's money managers with the highest rates of performance rebuts the claim of EMH proponents that luck is the reason some investors appear more successful than others. Burton Malkiel in his A Random Walk Down Wall Street (1996)Malkiel, A Random Walk Down Wall Street, 1996, p. 175 argues that "the preponderance of statistical evidence" supports EMH, but admits there are enough "gremlins lurking about" in the data to prevent EMH from being conclusively proved.
Stanford economist Caroline Hoxby criticized the study, resulting in a written debate with the authors. She originally argued the study "contains a serious statistical mistake that causes a negative bias in its estimate of how charter schools affect achievement,""A Serious Statistical Mistake In The CREDO Study of Charter Schools" but after CREDO countered the remarks, saying Hoxby's "memo is riddled with serious errors" Hoxby revised her original criticism. The debate ended with a written "Finale" by CREDO that rebuts both Hoxby's original and revised criticism. The National Education Policy Center has criticized the methods that CREDO has used in its studies.
2007, S. 13. Although the nineteenth century Kulturkampf was characterised by a peculiar intensity and radicalism, Clark's careful study of sources in several different European languages enabled him to spell out just how closely the Prussian experience of church-state rivalry resembled events elsewhere in Europe. In this way the book powerfully rebuts the traditional Sonderweg bandwagon, whereby throughout the twentieth century mainstream historians have placed great emphasis on the "differentness" of Germany's historical path, before and during the nineteenth century. Clark downplays the perceived uniqueness of the much vaunted reform agenda pursued by Prussia between 1815 and 1848.
A townsperson, bewildered at this request, asks the Lone Ranger why he wants the horse and Tonto; he replies "To perform an unnatural act." Seeing the townsperson dismayed that the Lone Ranger is a "fag," the Ranger rebuts that he himself is not a homosexual (or into bestiality) but read an exposé on it in a magazine and wanted to try it once to see how bad it was, noting the irony of punishing homosexuality by locking offenders in prison with other men. The townspeople react in disgust as The Lone Ranger and Tonto ride off into the sunset. Bruce intended to deconstruct homophobia and other issues explored within the routine.
Anyeint performances begin with a recitation and explanation of ancient verses, followed by a pari kamma (), a formal speech by troupe members to introduce themselves and thank the show's patron. Comedians then provide an introductory slapstick skit, before inviting the lead actress to the stage for a performance, during which they will provide improvised jokes and playful insults to the audience. At the end of the dance set, comedians direct jokes at the actress, who rebuts them and defends herself. In the past, the anyeint performance was concluded with a verse play called zat kyi (), although this portion is now omitted from contemporary anyeint programmes.
C. Cir. 2015).Salazar Decision The D.C. Circuit agreed with the district court that the evidence presented by plaintiffs demonstrates that "the LSI-Updated Laffey Matrix 'is probably a conservative estimate of the actual cost of legal services in this area'" (emphasis in original). It concluded that “[t]he District, neither below nor on appeal, rebuts this logic with relevant arguments.” The Court noted that the fact that other courts have applied the USAO Laffey Matrix “is not compelling.” Other courts have rejected the LSI-Adjusted Laffey Matrix, particularly for cases in the Washington-Baltimore region, and have based fee awards the USAO Laffey Matrix.
Sonnet 131 is a sonnet written by William Shakespeare and was first published in a 1609 quarto edition titled Shakespeare's sonnets. It is a part of the Dark Lady sequence (consisting of sonnets 127–52), which are addressed to an unknown woman usually assumed to possess a dark complexion. The sonnet, like the others in this sequence, addresses the Dark Lady as if a mistress. It references allegations from unspecified others that her "black" complexion makes her unattractive and rebuts these, but in the final two lines turns the compliment into a backhanded one by admitting that "In nothing art thou black save in thy deeds".
Michael, Pam and Ryan come in to discuss the terms of the buyout. After Michael rejects an initial offer of $12,000 to buy the company, David suggests that he is bluffing, saying he knows that his company's prices are too low to be sustainable. Michael keeps his cool and rebuts that Dunder Mifflin's best branch is "bleeding" and David could be replaced during an upcoming major stockholder meeting as a result. David gives a second offer of $60,000, which is strongly considered, but Michael rejects this offer at the last second and demands the company give him his old job back and hire Ryan and Pam as salespeople.
After the Anglo-French joint invasion and the destruction of the Yuanming Garden, the Xianfeng Emperor indulges in hunting at the Jehol Summer Resort and Prince Gong is becoming more influential in the Qing government through frequent negotiations and operations with foreign powers. Rumours have it that Prince Gong is planning a rebellion with foreign supports, but Noble Consort Yi often rebuts such claims before the Emperor. The Emperor promotes a female court attendant as Consort Li, much to the dismay of members of the harem, especially Noble Consort Yi and the Empress. During the celebration of the Emperor's birthday, he suffers from hyperhidrosis and dizziness but refrains from interrupting the opera show.
Decker further asserted that the advanced state of ancient irrigation practices "rebuts sizeable parts of the Watson thesis," since for example in Spain, archaeological work indicated that the Islamic irrigation system was developed from the existing Roman network, rather than replacing it. Decker agreed that "Muslims made an important contribution to world farming through the westward diffusion of some crops", but that the introduction of "agronomic techniques and materials" had been less widespread and less consistent than Watson had suggested. Furthermore, there is clear evidence that agricultural devices such as watermills and waterwheels, shadufs, norias, sakias, water screws and water pumps were widely known and applied in Greco-Roman agriculture long before the Muslim conquests.
Ch. 5 (40): The Chiffinches discuss tactics for retaining the King's favour. During a pause at the Tower on a royal river outing, Buckingham insults an aged warder, leading to his death, and the Duke of Ormond pleads the Peverils' case with the King. Ch. 6 (41): The Peverils and Hudson are tried for participation in the Popish Plot and acquitted. Ch. 7 (42): On leaving the court the Peverils are involved in a skirmish with a Protestant mob and take refuge at a cutler's where Bridgenorth appears. Ch. 8 (43): Julian rebuts his father's criticism of Bridgenorth, who takes him to eavesdrop on a conventicle of activists and deploys extremist rhetoric himself.
She declined, having fallen ill, which angered Goebbels; she later became a newspaper journalist with Nazi publications where she wrote some articles on Jewish influence over U.S. news and elite opinion. Bogart's article appeared just weeks before Noelle-Neumann took up a visiting position in the Political Science Department at the University of Chicago, where she had held similar appointments since 1978. The Temple Lot church has insisted since about 1976 (when final attempts at conciliation by the RLDS Church took place) that it will not cooperate with other Latter Day Saint or Christian denominations in building a temple, nor will it sell the Lot, regardless of any price that might conceivably be offered. Some members of other Latter Day Saint groups have described the Temple Lot church as "'squatters' on the location,"Max McCoy, "Separatist by faith: Church of Israel's patriarch rebuts claims of racism" , Joplin Globe, January 28, 2001. but that organization steadfastly defends its right to possess the property as its physical and spiritual "custodian".History of the Church of Christ.
She rebuts the conventional wisdom about a story needing a hero's journey. Looking for Grace has no heroes, just ordinary people and multiple journeys, yet it lacks nothing in emotional impact or narrative drive." Mad Dog Bradley, writing for Rip It Up, said "Something of a tough one to discuss, Brooks' film has been accused of unevenness, but surely the ambitious tone is one of its strongest suits, as we shift from teen lust to marital angst to unexpected comedy. And the actors are all strong, with Mitchell and Roxburgh (a long way from TV's Rake) putting in fine performances, and a breakthrough turn from Young, whose elusive Grace holds the subtle saga together.
Gould notes that Paley envisages a Lamarckist kind of evolution and rebuts it with the observation that men have not lost their nipples through disuse. However, Gould writes, Paley did not manage to think of one more alternative, natural selection, which has no purpose at all but just kills off whatever works less well in every generation. The evolutionary biologist Richard Dawkins described himself as a neo-Paleyan in The Blind Watchmaker (1986), where he argued, following the evolutionary biologist and humanist Julian Huxley, that Paley's watch analogy fails to recognise the difference between the complexity of living organisms and that of inanimate objects. Living organisms can reproduce themselves, so they can change to become more complex from generation to generation.
In a mostly positive review for The Guardian, David Lipsey largely agrees with Brown's themes and rebuts some of the criticism against him. But Lipsey suggests Brown does deserve some of the criticism from the left, who argue he did too little to punish bankers for the crisis and allowed too many of the consequences to fall on ordinary people. Tracey Boles for the Sunday Express focuses mainly on the book itself rather than the macro economic issues, saying that the work contains "fascinating insights" into the working of global governments as well as a few engaging incidents that shed light on Brown's home life. She says it would have been better if Brown had spent more time relating how he felt rather than discussing economic theory.
Nietzsche scholar Walter Kaufmann has described an argument originally put forward by Georg Simmel, which rebuts the claim that a finite number of states must repeat within an infinite amount of time: > Even if there were exceedingly few things in a finite space in an infinite > time, they would not have to repeat in the same configurations. Suppose > there were three wheels of equal size, rotating on the same axis, one point > marked on the circumference of each wheel, and these three points lined up > in one straight line. If the second wheel rotated twice as fast as the > first, and if the speed of the third wheel was 1/π of the speed of the > first, the initial line-up would never recur.Kaufmann, Walter.
His purpose was to refute arguments that these were actual stars rather than sublunary events. The publication of Galileo's Dialogue Concerning the Two Chief World Systems in Italian in 1632 and then in Latin in 1635, dealt a serious blow to Chiaramonti's scientific credibility. In the dialogue, arguments that he had used in past were placed in the mouth of Galileo's idiot character Simplicius in such way that, as Chiaramonti himself commented, only a "scempio" ("disgrace", "total mess") like Simplicio could possibly believe them. The character of Salivati firmly rebuts these points, dismissing "Antitycho" as a work hardly meriting serious attention, and referring to existence of sunspots, which not only darken the surface of the Sun, but cast a shadow on the whole of peripatetic philosophy.
Hale (2011) p. 87 Romanian university students were disproportionately over-represented in the Iron Guard, a fact which rebuts the claim that the Iron Guard attracted support only from social "losers". Romania had a very large intelligentsia relative to its share of the population with 2.0 university students per one thousand of the population compared to 1.7 per one thousand of the population in far wealthier Germany, while Bucharest had more lawyers in the 1930s than did the much larger city of Paris. Even before the Great Depression, Romania's universities were turning out far more graduates than there were jobs for, and a mood of rage, desperation and frustration prevailed on campuses as it was apparent to most Romanian students that the middle class jobs that they were hoping for after graduation did not exist.
The review says biographer Miranda Seymour is "circumspect on Nice's guilt". A review of the same book in The New York Times says Nice was accused of being a "Gestapo agent"; that Seymour "rebuts" the charge; and that it made Nice "unemployable". Seymour's book says that in a letter to Antony Noghes, the head of the Monte Carlo Rally committee, Hellé Nice "protested her innocence"; that she told him she would appeal to the Monaco court unless Chiron wrote an apology; that no letter from Chiron has been found; and that the court has no record of such a case between 1949 and 1955. Paired with the Swiss driver Ciro Basadonna, Chiron won the 1954 Monte Carlo Rally, and achieved podium finishes in the fifteen Formula One races he entered that year.
Armstrong's development as a philosopher was influenced heavily by John Anderson, David Lewis, and J. J. C. Smart, as well as by Ullin Place, Herbert Feigl, Gilbert Ryle and G. E. Moore. Armstrong collaborated with C. B. Martin on a collection of critical essays on John Locke and George Berkeley. Armstrong's philosophy, while systematic, does not spend any time on social or ethical matters, and also does not attempt to build a philosophy of language. He once described his slogan as 'Put semantics last' and, in Universals & Scientific Realism, he rebuts an arguments in favour of Plato's theory of forms that rely on semantics by describing "a long but, I think, on the whole discreditable tradition which tries to settle ontological questions on the basis of semantic considerations".

In contrast to Gallen J who had seen Mrs Baker's statements of fear at her husband as "rather on the side of establishing a factual situation than of indicating a continuing state of mind"; Justice Casey believed, > "By itself, the fact that the deceased did not invite her husband around to > shoot cats advances the Crown case no further, if this is what the jury > infers from the evidence of her state of mind. However, that conclusion > rebuts the only innocent explanation he has so far given for his visit with > a gun and ammunition. He wrote from prison that Atheism Conquered was "[a] volume against politicians and Machiavellians". In the second chapter, he presents arguments against religion, specifically Christianity, which he then rebuts in the remainder of the work from the perspective of the world being imbued with and an expression of the divine nature and of the unique nature of humanity in being able to achieve transcendent knowledge and religious insight. He argues that religion is part of natural law, that "human beings have a natural inclination toward justice and toward living within a religion", and that false religions are not an argument against the existence of religious truth, making a comparison with inept doctors not being an argument against the efficacy of medicine. He presents Christianity as the best candidate for a universal religion since it conforms best to natural law.
The segment then displays some news clippings and broadcasts that explain the FCC's priority-lane proposal. Oliver returns onto the segment, and he protests vehemently against the proposed rules, jokingly stating that the rules would ensure "my startup video streaming service, Nutflix, a one-stop resource for videos of men getting hit in the nuts", would not be able to compete with larger companies like Netflix. He then takes a more serious approach, stating that the proposal would allow large ISPs such as Verizon and Comcast to buy the "fast-lane" data more easily compared to smaller ISPs with fewer funds. Oliver rebuts a telecommunication lawyer's claim that it would be a "fast-lane-versus-hyperspeed-lane" contrast, stating that the proposed rules were more comparable to Olympic gold medalist sprinter Usain Bolt versus "Usain bolted to an anchor".
In India, where free software has gained a lot of ground, the unambiguous term swatantra and its variants are widely used instead of "free". The free software movement rebuts that while "free" may be prone to confuse novices because of the duplicity of meanings, at least one of the meanings is completely accurate, and that it is hard to get it wrong once the difference has been learned. It is also ironically noted that "open source" isn't exempt of poor semantics either, as a misunderstanding arises whereby people think source code disclosure is enough to meet the open-source criteria, when in fact it is not. The switch from the free software movement to the open-source movement has had negative effects on the progression of community, according to Christopher Kelty, who dedicates a scholarly chapter to the Free Software Movement in "Theorising Media and Practice".
The first part, referring to the intervention of a moment, may be an interpolation, however, it may be a careful qualification by a lawyer (and is supported by D.45.1.1.1 which suggests there may be a brief gap and the party may even go away and then come back again.) Who it is who may not begin something else is also unclear, the Latin is ambiguous, but it seems likely this text is referring to the actions of the promisor. That the text expressly rebuts the idea that a reply may be given on the same day after a party has undertaken some other business, suggests that such things were valid at some point in Roman law, although it could be an interpolation. D.45.1.1.1 says that a person answering on the same day is bound but someone answering on the next day is not.
Third, Walt rebuts the argument that it is necessary to go to war over Assad's use of chemical weapons, particularly when other regimes that used chemical weapons in the past were not then punished by the United States. Walt argues that "chemical weapons have only been used a handful of times over the past 80 years, mostly because they are less effective than conventional arms in most battlefield situations." Fourth, Walt argues that intervention is not necessary to maintain US credibility because "if we refrain from using force when vital interests are not involved or when doing so would only make things worse, it says nothing about our willingness to use force when it is truly necessary and when it can achieve clear and well-defined objectives." Finally, Walt argues that "wise leaders do not go to war without robust international and domestic support," which President Obama does not have.
The latter, which comprise cultual communities devoted to local deities and individual spiritual techniques, are classified by Yang as the legally undefined "gray market" of "semi-, quasi- and pseudo-religions", standing between the fully legal "red market" of what Yang considers "true religions" (whose prototype is Christianity) and the illegal "black market" of religions forbidden by the Chinese government (such as Falun Gong and Eastern Lightning). Yang claims that contemporary China's policies on religion hamper the growth of the red and black markets while leaving free space for the gray market to develop, and if China will liberalize religion completely, the "religious consumers" would mostly turn to "true religions". Goossaert rebuts that folk religions are not inferior forms of religion, have deep historical roots and a history of negotiation with the government, and are the largest form of religion in contemporary China, far from being "consumer goods" ready to be replaced by better ones. The Chinese scholar Mou Zhongjian advanced an alternative paradigm to that of the "religious market", actually preceding the latter in time.
A notable series of articles was entitled 'Marx' Economic Theory.' Ziber defended Marx against critics like I.G. Zhukjovsky and B.N. Chicherin and was one of the first to criticise narodnik economists like V. P. Vorontsov and N. F. Danielson along 'orthodox' Marxist lines later developed by G.V. Plekhanov, P.B. Struve, V.I. Lenin, D. Blagoev, and N. E. Fedoseev, among others. While Vorontsov argued that the development of industrial capitalism was impossible in Russia due to a lack of markets, and Danielson thought that, owing to Russia's belated development, capitalism was not necessary for industrial development, Ziber interpreted Marxism to entail that capitalism was an inevitable stage of development in the history of any society. (In this interpretation he was influenced by Marx' own Preface to the German edition of Capital, where Marx rebuts German writers who argued that Marx' analysis of British capitalism did not apply to Germany.) Since the development of capitalism was, according to Ziber, in its infancy in Russia in the 1870s and '80s, Russia's foreseeable future would consist of a lengthy period of capitalist modernisation.
His vehicles were built at his Regent's Park Manufactory works, and tested around the park's barrack yard, and on frequent excursions to Hampstead, Highgate, Edgware, Barnet and Stanmore, at speeds of up to 20 miles per hour (32 km/h). Gurney is by no means the only pioneering inventor in the history of steam road vehicles – Luke Herbert, in his 1837 Practical Treatise on Rail-Roads and Locomotive Engines, rebuts in scathing fashion claims made for Gurney in preference to Trevithick as inventor of the steam carriage: One of his vehicles was sufficiently robust to make a journey in July 1829, two months before the Rainhill Trials, from London to Bath and back, at an average speed for the return journey of 14 miles per hour—including time spend in refuelling and taking on water. His daughter Anna, in a letter to The Times newspaper in December 1875, notes that "I never heard of any accident or injury to anyone with it, except in the fray at Melksham, on the noted journey to Bath, when the fair people set upon it, burnt their fingers, threw stones, and wounded poor Martyn the stoker". The vehicle had to be escorted under guard to Bath to prevent further luddism.
On 27 April 2007, Sondhi claimed on his "Yam Fao Phaendin" (Guard of the Land) TV program that an amendment to the anti-corruption law passed by the National Legislative Assembly had been "stuck" for a month after being submitted for royal endorsement, and suggested the "delay" could be due to family ties between Arsa Sarasin (King Bhumibol's Principal Private Secretary) and Pong Sarasin (his eldest brother, a major shareholder in a company that Sondhi accused of acting as a nominee in the sale of Shin Corporation to Temasek Holdings). The Office of His Majesty's Principal Private Secretary said in a public statement that Arsa had "has no connections whatsoever" with the issue, and that Sondhi made "incorrect allegations" against the royal secretary. "Sondhi's statement indicated that he failed to double-check the facts and had intended to frame and cause damage to Arsa Sarasin and the Office of His Majesty's Principal Private Secretary," said a letter sent to Sondhi. The Nation, HM's office rebuts Arsa allegations , 4 March 2007 Sondhi issued an apology a few days later, but also publicly warned Arsa that he had no right to use the office of the King's Principal Private Secretary to defend himself in a personal matter.
In 2006, the film One Bright Shining Moment – The Forgotten Summer of George McGovernOne Bright Shining Moment was released in the United States. Directed by Stephen Vittoria and narrated by Amy Goodman, the documentary chronicles the life and times of George McGovern, focusing on his 1972 bid for the presidency. The film features McGovern, Gloria Steinem, Gore Vidal, Warren Beatty, Howard Zinn and Dick Gregory. McGovern is also prominently featured in the documentary films The U.S. vs. John Lennon (2006), Gonzo: The Life and Work of Dr. Hunter S. Thompson (2007), and Rush to War: Between Iraq and a Hard Place (2004), among other documentaries. The films Nixon (1995), Dick (1999), All the President's Men (1976), Some Kind of Hero (1982), and The Seventies (2000 TV miniseries) reference McGovern and his 1972 presidential campaign. In director Oliver Stone's Nixon, McGovern is repeatedly cited, including President Nixon (played by Anthony Hopkins) responding to southern conservatives and a right wing special interest group who threaten Nixon by taking away his campaign funds for the 1972 presidential campaign due to Nixon's policies on Cuba, the Environmental Protection Agency and détente with Communists. Nixon rebuts this by saying that if they don't like it then they can give their money to George Wallace.
