The government retaliated by imprisoning him for nearly three years without a trial. On 30 June 1650 he was arrested and confined, first in Dunster Castle and afterwards in Taunton Castle (12 June 1651) and Pendennis Castle (27 June 1651). He was finally offered his liberty on giving security to the amount of £1,000 that he would henceforward do nothing against the government; but, refusing to make any promise, he was released unconditionally on 18 February 1653.

Legge promised not to bear arms against the parliament, and was allowed to compound, and released. Charles II at once despatched him on a mission to Ireland, but he was captured at sea in July 1649, and imprisoned in Exeter Castle on a charge of high treason for two years or more. In March 1653 he was granted a pass to go abroad, on giving security to do nothing prejudicial to the state. On 11 March 1659 he was one of five commissioners empowered by the king to treat with all rebels not actual regicides, and promise pardon in reward for assistance.

The Council of Trent held in Italy between 1545 and 1563 and prompted by the Protestant Reformation, commissioned in the seventh canon () of Session XXIV the first Church-wide catechism of the Catholic Church, later known as the Roman Catechism and also as the Catechism of the Council of Trent. A commission of eminent theologians supervised by three cardinals produced a catechism, which was published in Rome under Papal authority, after the Council had concluded, under the Latin title (in-folio). In its section on the Fifth Commandment, the Roman Catechism teaches that civil authority, having power over life and death as "the legitimate avenger of crime", may commit "lawful slaying" as "an act of paramount obedience to this Commandment which prohibits murder" by giving "security to life by repressing outrage and violence".

John was a party to the Turnberry Bond with his father, Walter Stewart and the Bruces, which was signed at Turnberry Castle on 20 September 1286. With his older brother Alexander, John was involved in the resistance against King Edward I of England and were both captured after the Battle of Dunbar on 27 April 1296. While Alexander was released after swearing fealty, John remained a prisoner at Nottingham Castle in England until August 1297, when Edward released John from prison, on his taking oath and giving security to serve with the king in the campaign of 1297 in Flanders.
