Known as Fortnite Battle Royale, Epic later released it as a standalone free-to-play game in September 2017. Shortly after its release, Bluehole expressed concerns about the game, acknowledging that while they cannot claim ownership of the battle royale genre, they feared that since they had been working with Epic for technical support of the Unreal engine, that they may have had a heads-up on planned features they wanted to bring to Battlegrounds and could release it first. PUBG Corporation later filed a lawsuit against Epic Games Korea in January 2018, alleging that Fortnite Battle Royale was infringing the copyright of Battlegrounds. However, the lawsuit was closed by PUBG in June 2018 for undisclosed reasons.

Whosoever infringes copyright or the performers shall be punished with a fine from 20,000-200,000 baht. If the offence is committed for commercial purposes, the offender shall be punished with imprisonment for a term from six months up to four years or a fine from 100,000-800,000 baht or both imprisonment and fine. Whosoever infringes copyright by selling the work for profit, distribution which may cause damage to the owner of copyright, or communicating the work to the public by knowing that the work is made by infringing the copyright of another person shall be punished with a fine from 10,000-100,000 baht. If the offence is committed for commercial purposes, the offender shall be punished with imprisonment for a term from three months up to two years or a fine from 50,000-400,000 baht or both imprisonment and fine.

The layering of copyright raises a number of legal questions. Even if a person owns the copyright in a given compilation by virtue of section 13(1) because that person is the author of the compilation has exercised skill and judgement in the selection or arrangement of the constituent works into a compilation. In order for the owner of the copyright of a compilation not to be infringing the copyright of the constituent works, the statute would have to be interpreted to the effect that the copying the constituent works is not something that "only the owner of the copyright" in the constituent works has a right to do, and that the owner of the compilation also has a right to copy the constituent works. However, this interpretation would also be problematic because it would seem to conflict with another provision in the Copyright Act, namely section 2.1(2).
