The environmental claim was also dismissed by Judge Smith, and the issues regarding the environmental claim are currently pending in the Georgia Court of Appeals. The Georgia Court of Appeals recently ruled that Walker County Georgia does not have a claim under Georgia's Hazardous Site Response Act.
Even if the court denies equitable relief to a plaintiff because of laches, the plaintiff may still have a claim for legal relief if the statute of limitations has not run out. Under the United States Federal Rules of Civil Procedure, laches is an affirmative defense, which means that the burden of asserting laches is on the party responding to the claim to which it applies. The laches defense does not apply if the claimant was a minor during the time that the claim was not brought, so a party can bring a claim against an historical injustice when they reach their majority.
Dual citizenship is possible in Turkish law. The laws of Turkey provide for acquisition of Turkish citizenship based on one's descent—by birth to a Turkish citizen parent (or parents) in Turkey and also by birth abroad to a Turkish citizen parent (or parents)—regardless of the other nationalities a person might acquire at birth. Children born in Turkey to foreign citizens do not have a claim to Turkish citizenship, unless one of the parents is also a Turkish citizen or the child would otherwise be stateless. The automatic acquisition (or retention) of a foreign nationality does not affect Turkish citizenship.
Joscelin was his closest male relative who did not have a claim to the throne, so he was judged a reliable supporter: indeed, he proved his loyalty. In his capacity as regent, Raymond of Tripoli had begun negotiations for the marriage of princess Sibylla to William of Montferrat, a first cousin of Louis VII of France and of Frederick I, Holy Roman Emperor. William arrived in early October and became Count of Jaffa and Ascalon upon his marriage. In 1174, at the young age of 13, Baldwin successfully attacked Damascus in order to draw the Muslim Sultan Saladin away from Aleppo.
Hogan believed that a solid, repeatable golf swing involved only a few essential elements, which, when performed correctly and in sequence, were the essence of the swing. His book Five Lessons: The Modern Fundamentals of Golf (written with Herbert Warren Wind) is perhaps the most widely read golf tutorial ever written, although Harvey Penick's Little Red Book would also have a claim to that title, and the principles therein are often parroted by modern "swing gurus". In the Five Lessons, Hogan breaks down the swing into four parts: The Fundamentals, The Grip, Stance and Posture, and The Swing.
Bowen LJ's opinion was more tightly structured in style and is frequently cited. Five main steps in his reasoning can be identified. First, he says that the contract was not too vague to be enforced, because it could be interpreted according to what ordinary people would understand by it. He differed slightly from Lindley LJ on what time period one could contract flu and still have a claim (Lindley LJ said a "reasonable time" after use, while Bowen LJ said "while the smoke ball is used"), but this was not a crucial point, because the fact was that Mrs.
The priests of the temple are known as Kapuralas and are believed to be descended from Vedda people. Veddas, too, have a claim on the temple, a nearby mountain peak and locality through a number of legends. There is a mosque and a few tombs of Muslim pious men buried nearby. The temple complex is also connected to other similar temples in Eastern Province dedicated to Murugan which are along the path of pilgrimage from Jaffna in the north to Kataragama in the south of the island; Arunagirinathar traversed this pilgrimage route in the 15th century.
I even believe in helping an employer function more productively. For then, we will have a claim to higher wages, shorter hours, and greater participation in the benefits of running a smooth industrial machine.... Hillman's belief in stability as the basis for progress was coupled with a willingness to embrace industrial engineering approaches, such as Taylorism, that sought to rationalize the work processes as well. This put Hillman and the ACW leadership at odds with the strong anarcho-syndicalist tendencies within the union's membership, many of whom believed in direct action as a principle as well as tactic.
'B' says that Æthelwold "rode away by night" from Wimborne; 'A' reads "stole away". According to 'B', the Northumbrian Danes accepted Æthelwold as their king, and gave allegiance to him, but this is omitted in 'A'. However, none of the texts describe him as an ætheling after his flight to Northumbria, showing that his actions were no longer thought to have a claim to legitimacy. In the view of Scott Thompson Smith, the dispute was over property as well as kingship, and the Chronicle presents Edward as the successful protector of family property against outside interests.
They had a daughter Miriam Auhea Kekāuluohi (1839–1899), named for the Kuhina Nui (co-regent) at the time, Kekāuluohi. Auhea Kekāuluohi was mentioned as betrothed to Prince Lunalilo, but instead would marry American William Isaac, (or Jesse) Crowningburg (who claimed relationship to a Duke of Königsberg) and then after a divorce and his death, remarry Paul Kamai in 1873. After Lunalilo's death during his short reign as King, Miriam was considered to have a claim to the throne herself. She never contested the closer connections of the other contenders: Queen Emma, Bernice Pauahi Bishop, and Ruth Keʻelikōlani.
Gandhi's silence after the Khilafat period may represent an evolution in his understanding of the conflicting religious claims over Palestine, according to Kumaraswamy. In 1938, Gandhi spoke in favour of Jewish claims, and in March 1946, he said to the Member of British Parliament Sidney Silverman, "if the Arabs have a claim to Palestine, the Jews have a prior claim", a position very different from his earlier stance. Gandhi discussed the persecution of the Jews in Germany and the emigration of Jews from Europe to Palestine through his lens of Satyagraha.Panter-Brick, Simone (2008), Gandhi and the Middle East: Jews, Arabs and Imperial Interests.
The monarch's reign can end in two ways: ;Death: (William II, William III) ;Abdication: The monarch willingly steps down. (William I, Wilhelmina, Juliana, Beatrix) Both these events cause the regular mechanisms of succession to go into effect. Constitution for the Kingdom of the Netherlands Article 27 (Dutch edition of WikiSource) While the constitution mentions neither possibility explicitly, it does describe what happens after the monarch dies or abdicates. Abdication is a prerogative of the monarch, but it is also irreversible—the person abdicating cannot return to the throne, nor can a child born to a former monarch after an abdication has occurred have a claim to the throne.
Langalibalele's legacy continued into the late twentieth and early twenty-first centuries. In 1990, shortly after his own release from Robben Island Nelson Mandela laid a wreath on Langalibalele's grave in recognition of Langalibalele's own internment there. In 2005 the amaHlubi people presented a Submission to the Commission on Traditional Leadership Disputes and Claims under the Framework Act to recognise Ingonyama Muziwenkosi ka Tatazela ka Siyephu ka Langalibalele, otherwise known as Langalibalele II as king of the amaHlubi. However, in 2010 the Nhlapo Commission found that since the amaHlubi has been dispersed before the colonial era they did not have a claim to a kingship.
The poem forms a prominent landmark and reference point for the study of Old English prosody, for the early influence which Christianity had on the poems and songs of the Anglo-Saxon people after their conversion. Cædmon's Hymn is the oldest recorded Old English poem, and also one of the oldest surviving samples of Germanic alliterative verse. Within Old English, only the inscriptions upon the Ruthwell Cross (doubtful) or Franks Casket (early 8th century) may be of comparable age. Outside of Old English, there are a few alliterative lines preserved in epigraphy (Horns of Gallehus, Pforzen buckle) which have a claim to greater age.
Cases of intentional torts or breaches of fiduciary duty often allow for claims of unjust enrichment, as well as cases of statutory torts and breaches of contract. A plaintiff can even have a claim in unjust enrichment when there is no other substantive claim. The Uniform Commercial Code ("UCC") entitles a buyer who defaults restitution of the buyer's deposit to the extent it exceeds reasonable liquidated damages or actual damages. If the contract does not have a liquidated damages clause, the UCC provides a statutory sum: 20% of the price or $500, whichever is less, and the buyer who defaulted is entitled to restitution of any excess.
They also claim the brothers stole the statue of the Capitoline Wolf from the Temple of Apollo in Rome.Art in Renaissance Italy, by John T. Paoletti, Gary M. Radke, Laurence Publishing Company, 71 Great Russell Street, London (2006) page 99. However, since the brothers were descendants of Remus, Siena did have a claim to be descendants of one of the siblings nurtured by the she-wolf (lupa), which serves as a symbol of Rome. The Porta Camollia, in the Walls of Siena, is putatively named after an emissary or soldier sent to lure the brothers back to Rome, but who elected to stay instead.
Through her great grandfather Captain Harold Cox, Auhea was either one-eighth English or American descent. Her mother Namahana was the daughter of Peleuli, daughter of High Chief Kalaʻimamahu, half-brother of Kamehameha I. Her grandmother was the half- sister of Miriam Auhea Kekāuluohi, who ruled as Kuhina Nui of the Hawaiian Kingdom under Kamehameha III from 1839 to 1845, making the younger Auhea a second cousin of King Lunalilo. It was alleged that she was betrothed to Lunalilo but eloped instead with Jesse Crowningburg. After Lunalilo's death during his short reign as King, Auhea was considered to have a claim to the throne herself.
The French-Belgian commercial outpost of Bicaise on the Rio Nunez. Once the treaty with Lamina signed, the Belgians wanted to make an agreement with Mayoré who was becoming less and less hospitable to Europeans. Mayoré had expulsed Ismaël Tay, a Frenchman and his own brother in law, and kidnapped his wife and child, whom he felt threatened by since he could one day have a claim to his throne. The Belgians organised an expedition with Bicaise, a local merchant, and discovered Mayoré's people constructing a building meant for two English merchants, Braithwaith and Marin, on land owned by Bicaise and without his authorisation.
This article lists and discusses the usage and derivation of names of large numbers, together with their possible extensions. The following table lists those names of large numbers that are found in many English dictionaries and thus have a claim to being "real words." The "Traditional British" values shown are unused in American English and are obsolete in British English, but their other-language variants are dominant in many non-English-speaking areas, including continental Europe and Spanish-speaking countries in Latin America; see Long and short scales. Indian English does not use millions, but has its own system of large numbers including lakhs and crores.
This does not, however, mean that employees unfairly dismissed before a sale have a right to their jobs back, because national law's normal remedy remains with a preference for damages over specific performance.Wilson v St Helens BC and British Fuels Ltd v Baxendale [1998] UKHL 37, [1999] 2 AC 52 The same principle goes for any variation that works to the detriment of the employee. So the transferee employer may not (without a good business reason) for example, try to impose a single new gardening clauseCredit Suisse First Boston (Europe) Ltd v Lister [1999] ICR 794 or withdraw tenure, or the employee will have a claim for constructive dismissal.
Friedrich Wilhelm was born in Schloss Umkirch. He was the eldest son of Friedrich, Prince of Hohenzollern (1891–1965) and his wife, Princess Margarete Karola of Saxony (1900–1962), the daughter of the last King of Saxony Frederick Augustus III. He became the head of the House of Hohenzollern on 6 February 1965 following the death of his father Prince Friedrich, and remained so until his death on 16 September 2010. According to the Romanian succession laws of the kingdom's last democratic Constitution of 1923, Friedrich Wilhelm's descendants would have a claim to the Romanian throne (see "Line of succession to the former Romanian throne") upon the demise of former King Michael.
Stakeholder analysis (in conflict resolution, business administration, environmental health sciences decision making, Industrial ecology, and project management) is the process of assessing a system and potential changes to it as they relate to relevant and interested parties (stakeholders). This information is used to assess how the interests of those stakeholders should be addressed in a project plan, policy, program, or other action. Stakeholder analysis is a key part of stakeholder management. A stakeholder analysis of an issue consists of weighing and balancing all of the competing demands on a firm by each of those who have a claim on it, in order to arrive at the firm's obligation in a particular case.
The victim of the misuse may have a claim to an equitable remedy against the misuser, as well as a cause of action under property law, contract law and tort law. The remedies available for each of these types of wrongs could differ. Rather than let every case for misuse of confidential information turn on how best to characterize a plaintiff's harm, Justice Binnie thought it best to consider misuse of confidential information as its own sui generis claim and to provide remedies based on what is most just given the particular facts of a case. In this case, Justice Binnie felt that, for several reasons, it would not be just to impose an injunction on FBI Foods Ltd.
If he makes such a reservation, RJ would not bar him from returning the case to federal court at conclusion of action in state court.England v. Louisiana State Board of Medical Examiners, 375 U.S. 411 (1964) There is a declaratory judgment exception to RJ. “[A] declaratory action determines only what it actually decides and does not have a claim preclusive effect on other contentions that might have been advanced.” Therefore, “a plaintiff who has lost a declaratory judgment action may also bring a subsequent action for other relief, subject to the constraint of the determinations made in the declaratory action.” This exception has been adopted in Oregon, Texas, and a number of other U.S. states.
If more than one player has a winning combination, the prize is shared. Some games though require the player to press a button when they have a claim and only then will the computer check it and end the game (or reject it if the player has made a mistake). As well as being announced verbally, most prize bingo establishments feature a TV monitor or several that shows the last called number and how many numbers have been called. In addition to this, the consoles often have a small LED display that shows this information when a game is in progress or the number of remaining credits when there is no game in progress.
Lithuanian nationality law operates on the jus sanguinus principle, whereby persons who have a claim to Lithuanian ancestry, either through parents, grandparents, great-grandparents may claim Lithuanian nationality.. Citizenship may also be granted by naturalization. Naturalization requires a residency period, an examination in the Lithuanian language, examination results demonstrating familiarity with the Lithuanian Constitution, a demonstrated means of support, and an oath of loyalty. A right of return clause was included in the 1991 constitution for persons who left Lithuania after its occupation by the Soviet Union in 1940 and their descendants. Lithuanian citizens are also citizens of the European Union and thus enjoy rights of free movement and have the right to vote in elections for the European Parliament.
In June 2017, Doka La became the site of a stand-off between the armed forces of India and China following an attempt by China to extend a road from Yadong further southward on the Doklam plateau. India does not have a claim on Doklam but it supports Bhutan's claim on the territory. According to the Bhutanese government, China attempted to extend a road that previously terminated at Doka La towards the Bhutan Army camp at Zompelri two km to the south; that ridge, viewed as the border by China but as wholly within Bhutan by both Bhutan and India, extends eastward overlooking India's highly-strategic Siliguri corridor. On 18 June, Indian troops crossed into the territory in dispute between China and Bhutan in an attempt to prevent the road construction.
A wrongful dismissal can be actual or constructive, but a constructive dismissal is almost certain to be a wrongful one, since the correct notice will not have been given if the dismissal was caused by a resignation, itself caused by the employer's serious breach of contract. An employee who was constructively dismissed, as well as possibly having a claim for breach of the duty not to destroy the bond of mutual trust, will usually have a claim for wrongful dismissal. As only economic loss can be claimed for breach of contract, the main loss will be earnings due to the lost notice period, as opposed to any disgruntlement about the manner or reason for dismissal, so the constructive nature of the dismissal tends to disappear into the claim for lost notice period.
Internal feuds between the powerful families, such as the Grimaldi, the Fieschi, the Doria, the Spinola and others, caused much disruption, but in general the republic was run much as a business affair. During the Late Middle Ages Genoa was one of the main commercial powers of the Mediterranean Sea, while between the 16th and 17th centuries it was one of the major financial centers in Europe. The Genoese have a claim to the creation of the rough denim cloth then called "Blue Jeans" (an anglicised spelling of Gênes, the French name of the city), nowadays shortened simply as jeans, used by sailors for work and to cover and protect their goods on the docks from the weather. During the Republic of Genoa, Genoese merchants and sailors exported this cloth throughout Europe.
An order of succession of various male relatives is often spelled out by jurists. An example is this list written by Ibn Abd al-Wahhab: if the father is otherwise unavailable, guardianship should be assigned > first to the woman's brother, then to the paternal grandfather than to the > woman's son.... [then it] passes to the tribe of the brother, unless it is > law/base/despicable, ... [then the] paternal uncle takes over, followed by > his son, then other relatives in paternal relationships. ... Maternal > relative only have a claim to marriage guardianship if there are not > paternal relatives. ... the sultan or political leader may serve as the > marriage guardian ... only if he is a just man .... Thus the critical factor > in selecting an alternative marriage guardian is the man's adherence to > justice, not his political position.
It would be well to remember, though, that while racism had to be legislated out of the South, many in the North, including Quakers and others who ran the Underground Railroad, were ideologically opposed to Southerners' treatment of blacks. By the same token, many white Southerners have a claim to closer relationships with blacks than wealthy northern whites, regardless of the latter's stated political persuasion.History of Residential Segregation Anti-miscegenation laws (also known as miscegenation laws) prohibited whites and non-whites from marrying each other. These state laws always targeted marriage between whites and blacks, and in some states also prohibited marriages between whites and Native Americans or Asians. As one of many examples of such state laws, Utah's marriage law had an anti-miscegenation component that was passed in 1899 and repealed in 1963.
This interpretation has no contradictions since the idea that the Jewish people have a claim to ownership rights on the physical land is based on the idea of God deciding to give the land to the Jewish people and commanding them to occupy it as referred to in Biblical texts previously mentioned. In the boundary of the Promised Land is clarified in terms of the territory of various ancient peoples, as follows: : On that day the LORD made a covenant with Abram and said, "To your descendants I give this land, from the river of Egypt to the great river, the Euphrates - the land of the Kenites, Kenizzites, Kadmonites, Hittites, Perizzites, Rephaite, Amorites, Canaanites, Girgashites and Jebusites." The verse is said to describe what are known as "borders of the Land" (Gevulot Ha-aretz).Kol Torah, vol.
He was the child of Philip's second wife Mariana of Austria who became her son's regent. Mariana's nearest male relative, the Emperor Leopold would have a claim to inherit the Spanish Empire through his mother, Maria Anna of Spain, if Charles died childless, so Louis therefore claimed that, since Maria Theresa's dowry had not been paid, her renunciation was invalid. In addition, he referred to an obscure law of the duchies of Brabant and Limburg that prioritised the children of a first marriage in cases of inheritance and finally argued that Maria Theresa's rights to the Spanish throne "devolved" to him. The French invasion of the Spanish Netherlands in 1667 was initially very successful, but on 31 July, Peace of Breda ended the Second Anglo-Dutch War and the Dutch began discussions with England and Sweden on creating a diplomatic alliance to protect Spain against France.
Such conflicts have given rise to a significant body of case law in the United States,e.g., where courts have frequently held that state tort laws may be "pre-empted" where they conflict with federal enactments. #While the decision may be surprising to those who practise in the area of maritime law (with some considering the lower courts to have reached the correct decision), to conclude differently would have created uncertainty, (a) for marine employers who may have paid into their respective provincial funds but, ultimately, would not be entitled to the limited liability benefits thereof; and (b) for employees injured or killed in a marine context who would not, based on their specific fact scenario, have a claim in tort against their employer and thus would have no ability to obtain compensation. #In Ryan Estate, the SCC also tried to clarify what exactly it means to impair a core legislative power.
Like the novel, the season continues the storyline of The War of the Five Kings: after the death of Renly Baratheon, all four kings in Westeros believe they have a claim to the Iron Throne, besides Robb Stark, who seeks vengeance for the death of his father, Ned Stark, and independence for the North. The season also features other storylines: Daenerys Targaryen begins her rise in power in Essos; Ned's illegitimate son, Jon Snow, goes undercover beyond the Wall; the other Stark children struggle to survive up and down Westeros, but Robb is killed; Jaime Lannister returns to the capital; and all of Westeros is informed of the reawakened threat of the Army of the Dead. Game of Thrones features a large ensemble cast, including Peter Dinklage, Nikolaj Coster-Waldau, Lena Headey, Emilia Clarke and Kit Harington. The season introduced a number of new cast members, including Diana Rigg, Ciarán Hinds, Nathalie Emmanuel and Iwan Rheon.
Given the substantial number of Europeans who emigrated throughout the world in the 19th and 20th centuries, and the extension of citizenship by descent, or jus sanguinis, by some EU member states to an unlimited number of generations of those emigrants' descendants, there are potentially many tens of millions or even hundreds of millions of persons currently outside Europe who have a claim to citizenship in an EU member state and, by extension, to EU citizenship. There have also been extensive debates in European national legislatures on whether, and to what extent, to modify nationality laws of a number of countries to further extend citizenship to these groups of ethnic descendants, potentially dramatically increasing the pool of EU citizens further. If these individuals were to overcome the bureaucratic hurdles of certifying their citizenship, they would enjoy freedom of movement to live anywhere in the EU, under the 1992 European Court of Justice decision Micheletti v Cantabria.
From there, Gewirth holds that an agent must attach a positive value to E, through some criteria, that motivates them to achieve E, or else there would be no motivation to act in the first place. Because an agent values E, it follows that they must value the conditions necessary to achieve E. Gewirth claims these conditions are that of freedom, the ability to choose purposes, and well-being, the ability to realize purposes. Since an agent must value their freedom and well-being, it follows that agents have a claim right to their freedom and well-being, for it is mutually exclusive to hold both that they must have freedom and well-being and that they may not have freedom and well- being. Given that each agent has a claim right to freedom and well-being, and that agents accept parallel reasoning, agents must accept that other agents also have those rights.
Rather, each spouse walks away from the marriage with his or her individual property. Divorcing Muslim women who did not work outside their home after marriage do not have a claim on the collective wealth of the couple under Islamic law, except for deferred mahr – an amount of money or property the man agrees to pay her before the woman signs the marriage contract.JAMAL NASIR, THE STATUS OF WOMEN UNDER ISLAMIC LAW AND MODERN ISLAMIC LEGISLATION, 3d edition, 2009Sameena Nazir and Leigh Tomppert, Ed., Women's Rights in the Middle East and North Africa, Rowman and Littlefield Publishers, 2005 Quran states In case of husband's death, a portion of his property is inherited by his wives according to a combination of sharia laws. If the man did not leave any children, his wives receive a quarter of the property and the remaining three quarters is shared by the blood relatives of the husband (for example, parents, siblings).
In early 1581, he fled to France carrying with him the Portuguese Crown Jewels, including many valuable diamonds. He was well received by Catherine de' Medici, who pretended to have a claim to the Crown of Portugal. She looked upon him as a convenient instrument to be used against Philip II. By promising to cede the Portuguese colony of Brazil to her and the sale of some of his jewels, António secured support to fit out a fleet manned by Portuguese exiles and French and English adventurers. As the Habsburgs had not yet occupied the Azores, he sailed for them with a number of French adventurers under Philip Strozzi, a Florentine exile in the service of France, but was utterly defeated at sea by the Álvaro de Bazán, 1st Marquis of Santa Cruz at the Battle of Ponta Delgada, off the coast of the island of São Miguel between 25–26 July 1582.

Johnson, p. 221 The pianist and musical scholar Graham Johnson, quoting this, adds that although Berlioz might be thought to have a claim to that title, it was Gounod who brought the mélodie widespread popularity in France: Johnson adds that Gounod brought to the mélodie "those qualities of elegance, ingenuity, sensibilité, and a concern for literature which together constitute the classic qualities of French song" in mélodies that display the composer's "melodic genius, his talent for creating long flowing lines (only surpassed by Fauré), and his instinct for the harmonic juste".Johnson, p. 223 From his earliest period, during and just after his time as a Prix de Rome student, Gounod's songs include some of his best, in the view of both Huebner and Johnson.Johnson, p. 222 Examples include "Où voulez-vous aller?" (words by Gauthier, 1839) – which challenged comparison with Berlioz, who had already set the poem in his Les Nuits d'été – and "Venice" (Musset), 1842, described by Johnson as "astonishingly evocative with its turbulent interludes painting that city's ability both to intoxicate and disturb". Other early songs such as "Le vallon" and "Le soir" (both to words by Lamartine, c.
