Attorneys Rivkin and Schaap represented eleven black sailors aboard the U.S.S. Little Rock, flagship of the Sixth Fleet, Naples, Italy, charged in an outbreak of racial assaults. As a result of a petition to the U.S. Court of Military Appeals argued by LMDC attorney David Addlestone, the convening authority, Captain Peter Cullins, was disqualified as an interested party, since he was in command of the vessel and intervened personally at the time of the fighting.Brookins v. Cullins, 23 USCMA 216, 49 CMR 5 (1974).
The call-back function is exclusively web-based. Here, the internet user provides a phone number on the website of a company that is advertising at which he/she can be called back. As soon as the user confirms she wants to be contacted with a click of the mouse, the technology behind this automatically sets up a telephone conversation between the advertiser and the interested party. At the same time, a cookie saves information on which online advertising medium led to the telephone call.
The examination of the dossier is carried out by the Risk Assessment Committee (RAC) and the Socio-Economic Analysis Committee (SEAC) and opens with a public consultation on alternatives. During 8 weeks, companies, NGOs or any other interested party have the possibility to comment on and possibly challenge the alternatives proposed by the applicant. The consultation can be followed by additional discussions with the two Committees in order to clarify the application. This process is called Trialogue and stakeholders can be invited to participate.
Section 2 of the Directive deals with the evidence. Article 6 gives the power to the interested party to apply for evidence regarding an infringement that lies in the hands of the other party to be presented. The only requirement is for that party to present "reasonably available evidence sufficient to support its claim" to courts. In case of an infringement on a commercial scale, Member States must also take steps to ensure that "banking, financial or commercial documents" of the opposing party are presented.
Larnach was on the brink of financial ruin. Larnach made an explanation to Parliament on 25 October 1895; saying that being an interested party he refrained from voting on banking legislation. But on that day he mistakenly voted for a third reading of the Banking Act Amendment Bill (which involved the Colonial Bank), thinking he was voting on the following bill, the Horowhenua Block Bill.Hansard, 25 October 1895 page 683 In 1898, Larnach locked himself in a committee room at Parliament and shot himself with a revolver.
A colonel whom Lip knows through a contact at a local university leaves a West Point application with Ian, who is chagrinned to learn the officer thinks Lip is the interested party. This leads to a physical confrontation between the brothers, and they refuse to communicate with each other until Grammy, recently released from prison for medical reasons, convinces them to fight and get out their issues. After a short battle, Ian confesses that he feels like he is trapped in Lip's shadow. He and Lip reconcile.
Next would be the administrative appeal, a system of contentious character whose initiation is made at the request of the interested parties, and which intends to review an administrative act. The administrative appeal is a prerequisite for access to contentious- administrative jurisdiction. Finally, there is the previous complaint, a very similar system to the administrative appeal, which also has an initiation at the request of the interested party, but whose object is an underlying conflict between the individual and the Administration (not necessarily an administrative act).
An emoluments attachment order may be executed against the emoluments attachment debtor or garnishee as if it were a judgment of the court. The order is always subject to the rights of the judgment debtor, emoluments attachment debtor or any interested party to dispute the validity or correctness of the order.s 65J(5). The emoluments attachment order “is a good way of proceeding against a judgment debtor who does not possess sufficient attachable assets to pay off a significant portion of the debt.”Pete Civil Procedure 347.
Whilst the contract is for 94 new trains, the company may extend this to 109 trains if Transport for London extend the contract. Siemens are also an interested party in bidding for other new tube train builds for the Bakerloo, Central and Waterloo & City lines. The new plant may also be used as a location to construct trains for HS2 should Siemens be successful in gaining that contract. In April 2019, Siemens submitted their plans for the factory to East Riding of Yorkshire Council.
Committee members shall include the Sports Information Director and others who have knowledge and appreciation of the athletic traditions of the College. Nominations can be submitted by any interested party and should include detailed information about the nominee’s contribution to the athletics program, as well as current contact information. A list of prospective nominees is developed by the SID and solicited from alumni and friends of the College. At least 60 percent of the committee members must vote in favor of a nominee for that individual to be elected to the Athletics Hall of Fame.
The purpose of the account lying for inspection is to enable any interested party to object to the account if that party is of the opinion that it is incorrect. Any objections to the account must be submitted to the Master, who will then forward the objection to the executor for his comments, in terms of the audi alterem partem principle. On receipt of the executor's comments, the Master makes a ruling. If the Master is of the opinion that the objection is well founded, the executor will be directed to amend the account.
As a "financially interested party", being the author of the square reconstruction, he shouldn't serve as the jury president. At the time, city government planned to place the monument on 12 March 2018, on the 15th anniversary of Đinđić's assassination. As it was planned to be placed at the central part of the present carriageway, the project of transforming the square into the pedestrian zone had to be done first. However, the authorities went quiet on this project, additionally introducing the idea of a tram line across the chosen location.
Through the 20th century various people have patented techniques using freeze-gelation, most being centred on the use of ceramics as refractory materials. A furnace lining brick, or an investment casting mold, can be easily fabricated using this method. Recently there was a flurry of interest in freeze-casting at the University of Bath, UK, which led most significantly to two doctoral theses, by J. Laurie in 1995 and by M. Statham in 1998. Taken together in chronological order, these form a good introduction to the technique for the interested party.
In the United States, state law governs whether such an institution may release this identifying information to the interested party. Some states have an adoption registry, in which both the adopted adult and birthparent must register before information will be provided. In other states, if the adoptee requests information, the organization will contact the birth parent and request consent for a reunion. In Canada, adult adoptees from British Columbia, Newfoundland, and Ontario generally have access to their own birth and adoption information provided no disclosure veto has been filed.
In March 2008 Telkom said it would reduce its funding by R2.2-billion as other investments, such as a mobile wireless network, provided a shorter period for return.Mail & Guardian(3) In June 2008 Telkom said it intended to sell its (then 66 percent) stake in Telkom Media. By June it was said to have identified a buyer from among several interested partiesMail&Guardian;(2) and in November 2008 Telkom confirmed that negotiations were at an advanced stage.Bloomberg(1) The interested party was rumoured to be a South African consortium funded out of China.
After receipt of the Schedule of Arrestment, the third party (arrestee) has three weeks in which to complete and send to the creditor and debtor, and any other interested party, a formal document known as Form of Disclosure by Arrestee.Debtors (Scotland) Act 1987 s.73G. This document sets out what property the arrestee (third party) holds for the debtor and the value of such property. The Form of Disclosure by Arrestee must be in a manner stipulated by the Scottish Ministers, currently found in Schedule 8 of the Diligence (Scotland) Regulations 2009.
From its founding until 1967, Comecon had operated only on the basis of unanimous agreements. It had become increasingly obvious that the result was usually failure. In 1967, Comecon adopted the "interested party principle", under which any country could opt out of any project they chose, still allowing the other member states to use Comecon mechanisms to coordinate their activities. In principle, a country could still veto, but the hope was that they would typically choose just to step aside rather than either veto or be a reluctant participant.Bideleux and Jeffries, 1998, p. 561.
In addition, he tells Marco that someone has already responded to his online notice and wants to buy it. Marco knows that the interested party is Visser Three, and he immediately skips the rest of the schoolday in order to stop the automatic E-mail David has set up (which contains his contact information and his address) from going out. During school, Marco takes Ax with him to stop David's E-mail from being sent. Unfortunately, they're too late, due to David's computer's clock being an hour fast.
If CIPO recommends that protection should be given to a geographical indication, a statement is issued in the Trademarks Journal about the proposal. Similar to trademark applications and oppositions, any interested party can file an objection to prevent a geographical indication from receiving protection as long as it is made during the two-month period after the proposal was first published in the Journal. The reason for the publication of these proposals in the Trademarks Journal is to provide an opportunity for the public to review and challenge them, if necessary.
Before a geographical indication is published in the Trademarks Journal, the responsible authority submits a request to protect the geographical indication and the request is reviewed by CIPO. If the geographical indication satisfies the requirements set out in the Trademarks Act, a recommendation is made to the Minister of Innovation, Science and Industry to publish the geographical indication in the Trademarks Journal. Any interested party has two months from the date that the geographical indication first appeared in the Journal to initiate objection proceedings. These proceedings usually involve pleadings, evidence and arguments.
The audit report stated that PCX faced financial difficulties and may be insolvent, with VDC having given it a loan of $(US)2.4m. In April 2005 it was reported that Khan was a key figure in a bid by PCX to apply for a 3G mobile telephony wireless licence in Fiji. Because of the alignment of PCX with NLTB, through VDC, it was put forth by the NLTB as a company that represented the interests of the indigenous Fijian people. Another interested party in the bid was Digicel, owned by Irish telecommunications entrepreneur, Denis O'Brien.
They are subject to legal professional privilege and are therefore duty-bound not to betray client confidentiality, thereby giving them the right to withhold information in court as would an attorney or doctor. In cases where a notary acts as legal advisor to a particular interested party, the advising notary must counsel all parties including third-party beneficiaries. All notaries are law graduates. Not only are they experts in family, estate, company, and property laws, but they must also stay up-to-date about pertinent cases and certain aspects of tax legislation.
The application is reviewed, and if necessary, a detailed background investigation is conducted by the law enforcement bureau. The decision on whether to issue a license is based on a review of the application and information gathered. Licensing's central office staff then reviews or audits each license package and performs a microfilm history check on each applicant or interested party to the license. Further, all license renewals are performed by the central staff, and divided so that approximately 50% of the renewals are performed during a six-month period.
Circus lion tamer Jakra and publicist Squidge are intrigued when they hear about Tama, a beautiful woman from Malaya who may be the rightful heiress to an American family's fortune. To find proof of the claim, Jakra and his girlfriend go with Squidge and another interested party, Professor Thornton, to the Malayan jungle where Tama was raised. There they see her tiger, which can swim, and hear tales of a killer elephant responsible for many deaths. Natives, expecting riches, turn against the visitors, but Tama's tiger comes to their rescue.
In the late 1840s, the Marmora Iron Works formed as a collection of iron mines in the area around Marmora, Ontario. This was only a few miles from the northern portions of the Trent River where they emptied into Rice Lake. A new plan to service the mines was brought up by W. W. Dean at the 1864 meeting, and in 1865 John Dumble was asked to examine the concept of selling the line to investors for hauling iron. He found an interested party in Pittsburgh, headed by George K. Schoenberger.
After someone had "spent" a PoW token at a website, the website's operator could exchange that "spent" PoW token for a new, unspent RPoW token, which could then be spent at some third-party website similarly equipped to accept RPoW tokens. This would save the resources otherwise needed to 'mint' a PoW token. The anti-counterfeit property of the RPoW token was guaranteed by remote attestation. The RPoW server that exchanges a used PoW or RPoW token for a new one of equal value uses remote attestation to allow any interested party to verify what software is running on the RPoW server.
Roxy and Luke later learn Greg is selling the house and Roxy is horrified to learn Irene Roberts (Lynne McGranger) is an interested party and describes her as the landlady from hell, without realising her daughter Fin (Tina Thomsen) is in earshot. Irene responds by saying she will not keep Roxy on as a tenant so Roxy and Luke make plans to buy the beach house themselves. However, Roxy then decides to move back in with Sarah and the Stewarts. Rob Storey (Matthew Lilley) returns to Summer Bay after some time away from the area, and is attracted to Roxy.
In October 2014, CARICOM joined the case as an interested party supporting Tomlinson's arguments. On 18 March 2015, the challenge was heard with allegations that the immigration bans abridge the rights of free movement for Caribbean citizens contained in the Treaty of Chaguaramas. On 10 June 2016, the CCJ ruled that neither Trinidad and Tobago nor Belize had violated Tomlinson's freedom of movement, dismissing his case. As clarification, the judgment noted that neither state can ban homosexuals from CARICOM countries from entering their countries due to their treaty obligations, "notwithstanding their laws that ban the entry of gays".
In January 2009, the Mykolaiv Oblast State Administration reorganized the cooperative enterprise Mykolaiv International Airport into an open stock society. In October 2010, the Mykolaiv Oblast Council canceled its decision to privatize the cooperative enterprise, Mykolaiv International Airport and to reorganize the airport into a public stock society. As was communicated in the session of the County Council, of Mykolaiv County State Administration Igor Katvaluk said: "Until today, not one serious buyer or interested party came to us to invest in our airport. The furthest finding of the airport in procedure of privatization is held its development as a cooperative enterprise".
A plan was made to develop it into offices, retail spaces and residential units. The original Windmill Lane Studios structure was demolished on 3 April 2015, by property investment company Hibernia REIT, with the exception of Open Gallery 3 where U2 recorded. The firm announced plans to retain a 20-metre stretch of the studio wall famous for its fan graffiti. Options for the future of the wall include recreating the wall in the atrium of the new Windmill Lane building, giving the wall to Dublin City Council, U2 or any other interested party for reconstruction or reuse in an alternative setting.
In March 2008, Levees.org announced that records obtained under the Freedom of Information Act revealed that as early October 2005, the Army Corps of Engineers had directed and later paid the ASCE more than $1.1 million for its peer review (Grant Number: W912HZ-06-1-0001). The grant also paid for a series of misleading ASCE presentations attempting to shift blame away from the corps and onto local levee officials. Members of the ASCE are forbidden from making false or exaggerated statements and also from making statements for an interested party unless this is disclosed. Levees.
Stamped paper has been widely used around the world to collect taxes on documents requiring stamping, such as leases, agreements, receipts, court documents and many others. The papers are bought blank apart from the pre- printed stamp and are available from stationers, lawyers offices, post offices and courts according to local regulations. The parties to the matter then write their legal business on the paper and lodge it with the court or other interested party. This is an efficient way of collecting taxes and stamping documents without the need to submit them to a separate government stamp office.
Protection can only be sought for geographical indications related to wine, spirits, agricultural products, and food. Meanwhile, the objector is any interested party that may be impacted by a decision to protect the geographical indication in question. In addition, the Trademarks Act sets out the permissible grounds for objection, procedural rules and protections, service requirements, and the timeframe and content requirements for pleadings filed by the responsible authority and objector. The Trademarks Regulations furnish additional information about timeframes and requirements for correspondence, documents, service, evidence, statements, cross-examination, written representations, hearings, and the payment of fees.
Both the interested party (objector) and the responsible authority are required to submit evidence. The objector and responsible authority can also file a statement that they will not be submitting any evidence. If the responsible authority does not take any action at all (either filing evidence or submitting a statement), the geographical indication will not receive protection; likewise, if the objector does not take any action at all (either filing evidence or submitting a statement), the objection will be deemed withdrawn. After both the objector and responsible authority file their evidence, the objector is allowed to respond with additional evidence.
MK Metro Caetano Nimbus bodied Dennis Dart in September 2004 Choice Travel Wright Urbanranger bodied Mercedes-Benz OH1416 in Wolverhampton in August 2003 In 1997, Peddle took over two former Cambus depots at Huntingdon and Milton Keynes. These had been acquired along with the rest of Cambus by Stagecoach in 1995, but the Office of Fair Trading had instructed Stagecoach to sell two depots to reduce its dominance in the region. They also stipulated that both depots must be sold to the same buyer. Peddle proved to be the only interested party and duly took over the operation in June 1997.
The decision was upheld at appeal on 13 October 2010. The case of CROCKER was heard in 2003 (Thus pre-dating issue of HOC 46/2004). It is referenced as Neutral Citation Number [2003] EWHC 3115 (Admin) CO/505/2003. The brief background is that the claimant, the South Wales Police Authority, sought to quash a decision of the defendant Medical Referee that Mr Crocker the interested party, a police officer who was retired on 3 March 2002, had lost all earning capacity as a result of an injury received in the execution of his duty.
Morris began her tenure as justice in South Pass City in 1870 by arresting Stillman, who refused to hand over his court docket. Ultimately, Morris dismissed her own case with a ruling that she as an interested party did not have the authority to arrest Stillman, according to author Lynne Cheney. Morris began anew with her own docket, holding court sitting on a wood slab in the living room of her log cabin. Cheney notes: > When the lawyers who appeared in her court tried to embarrass her with legal > terms and technicalities, she admitted her lack of training but was quick to > let them know just whose court they were in.
With ABS- CBN's contract to broadcast the UAAP expiring on March 31, 2010, two other TV networks are bidding for exclusive television rights for the league, although ABS-CBN has the right of first refusal. Solar Entertainment Corporation's sports section Solar Sports will join the bidding for the TV rights, with a Solar official naming GMA Network as another interested party. The UAAP has been broadcast by ABS-CBN for ten years already at their UHF station Studio 23. UAAP president Anton Montinola said the league considers "to project the league not just nationally but also globally" due to "a lot of followers abroad, mostly alumni".
In South Africa and other countries whose legal systems are based on Roman-Dutch law, the interdictum de homine libero exhibendo is a remedy by which a person who is arrested or detained can challenge the legality of his or her detention, and be released if it is found to be unlawful. It is the equivalent of the writ of habeas corpus in English law. An application for the interdictum may be made in a superior court either by the detainee or by a family member, friend or interested party on their behalf. It takes priority over other matters on the court roll, and is usually heard by a single judge.
At the hearing where the scheme of arrangement is considered by the court, any creditor or member whose claim or interest would be impaired if the proposals were implemented, has a right of audience. The court has discretion to confirm proposals, modify or reject them. The court may not confirm the proposals if they are not "fair and equitable" or if they are "unfairly prejudicial" to the interests of any interested party. In practice, the court will be slow to find that proposals are unfair or inequitable or unfairly prejudicial in circumstances where the affected class will receive a higher dividend than it would receive in a liquidation.
Each interested party promoted immigration in their own way. Colonial assemblies soon became active in this work, and remained so throughout the colonial period. In 1740 Parliament responded with a more liberal and enlightened policy that greatly eased and broadened the ability of aliens in the American colonies to become naturalized subjects of Britain. William Penn, who as early as 1700 argued in favor of a general naturalization act for the American colonies The Plantation Act 1740 supplanted the private naturalization process in which aliens in the colonies had to travel to London to appeal for subjectship on a costly, case-by-case basis.
In Canadian trademark law, an objection proceeding is an administrative process that allows any interested party to prevent a geographical indication from receiving protection. Geographical indications reviewed and recommended by the Canadian Intellectual Property Office (CIPO) and published in the Trademarks Journal can be disputed through this process. Similar to oppositions, an objection must be based on at least one of the grounds set out in the Trademarks Act, and it must be filed during the two-month period after the geographical indication first appeared in the Trademarks Journal. Objections are also heard and decided by the Trademarks Opposition Board, an administrative body within CIPO.
In 1997, SAFA filed for the trademark "Bafana Bafana" for all goods and services, in all classes. SAFA then applied to have Standton Woodrush Ltd removed from the trade marks register, on the grounds that SAFA was the rightful owner of the name. The case was dismissed on the ground that SAFA was not an interested person within the meaning of this term as used in the Trade Marks Act No. 94 of 1993, which provides that only an interested party has legal standing to seek relief. SAFA made another application to gain ownership of the trade mark, with the second application going to the Appeal Court.
British courts did not accept Pretty's arguments, with the House of Lords, Britain's highest court at the time, eventually turning her case down. The Queen on the Application of Mrs Diane Pretty (Appellant) v Director of Public Prosecutions (Respondent) and Secretary of State for the Home Department (Interested Party) The European Court of Human Rights refused to acknowledge that the European Convention on Human Rights provided a right to die,Article 2 of the Convention ... can not give protection to the negative right to life (that is, the right to end it): and her appeal to that court also failed.ECHR, Pretty v. the United Kingdom, application no.
In 1981, María Teresa acquired Spanish citizenship by royal decree; the official state bulletin said that it was given "at the request of the interested party and in response to the exceptional circumstances and her belonging to a family so closely linked to Spain". In a 1997 interview, María Teresa said that she was Christian, but criticized some Christian attitudes to immigration that sought to create a divide. María Teresa never married, and had no children. She was the aunt of Prince Carlos, Duke of Parma and 4th cousin, once removed, of the current King of Spain, Felipe VI. In 2014, she published a history of the Bourbon-Parma family.
Chaifetz has been linked to attempts to buy multiple professional sports franchises. He was named as a potential buyer of the St. Louis Rams professional football team in 2010. The Rams were eventually sold to Stan Kroenke in August of that year. In 2014, Chaifetz was an interested party to purchase the Milwaukee Bucks professional basketball team. Reportedly, Chaifetz became interested in the franchise due to his longtime friendship with basketball coach and Wisconsin native Rick Majerus, who had been the head coach of the Saint Louis University men’s basketball team in 2007 when Chaifetz donated $12 million to help build the team’s new arena.
The right to vote was reserved to the corporation, which consisted of two "guild stewards", appointed annually, and a varying number of ordinary members or "burgesses", who were appointed by being co-opted by the existing members. This meant that once any interested party had secured control of the corporation it was generally easy to maintain, and the owner or "patron" of the borough usually had total power to nominate both the MPs. Indeed, before 1830 there had not been a contested election in living memory. In 1572, the manor of Calne was bought by Lionel Duckett, and his family were influential over elections in the borough for almost 200 years.
A dead man's statute, also known as a dead man act or dead man's rule, is a statute designed to prevent perjury in a civil case by prohibiting a witness who is an interested party from testifying about communications or transactions with a deceased person (a "decedent") against the decedent unless there is a waiver. This prohibition applies only against a witness who has an interest in the outcome of the case and applies only where that witness is testifying for his own interests and against the interests of the decedent. Furthermore, the restriction only exists in civil cases, never in criminal cases. The restriction can be waived.
The main impediment to Maximo's plan is lack of money and weapons. The legal regime of Hondo Rico also faces a lack of wealth with First Minister Henri Degiere and his aide de camp Captain Toussaint running a Hondo Rican trade fair with a variety of attractive women to lure the United States government or private investors to support the nation through their industry of manufacturing various items out of sugar caneby- products. The only interested party is wealthy Texan millionaire Axel "Longhorn" Gates. During the trade fair Henri hires a pair of Americans Steve and Stoney to fly some cargo and diving gear down to Hondo Rico.

The personal data object of the treatment can only be communicated to a third party for the fulfillment of purposes directly related to the legitimate functions of the transferor and the transferee with the prior consent of the interested party. BVI Platinum news, 26 May 2007 However, rival operator Digicel issued court proceedings against the British Virgin Islands regulator, arguing that he had acted improperly by imposing a limit of three licenses (one of which was awarded to a local cable television company and has not been exercised). bmobile was joined to the suit as an interested party. In United States patent law, a reexamination is a process whereby anyone—third party or inventor—can have a U.S. patent reexamined by a patent examiner to verify that the subject matter it claims is patentable. To have a patent reexamined, an interested party must submit prior art, in the form of patents or printed publications, that raises a "substantial new question of patentability". The Leahy-Smith America Invents Act makes substantial changes to the U.S. patent system, including new mechanisms for challenging patents at the U.S. Patent and Trademark Office. One of the new mechanisms is a post- grant review proceeding, which will provide patent challengers expanded bases on which to attack patents.
Backed by an active Constituency Association, Reid had a strong showing in the 1993 federal election taking 3.9% of the vote in the St. James riding. Following the election Reid was elected to the National Council of the party as a Member-at-Large at a raucous and divisive national convention in Vancouver. During a National Council meeting in Toronto, which was attended by many interested Party members, it was clear that a faction led by Daniel Whetung sought to take control of the party from the elected members and oust several members of the Executive and Council. A strong supporter of proper democratic procedure within the party, Reid sided with the majority of the party's Executive.
Working: If a trademark has not been used in Iran or abroad within three years from the registration date and if the owner or his legal representative fails to furnish a valid reason, any interested party may apply to the court and request cancellation of trademark. Registration: To register a trademark, an applicant (Iranian or foreign) should refer in person or through an attorney to the Registration Office for Industrial Property, in Tehran, and file a request for obtaining a certificate of trademark registration. Applications are published in the official gazette so that interested parties may inspect and, if needed, contest them. The registrar examines applications for format, content and consistency in compliance with the relevant rules of registration.
As with any method used for determining speed, VASCAR is not immune to cheating by operators. Cheating is only useful if the operator intends to show the speed readout to the supposed violator or another interested party as "proof" of the result. The system relies completely on the operator's inputs, so it is possible for a traffic officer to get a desired output, either by cutting off the elapsed time clock early, or by letting the distance counter run longer. Of course, it is not actually necessary for the operator to track the vehicle, and an experienced operator can work the switches until a desired speed is shown, then save that display until an appropriate vehicle comes along.
It found that the Minister of Defence, as head of SANDF, could not appoint the members of the Military Arbitration Board (the body tasked with settling union disputes) because appointment by an interested party (the Minister as the employer) undermines the impartiality and independence of the Board. Furthermore, regulations which prohibited union members from being represented by union members or officials in grievance or disciplinary proceedings offended the right to fair labour practices, because representing its members is one of a union’s central tasks. Finally, to the extent that the good order and discipline of the military was not jeopardised, the SANDF could not forbid non-uniformed soldiers from assembling to petition or picket as private citizens.
Working from a small budget, Thomas had to produce something "feasible", so he wrote a script that was purposefully introspective with a small number of characters. "What you don't have in spectacle, you have to have in sensibility, and you have to have in interesting ideas." Unlike most writers, Thomas does not send a script out to be read; instead, he does a "test telling", sitting down with a potential producer, actor, or other interested party, and he reads it aloud, acting out the various parts, even playing music appropriate to the scene, as Walt Disney used to do when his films were in development. Thomas thinks screenplays are actually a poor blueprint for movies.
In practice, the study of the dynamics of this process by the interested party has evolved into a sophisticated field, where various statistical methods are being applied to the optimization of outcomes. This includes real-time adjustment of presented content, in which a website operator tries to provide deliberate incentives to increase the odds of conversion based on various sources of information, including demographic traits, search history and browsing events. In practice this reflects in different content presented to users arriving from online advertising versus search engines, and similarly different content is presented depending on their demographic segments. The fundamental metric describing this process in the aggregate is known as conversion rate.
When CTV purchased NetStar, the former parent company of TSN, in 2000, the CRTC ordered CTV to sell either TSN or its stake in Sportsnet. CTV ultimately chose to retain TSN, and sell its stake in Sportsnet. The other shareholders had first right of refusal; as Rogers was the only interested party, it acquired CTV's stake in the summer of 2001, and soon after renamed it Rogers Sportsnet. During part of the transition period, during which time the channel was known as "Sportsnet", CTV was allowed to control programming on both networks, and some cross- affiliation and programs that were going to be tape-delayed on TSN, most notably figure skating, were given to Sportsnet.
In 1992, after having conducted an extensive review of the events of September 18, 1970, the London Ambulance Service issued an official statement: "There was no one else, except the deceased, at the flat when they arrived; nor did anyone else accompany them in the ambulance to St. Mary Abbotts Hospital." In 1992, having arranged for a private investigation of Hendrix's death, Etchingham supplied the results of the effort to UK authorities and requested they reopen the coroner's inquest.: (primary source); : (secondary source); : (additional secondary source). After a several-month inquiry by Scotland Yard, during which every interested party to the events was interviewed, officials were confident the request would be granted.
Capps was sworn in to serve a full 2-year term as a Kansas State Representative on January 14. 2019. Prior to the start of the 2019 legislative session, Capps pre-filed his first piece of legislation, HB 2025, aimed at including a person who has filed a petition for adoption in the definition of an interested party in the child in need of care code. While HB 2025 never emerged from committee, Capps spoke frequently during the 2018 election campaign on the importance of reforming the Kansas Department of Children and Families. Capps also introduced HB 2285, a bill creating the Kansas legal tender act; providing for sales exemption from and modification for sales of specie legal tender.
In the event of contradictory applications for declaration, meaning that both an application for a declaration of death and an application for a declaration of absence of the same natural person are filed by the interested parties with a people's court, the people's court shall declare the death of the person if the conditions for a declaration of death as set out in this Law are met. The Chinese law specifically talks about the return of the absentee. The validity of the previous declaratory judgment of death is not imperiled by the sheer fact of return. The absentee or interested party (or parties) must apply for the revocation of the said declaratory judgment, then it can be annulled.
On 4 October 2016, the National Evangelical Association of Belize's appeal of the case was rejected by the Chief Justice because the organization was not an original interested party to the case. In March 2018, the Catholic Church in Belize officially withdrew from the appeal, leaving the Government of Belize as the sole appellant to the decision on Section 53. With the Catholic Church withdrawal, recognition was given that sexual relations between consenting adults was fully legalized in Belize, as the partial appeal by the Government concerned only whether the anti-discrimination clause of the Constitution which referred to sex could be interpreted to prohibit discrimination on the basis of sexual orientation. On 29 October 2018, the appellate court heard full arguments from both sides.
Two hedge funds that owned 20% of the bank, SRM Global and RAB Capital, took legal action against the Government, regulators and individuals whose nationalisation of the bank, they believed to have been inappropriate, and a contributory factor to the current crisis. On 15 January 2008, a meeting was held at the 11,000 seat Metro Radio Arena to discuss the situation which then existed, where all but one of the proposals put forward by the hedge funds were rejected. In May Legal & General joined the hedge funds, as an "interested party". The hedge funds are to request that an independent valuer assesses the level of compensation and to argue that the bank's shares are worth more than the final price of their trading prior to nationalisation.
Von Sickingen and Silvester of Schauenburg wanted to place Luther under their protection by inviting him to their fortresses in the event that it would not be safe for him to remain in Saxony because of the threatened papal ban. Between the Edict of Worms in April 1521 and Luther's return from the Wartburg in March 1522 a power struggle developed of who was to lead the Reformation through its competing possibilities and how the Reformers should follow their teachings. In Wittenberg each interested party – prince, town council and commune – wished to expand its influence on the governance of the church in accord with its own values and needs.Carter Linderg, The European Reformations (Boston: Blackwell Publishing, 2006), 96-97 Through this the question of authority appeared.
The doctrine that such marriages were illicit was reflected in the Table of Kindred and Affinity in the Anglican (Church of England) Book of Common Prayer. The full table of kindred and affinity from the Book of Common Prayer can be seen at Prohibition of marriage between certain degrees of kindred outlawed what is known as incest; prohibition between degrees of relationship by marriage (affinity) as opposed to blood (consanguinity) seems to have reflected an analogous taboo. At least one novel, Felicia Skene's The Inheritance of EvilFull text at (1849), addressed the topic in polemic fictional form. Under ecclesiastical law, a marriage within the prohibited degrees was not absolutely void but it was voidable at the suit of any interested party.
The Atmospheric Pollution Prevention Act, the court found, does authorise the Minister of Health and Welfare to apply for an interdict to enforce the provisions of section 9(1) thereof, and to restrain conduct which constitutes the carrying on of a "scheduled process" within a controlled area without a current registration certificate, in contravention of section 9(1). The Minister is not limited, therefore, to the specific criminal penalties provided for contraventions of section 9. The Act provides no specific "remedies" which the Minister or any other interested party can invoke to stop a person from contravening it. In such circumstances the principle does not arise that the Act is exclusive as to what may be done to enforce its provisions.
Marriott's Great America, built by hotel and restaurant operator Marriott Corporation, opened to the public on March 20, 1976. Less than two months later on May 29, the company opened a second Marriott's Great America – later known as Six Flags Great America – north of Chicago in Gurnee, Illinois. A third park was initially planned for the Baltimore–Washington metropolitan area, but the idea was later abandoned after several failed attempts to sway local opposition. View of California's Great America from above The park, though profitable, was still an earnings disappointment for Marriott, leading the company in 1983 to explore options to sell. An interested party, Caz Development Co., appraised the land value at US$800,000 to $1 million per acre.
5, (5), Article VIII, 1987, Constitution) The writ of habeas corpus is an "extraordinary", "common law", or "prerogative writ", which were historically issued by English courts in the name of the monarch to control inferior courts and public authorities within the kingdom. The most common of the other such prerogative writs are quo warranto, prohibito, mandamus, procedendo, and certiorari. The due process for such petitions is not simply civil or criminal, because they incorporate the presumption of non-authority, so that the official who is the respondent has the burden to prove his authority to do or not do something, failing which the court has no discretion but to decide for the petitioner, who may be any person, not just an interested party.
In the proceedings, all parties accepted that withdrawal from the European Union would have profound consequences in terms of changing domestic law in each of the jurisdictions of the United Kingdom.[2016] EWHC 2768 (Admin). para.4 At the preliminary hearing on 19 July 2016, Sir Brian Leveson, President of the Queen's Bench Division, stated that the court gave leave to Dos Santos to stay his proceedings and join as an interested party in Miller's case, and others, such as a group of unnamed clients who were separately represented, would have the option to be interested parties in the claim or interveners. At the hearing, lawyers for the government confirmed that the government would not issue an Article 50 notification before the end of 2016.
The same reform of 1994 restored the "concentrated control" of constitutionality is a function of the Supreme Court, in laws and at the request of the Executive Branch that resource, one of the Presidents of the Chambers or an interested party. This resource ormes erga not close the traditional way of constitutional motion by way of exception, "fuzzy control". According to the above-mentioned article 63 of the Constitution of 1994 the law would regulate the judicial career and pension scheme of the judges, officials and employees of the court order. Moreover, appropriated judicial functions that are incompatible with other public office or employment except teaching and honorary positions; and it also stated that judges are irremovable, except suspension or dismissal by the Supreme Court, in the manner prescribed by law.
Victor Chandler Jr. had owned 20% stake in the track since 1974 but wanted to sell his share due to the fact that his side of the family was concerned with the bookmaking business. The Greyhound Racing Association (GRA) also held a third share in the track but had to sell to alleviate their debts in January. Suddenly it became apparent that an interested party could acquire a 52% stake in the track and have the controlling interest, it led to a clambering from major players looking to buy Walthamstow. Corals and Ladbrokes both expressed an interest but the Chandler family rallied round, Charles Jr., Percy and Frances (wife of Charles Sr.) spent over £400,000 to withstand the attempts from Corals and Ladbrokes and buy the track outright.
A de may be added in front of a surname that could be otherwise misunderstood as a forename.Article 195, Reglamento del Registro Civil: "On petition of the interested party, before the person in charge of the registry, the particle de shall be placed before the paternal surname that is usually a first name or begins with one" (for example, a birth may be registered for a "Pedro de Miguel Jiménez", to avoid having "Miguel" taken for a middle name). Article 206 does allow persons to remove de and an article from their surname, should they so desire. Conclusive proof of the nobility of a surname can be determined by establishing whether that surname is associated with a blazon, since for centuries coats of arms have been borne legally only by persons of noble condition.
Featured events in these contests have been tailored to emphasize a more well-rounded athlete, to reflect that viewpoint on strongman as a whole, and in the interests of increased popularity and marketability among the masses. Almost inevitably, more than one interested party has seen the benefits of strength competitions. Alternative organizations have formed in recent years, comprising a new wave of influence in the field, with the United Kingdom Strength Council (UKSC) founded by Britain's Strongest Man multi-year champion Glenn Ross setting up events separate from BSM, as has the IFSA. Ross and his UK Strongest Man competitions hold a philosophical difference in approach with the World's Strongest Man related venues, including more brute strength events similar to traditional strongman and powerlifting, with less emphasis on field athleticism and endurance.
Because trade and capital investment issues were involved, for example, in relations with the People's Republic of China and with South Korea, the business community increasingly became an interested party in the conduct of foreign affairs. Similarly, when fishing rights or agricultural imports were being negotiated, representatives of the industries affected worked with political leaders and the foreign affairs bureaucracies in shaping policy. Because of the continuous control of the government enjoyed by the LDP since its formation in 1955, the policy- making bodies of the LDP had become the centers of government policy formulation. Because the unified will of the majority party almost invariably prevailed in the Diet, some observers believed that the Diet had been reduced to a mere sounding board for government policy pronouncements and a rubber- stamp ratifier of decisions made by the prime minister and his cabinet.
In determining the party to prepare a HCP and application for an Incidental Take Permit, two primary factors must be considered; first, the party must be capable of overseeing the implementation of the HCP once approved and second, the party must be capable of funding the implementation of the HCP. Beyond these requirements, parties can vary based on the scope of the proposed action. For example, a single landowner may be the sole preparer of a HCP if they intend to obtain an Incidental Take Permit for an action on their own property and they are the only interested party. For large-scale projects such as those covering a region of land rather than a single property, or those with multiple interested parties rather than a single landowner, the permittee may be a group such as a local or governmental agency.
Since 1994, CISAC has been working to improve data exchanges on creative works between authors' societies. Known as the Common Information System (CIS) project, CISAC has worked on the development of ISO certified international standards for the identification of creative works and rights holders."New ISO standard for worldwide identification of musical works", ISO, 2002 These include the International Standard Musical Work Code (ISWC), the International Standard Audiovisual Number (ISAN), the International Standard Text Code (ISTC) and the International Standard Name Identifier (ISNI), a unique identifying number linked to contributors (such as a songwriter or publisher) and which complements CISAC's Interested Party Information (IPI) System where more detailed information on the rights owner, accessible to authors societies, is held. CISAC released "CIS-Net powered by FastTrack" in 2004, an Internet-based network for sharing musical works information between authors' societies.
Smurthwaite renewed his dispute with The Sentinel by banning the newspaper from attending the club's press conference where Ribeiro was unveiled as the club's new manager. He went on to appoint Colin Garlick as the club's CEO, and in January stated that "I'm only really involved now when it comes to prising open the sweetie jar for the money". In March, Smurthwaite used the OneValeFan fansite to ask supporters to vote whether he should sell the club to one of two hedge funds that he said had met his asking price for the club. The Sentinel revealed one interested party was a Norwegian company who proposed a sale figure of £6.5 million based on a valuation of Vale Park at £10 million, the playing squad at £5 million and expected crowds of 20,000 in the Championship.
For his conduct in the Royal Commission on the activities of the NSW Police, he was censured by the New South Wales Bar Association for lacking tolerance and judicial calm and exhibiting "a great disservice to the bench and the legal profession";Sydney Morning Herald 3 July 2002 he was also criticised by the Incorporated Law Institute for "departing from accepted standards of courtesy, fairness and patience". John Douglas Pringle, editor of The Sydney Morning Herald, condemned "the mean and shabby courtroom ... where the judge failed to preserve that august and aloof detachment which is his function and participated in the inquiry as though he was counsel engaged for an interested party". He was a racehorse owner and was frequently seen at racecourses wearing his trademark top hat and a monocle. One of his top hats is now on display at the Powerhouse Museum in Sydney.
The "prerogative" writs are a subset of the class of writs, those that are to be heard ahead of any other cases on a court's docket except other such writs. The most common of the other such prerogative writs are habeas corpus, quo warranto, prohibito, mandamus, procedendo, and certiorari. The due process for petitions for such writs is not simply civil or criminal, because they incorporate the presumption of non-authority, so that the official who is the respondent has the burden to prove his authority to do or not do something, failing which the court has no discretion but to decide for the petitioner, who may be any person, not just an interested party. In this, they differ from a motion in a civil process in which the burden of proof is on the movant, and in which there can be a question of standing.
This law is a consolidation of numerous laws regulating the manufacture and distribution of narcotics, stimulants, depressants, hallucinogens, anabolic steroids, and chemicals used in the illicit production of controlled substances. The act also provides a mechanism for substances to be controlled, added to a schedule, decontrolled, removed from control, rescheduled, or transferred from one schedule to another. Proceedings to add, delete, or change the schedule of a drug or other substance may be initiated by the Drug Enforcement Administration (DEA), the Department of Health and Human Services (HHS), or by petition from any interested party, including the manufacturer of a drug, a medical society or association, a pharmacy association, a public interest group concerned with drug abuse, a state or local government agency, or an individual citizen. When a petition is received by the DEA, the agency begins its own investigation of the drug.
His mother directly attributed his death to his struggle with the Home Office regarding his immigration status. His treatment and death was described by his MP David Lammy as "a tragedy". Jeremy Corbyn, the Leader of the Opposition, said that “[Bristol's mother] argued, powerfully and convincingly, that this is racism. He was the victim of [British government] policies.” The Grenadian prime minister Keith Mitchell said, regarding Bristol's death, that "no amount of compensation can deal with pain". The poet Benjamin Zephaniah was quoted as saying “I’d like to see heads roll, but how do you compensate somebody like the mother of Dexter Bristol?” On 28 August 2018 an inquest at St Pancras Coroner's Court, concluded that Bristol had died of natural causes, namely "acute cardiac arrhythmia", though the coroner acknowledged that stress had been a factor in his death. Bristol's family walked out of the inquest following the coroner's refusal to allow that the UK Home Office should be named as an "interested party" to the inquest.

The DEA also may begin an investigation of a drug at any time based upon information received from laboratories, state and local law enforcement and regulatory agencies, or other sources of information.

Caleb Orozco successfully argued in court that Belize's sodomy ban was unconstitutional. In September 2010, the United Belize Advocacy Movement (UNIBAM) and its executive director Caleb Orozco jointly filed a case in the Supreme Court of Judicature of Belize challenging the constitutionality of Belize's anti-sodomy law with the support of the International Commission of Jurists, the Commonwealth Lawyers' Association, and the Human Dignity Trust. Counsel for the Church Interested Parties (CIP) (consisting of the Roman Catholic Church, the Belize Church of England Corporate Body, and the Evangelical Association of Churches) argued in January 2012 that UNIBAM had no standing to bring the case because, as an organization, it has no constitutionally guaranteed rights. Relying on Section 20 of the Belize Constitution, the court sided with CIP on 27 April 2012 and struck out UNIBAM as a claimant. In December 2012, Justice Arana granted UNIBAM "interested party" status, which was the same status given to CIP."UNIBAM regains ground in court", 7 News Belize, 5 December 2012 The case was heard by the Supreme Court of Judicature in May 2013,Global Post.
