Transparency, like sound or video quality, is subjective. It depends most on the listener's familiarity with digital artifacts, their awareness that artifacts may in fact be present, and to a lesser extent, the compression method, bit-rate used, input characteristics, and the listening/viewing conditions and equipment. Despite this, sometimes general consensus is formed for what compression options "should" provide transparent results for most people on most equipment. Due to the subjectivity and the changing nature of compression, recording, and playback technology, such opinions should be considered only as rough estimates rather than established fact.

Targets for which constant motion is an established fact essentially have zero process noise, and all uncertainties due to changes to the targets’ motion state are modelled by nonzero process noise.
Prodromus achieved immediate popularity and established Kircher's reputation as a scholar. The first enthusiastic response to the work came from Kircher's fellow Jesuit, Melchior Inchofer, who had been appointed as its censor. Normally censors wrote succinct reports with an opinion as to whether a work posed any doctrinal problems, but Inchofer was expansive in his praise, hailing the book as "a worthy beginning from which we may anticipate what will follow." A more critical note was sounded by Kircher's former mentor Peiresc, who complained of his inaccurate transliterations and warned him that presenting theories and conjectures as established fact would damage his reputation.
With the capture of Dali, Muslim supremacy became an established fact in Yunnan. Du Wenxiu was originally not aiming his rebellion at Han, but was anti-Qing and wanted to destroy the Manchu government. During the revolt Hui from provinces which were not in rebellion, like Sichuan and Zhejiang, served as negotiators between rebel Hui and the Qing government. One of Du Wenxiu's banners said "Deprive the Manchu Qing of their Mandate to Rule" (革命滿清), and he called on Han to assist Hui to overthrow the Manchu regime and drive them out of China.
The report found that the tendency of the evidence presented in the programme was to suggest the terrorists had been unlawfully killed, and that it did not explore alternative explanations in any depth. Nevertheless, Windlesham and Rampton believed that the programme presented evidence for one possible explanation, but sought to raise questions rather than reach a conclusion. In analysing the content of the programme, they found that it allowed the witnesses to give their accounts in their own words rather than presenting them as established fact. Thus, they found that the content did not infringe any requirement for neutrality.
1669 report that claims a woman fasted for 12 months Inedia (Latin for 'fasting') or breatharianism is the claimed ability for a person to live without consuming food, and in some cases water. It is considered a deadly pseudoscience by scientists and medical professionals, and several adherents of these practices have died from starvation or dehydration. It is an established fact that humans require food and water (nutrients) to survive. Breatharians claim that food (and sometimes water) is not necessary for survival, and that humans can be sustained solely by prana, the vital life force in Hinduism.
In 1899 J. C. Hawkins took up the question with a careful statistical analysis and argued for Marcan priority without Proto-Mark, and other British scholars soon followed to strengthen the argument, which then received wide acceptance. Many scholars in the twentieth century regarded Marcan priority as no longer just a hypothesis, but an established fact. Still, fresh challenges from B. C. Butler and William R. Farmer proved influential in reviving the rival hypothesis of Matthaean priority, and recent decades have seen scholars less certain about Marcan priority and more eager to explore all the alternatives.
He pointed out that the policy of secret spying was one of mistrust and that the incident had doomed the summit before it even began. He expected the United States and Eisenhower to condemn the spying and pledge to end further reconnaissance missions. At the summit, after Khrushchev had blown Eisenhower's cover, Eisenhower did not deny that the aircraft had been spying on Soviet military installations but contended that the action was not aggressive but defensive. He argued that the current state of international relations was not one in which peaceful coexistence was an already established fact.
Troops under General Nuno Álvares Pereira defeated a small Castilian army at Atoleiros, while John of Castile had to lift a siege to Lisboa, mainly due to a plague that hit his army and killed his wife Beatrice. This was followed, however, by a larger invasion of Castilian and Portuguese troops loyal to John of Castile. The House of Aviz became Portugal's reigning dynasty following the Battle of Aljubarrota in 1385. John of Aviz's rule became established fact with the Portuguese victory in the Battle of Aljubarrota on 14 August 1385, where he defeated John I of Castile.
"Capture of the high ground," the Medal of Honor recommendation stated, "... was essential to the success of the D-Day operations. It is an established fact that had it not been done, it would have constituted a most serious threat to the subsequent operations of the 5th Amphibious Corps." The 3rd Battalion lost more than half its officers and nearly one-half its enlisted strength on D-Day. But by "fearless disregard for his own life" and leading his depleted battalion "by example rather than command," Chambers won the key heights and anchored the right flank of the Marines' position.
Very little research has been done in an attempt to therapeutically target EVI1 or any of its chimeric counterparts. However, since it has become an established fact that overexpression of EVI1 derivatives is a bad prognostic indicator, it is likely that the literature will begin to examine specific targeting within the next few years. One very promising therapeutic agent for myelogenous leukemia and potentially other forms of cancer is arsenic trioxide (ATO). One study has been done showing that ATO treatment leads to specific degradation of the AML1/MDS1/EVI1 oncoprotein and induces both apoptosis and differentiation.
There was some backlash from the Sheridans' criticism. Following Mark's comments in news stories criticizing both Soriano and his report, Raymond Bateman, a former State Senate president and the Republican Party's 1977 gubernatorial candidate, wrote an op-ed piece in the Home News Tribune, Middlesex County's daily newspaper, defending Soriano. Bateman's son Christopher, who had followed his father into the State Senate, had sponsored Soriano's nomination. Bateman took it as an established fact that John Sheridan, whom he knew from his own days in the State Senate, was mentally ill in some way when he died.
The Murnaghan equation of state is a relationship between the volume of a body and the pressure to which it is subjected. This is one of many state equations that have been used in earth sciences and shock physics to model the behavior of matter under conditions of high pressure. It owes its name to Francis D. Murnaghan who proposed it in 1944 to reflect material behavior under a pressure range as wide as possible to reflect an experimentally established fact: the more a solid is compressed, the more difficult it is to compress further. The Murnaghan equation is derived, under certain assumptions, from the equations of continuum mechanics.
Fig. 1 A piece (formed with M KMS-96 alumina powder) has been broken after mold ejection. It is a well-established fact that the performance of a ceramic component critically depends on the manufacturing process. Initial powder characteristics and processing, including cold forming and sintering, have a strong impact on the mechanical properties of the components as they may generate a defect population (microcracks, density gradients, pores, agglomerates) within the green and sintered compounds. The mechanical characteristics of the solid obtained after cold forming (the so- called ‘green body’) strongly affect the subsequent sintering process and thus the mechanical properties of the final piece.
The Volunteers filled the gap left behind, with possibly half of its officers having held commissions in the militia. Historian Thomas Bartlett claims that the purpose of the militia as defined in 1715 would have fitted with the aims of the Volunteers: "of suppressing ... all such insurrections and rebellions, and repelling of invasions". Along with this, Irish Protestants of all ranks had a long, strong tradition of self-defence, having formed groups to resist and pursue agrarian insurgents and keeping a watchful eye on Catholics when threats arose. The Volunteers were independent of the Irish Parliament and Dublin Castle, and this was an established fact by 1779.
Such a theory cannot be supported by the fact that the head and the collar resemble those more of a griffon, as the stylisation dates back to the Medieval times. Conclusive evidence comes from the established fact that an eagle was adopted as a symbol of the Patria del Friuli over a century before the 14th-century flag. Indeed, the eagle symbol was tied to the state of Friuli long before its connection with the patriarch Bertrand. Confirmation of this fact can be seen in the numerous archaeological findings that trace the utilisation of the eagle to Wolfger von Erla who was patriarch of Aquileia from 1204 to 1218.
Royal Supremacy is specifically used to describe the legal sovereignty of the civil laws over the laws of the Church in England. The act declared that the king was "the only supreme head on Earth of the Church of England" and that the Crown shall enjoy "all honours, dignities, preeminences, jurisdictions, privileges, authorities, immunities, profits, and commodities to the said dignity.""Henry VIII's Act of Supremacy (1534)- original text" English History. David Ross and Britain Express The wording of the act made clear that Parliament was not granting the king the title (thereby suggesting that they had the right to withdraw it later); rather, it was acknowledging an established fact.
The relationship between man and woman is indeed at the heart of the play, portrayed as being both deeply flawed on the one hand, yet still affirmed as the basic human relationship. While these interpretations may be up for discussion, the role of Hegelian dialectic in the sequencing of scenes is an established fact. Each scene, each historical period, is the realization of some ideal of Adam (thesis), which Lucifer then exposes as being deeply flawed (antithesis). Adam, on the verge of losing hope, comes into contact with Eve, and decides upon a new ideal (synthesis) which would cure the worst problems of his present reality.
We found the same thing when we compare healthcare in the Boston and New Haven communities served by some of the finest academic medical centers in the world. The basic premise—that medicine was driven by science and by physicians capable of making clinical decisions based on well-established fact and theory—was simply incompatible with the data we saw. It was immediately apparent that suppliers were more important in driving demand than had been previously realized," stated Wennberg.Clamping down on variation - Managed Healthcare Executive "The solution for unwarranted variation in preference-sensitive services is shared decision-making—the active involvement of the patient in choosing.
He justified the placement of Hygrophoropsis in the Paxillaceae largely on fruit body morphology and spore size: "The discovery of a second species, H. tapinia, with smaller spores and an external appearance frankly suggesting Paxillus curtisii but never met with in Clitocybe, makes the affinity between Hygrophoropsis and Paxillus an established fact." In 1975, he added H. olida, a species with inamyloid but cyanophilous spores, whose characteristics otherwise aligned with the type species. Hygrophoropsis is now the type genus of the family Hygrophoropsidaceae, circumscribed by Robert Kühner in 1980 to contain it and the genus Omphalotus. Singer considered this family to be "transient between Tricholomatales and Boletales".
As a village, Aghribs is home to about 2000 people. It is the birthplace of Said Sadi, the co-founder and ex-president of the RCD, the Rassemblement pour la Culture et la Democratie. As of April 2013, the village oldest resident is Mr. Said Ameur, who is 104. Although archives are inexistent, it is a well established fact that Aghribs was founded by a family or families that left the village of Adrar, a village just a few kilometres away. Today, Aghribs’s main families are : Ameur, Ait Lounis, Belkacem, Ait Amara, Ait Yahya, Sadi (or Saadi), Meziani, Laimeche, Tamani, Aider and Ait Aider.
Sign at the entrance to the Dyke The site is a candidate for the strongly defended place where Julius Caesar fought Cassivellaunus in 54 BC, as described in his firsthand account De Bello Gallico. There are other possible locations for the stronghold (for example, Ravensburgh Castle, Hexton) and the historical evidence neither supports nor disproves the claim of the Devils Dyke. The theory that Wheathampstead was attacked by Caesar was supported by Sir Mortimer Wheeler 1932 excavation of the site. The sign at the entrance to the Dyke states that it is the probable place (based on the assertions of Sir Mortimer), which has led to the claim often being repeated as an established fact.
This ritual lasted for one night on the tenth day of the Akitu, the Sumerian new year festival, which was celebrated annually at the spring equinox. As part of the ritual, it was thought that the king would engage in ritualized sexual intercourse with the high priestess of Inanna, who took on the role of the goddess. In the late twentieth century, the historicity of the sacred marriage ritual was treated by scholars as more- or-less an established fact, but in recent years, largely due to the writings of Pirjo Lapinkivi, some scholars have rejected the notion of an actual sex ritual, instead seeing "sacred marriage" as a symbolic rather than a physical union.
He became extensively known by his work, and acquired material prosperity, and his creation of new methods, particularly in the process of extracting gold from ore (the Merrill-Crowe process), brought to him wide fame. It is an established fact that he added to the value of the effective reserve in the ore property of the Homestake mine alone approximately twenty million dollars (1930's dollars). After he achieved his success in South Dakota, Merrill organized the Merrill Company in San Francisco in 1910, for the purpose of exploiting his patents in the cyanide process. He held over 25 patents in the United States and foreign countries relative to metallurgical processes and mining apparatus.
There are several traditions on where the remains of the Magi are located, although none of the traditions is considered as an established fact or even as particularly likely by secular history. Marco Polo claimed that he was shown the three tombs of the Magi at Saveh south of Tehran in the 1270s: Paul William Roberts provides some modern-day corroboration of this possibility in his book Journey of the Magi.Journey of the Magi, Paul William Roberts, (2006) Tauris Parke Paperbacks, pgs 27-38 The Shrine of the Three Kings in Cologne Cathedral, Germany, c. 1200. A Shrine of the Three Kings at Cologne Cathedral, according to tradition, contains the bones of the Three Wise Men.
Medawar presented a talk on viviparity in animals (the phenomenon by which some animals give live birth) at a meeting on evolution at Oxford in July 1952. Later published in 1953, he introduced an aphorism: > Endocrine evolution is not an evolution of hormones but an evolution of the > uses to which they are put; an evolution not, to put it crudely, of chemical > formulae but of reactivities, reaction patterns and tissue competences. The notion that evolution and diversity of endocrine function in animals are due to different uses of each hormone rather than different hormones themselves became an established fact. The paper is also regarded as a pioneer in the field of reproductive immunology.
It is also noted that Adams was induced, by Simon Cock, to answer questions about the region that had stumped Europeans for generations. He had an answer to every question he was asked by the Europeans. Raising more doubt is the manner in which Cock "found" Adams, a then destitute beggar, wandering the streets of London in 1815, and how an illiterate person, who learned nothing from books, knew the exact number of days of his journeys, the precise number of miles he traveled each day, and the precise directions of all his travels on foot. It is notable that it was a well-established fact that no wrecks occurred south of Cape Bajado at that time.
Islam Q & A, 6537: Dreams and dream interpretation, retrieved on Mar 12, 2015 Another example lies in the authenticity of the book "Muntakhabul Kalam ..." which is definitely non- genuine, for the simple reason that it relates those stories that happened long after Sirin's death as already stated. Nevertheless, it is possible that these books were written by another expert or by Ibn Sirin's students and/or admirers. The major suspect is a Muslim preacher by the name of Abu Sa'id Al- Wa'ez, himself author of several books on Islamic oneiromancy. What lends credence and adds weight to the theory that Ibn Sirin never wrote anything is the established fact that he abhorred books.
Maurice A. Finocchiaro, Galileo's Dialogue, Routledge 2014 p.48 The Dialogue is a broad synthesis of Galileo's thinking about physics, planetary movement, how far we can rely on our senses in making judgements about the world, and how we make intelligent use of evidence. It drew together all his findings and recapitulated arguments made in earlier years on specific topics.Maurice A. Finocchiaro, Galileo's Dialogue, Routledge 2014 p.5 For this reason, there is no 'section on sunspots' in the Dialogue. Rather, they are referred to at various points in arguments about other topics. In the Dialogue, that sunspots are on the surface of the Sun and not planets was taken as established fact.
Similarly, the objectivity of news organizations owned by conglomerated corporations fairly may be questioned, in light of the natural incentive for such groups to report news in a manner intended to advance the conglomerate's financial interests. Individuals and organizations who are the subject of news reports may use news management techniques to try to make a favourable impression. Because each individual has a particular point of view, it is recognized that there can be no absolute objectivity in news reporting. Journalists can collectively shift their opinion over what is a controversy up for debate and what is an established fact, as evidenced by homogenization during the 2000s of news coverage of climate change.
Secular works produced for secular patrons often show military themes, for example in illuminated manuscript copies of histories like the 15th century Froissart of Louis of Gruuthuse (BnF Fr 2643-6), where most of the 112 miniatures show military scenes. The Siege of the Castle of Love, often found on Gothic ivory mirror-cases, showed knights attacking a castle defended by ladies, a metaphor from the literature of courtly love. The 11th century Bayeux Tapestry is a linear panoramic narrative of the events surrounding the Norman Conquest and the Battle of Hastings in 1066,UNESCO , Bayeaux tapestry, Nomination Form, p. 4; excerpt,"... it is an established fact that it recounts a military triumph: the conquest of England by William the Conqueror"; Nomination Form, pp.
Compton dates this marriage to March or April 1833, well before Joseph was accused of an affair. However, historian Lawrence Foster dismisses the marriage of Alger to Joseph Smith as "debatable supposition" rather than "established fact.""Review of Todd Compton, In Sacred Loneliness: The Plural Wives of Joseph Smith" , Dialogue: A Journal of Mormon Thought 33 (Spring 2001): 184–86 Others conclude that many Latter-day Saints entered into plural marriage based on the belief that it was a religious commandment, rather than as an excuse for sexual license. For instance, many of the figures who came to be best associated with plural marriage, including church president Brigham Young and his counselor Heber C. Kimball, expressed revulsion at the system when it was first introduced to them.
The king would then partake in a "sacred marriage" ceremony, during which he engaged in ritual sexual intercourse with the high priestess of Inanna, who took on the role of the goddess. In the late twentieth century, the historicity of the sacred marriage ritual was treated by scholars as more-or-less an established fact, but, largely due to the writings of Pirjo Lapinkivi, many have begun to regard the sacred marriage as a literary invention rather than an actual ritual. The cult of Ishtar was long thought to have involved sacred prostitution, but this is now rejected among many scholars. Hierodules known as ishtaritum are reported to have worked in Ishtar's temples, but it is unclear if such priestesses actually performed any sex acts and several modern scholars have argued that they did not.
It has sometimes been suggested that Chevening served Jane Austen as a model for Rosings Park in her novel Pride and Prejudice, but the only established fact that links the novelist with Chevening is that the Revd John Austen, her second cousin and grandson of the solicitor Francis Austen, who lived in the Red House, Sevenoaks, became Rector of Chevening in 1813, the novel having been published in that January. However, it was written from October 1796 to August 1797. John Halperin also relates that Francis Austen, an uncle of Jane Austen's father, was solicitor to the owners of Chevening during the latter third of the 18th century; that Francis Austen owned property in the area, and that Jane Austen visited him and relatives in Kent several times between 1792 and 1796.
In a three-part series on the XYY syndrome published in April 1968, The New York Times presented Jacobs' unsubstantiated theory associating the syndrome with violent behavior as an established fact, and noted that the karyotype had been cited as a mitigating factor by attorneys defending an XYY man charged with murder in Paris, and another in Melbourne. It also identified Speck as a "classic example" of an "XYY criminal" and citing Telfer and Getty as sources, predicted that XYY syndrome would form the crux of his insanity defense. Similar articles followed, again citing Telfer, in Time and Newsweek, and six months later in The New York Times Magazine. In May 1968, Speck's chromosomes were karyotyped a second time by Engel, with the same result: a normal 46,XY genome.
A forerunner of the term was what Jack Wennberg called unwarranted variation, different rates of treatments based upon where people lived, not clinical rationale. He had discovered that in studies that began in 1967 and were published in the 1970s and the 1980s: "The basic premise – that medicine was driven by science and by physicians capable of making clinical decisions based on well-established fact and theory – was simply incompatible with the data we saw. It was immediately apparent that suppliers were more important in driving demand than had been previously realized."Michael T. McCue Clamping down on variation – Managed Healthcare Executive, February 01, 2003 In 2008, US bioethicist Ezekiel J. Emanuel and health economist Victor R. Fuchs defined unnecessary health care as "overutilization", health care provided with a higher volume or cost than is appropriate.
These texts bear witness to the private custom of saying a prayer before retiring to rest. If this was not the canonical hour of compline, it was certainly a preliminary step towards it. The same writers reject the opinion of Paulin Ladeuze and Dom Besse who believe that compline had a place in the Rule of St. Pachomius, which would mean that it originated still earlier in the 4th century. It might be possible to reconcile these different sentiments by stating that if it be an established fact that St. Basil instituted and organized the hour of compline for the East, as St. Benedict did for the West, there existed as early as the days of St. Cyprian and Clement of Alexandria the custom of reciting a prayer before sleep, in which practice we find the most remote origin of our compline.
This, the earliest portrait of Washington, was painted in 1772 by Charles Willson Peale, and shows Washington in uniform as colonel of the Virginia Regiment. The original hangs in Lee Chapel at Washington and Lee University in Lexington, Virginia This 1866 engraving depicts Washington praying at Valley Forge. In 1918, the Valley Forge Park Commission declined to erect a monument to the prayer because they could find no evidence that the event had occurred. In 1945, an article was published by the Valley Forge Historical Society in which the writer presents the accounts of the purported incident and, while acknowledging the second hand records of the tradition "lack ... the authentication with which the historian seeks to monument his recordings in all the solemnity of established fact," rhetorically asks if it is unreasonable to believe the event might have occurred.
Aristotle suggested instead that the (nonphysical) form-giving principle of an organism was transmitted through semen (which he considered to be a purified form of blood) and the mother's menstrual blood, which interacted in the womb to direct an organism's early development. For both Hippocrates and Aristotle—and nearly all Western scholars through to the late 19th century—the inheritance of acquired characters was a supposedly well-established fact that any adequate theory of heredity had to explain. At the same time, individual species were taken to have a fixed essence; such inherited changes were merely superficial.Mayr, The Growth of Biological Thought, pp 635–640 The Athenian philosopher Epicurus observed families and proposed the contribution of both males and females of hereditary characters ("sperm atoms"), noticed dominant and recessive types of inheritance and described segregation and independent assortment of "sperm atoms".
The first mention of the language spoken on the Bantayan islands seems to be from the Spanish historian and Jesuit missionary Ignacio Alcina, who wrote in 1668, > "Finally, it could have happened that people from various larger or smaller > islands passed over to the others, as is an established fact among them. For > instance, those on the Island of Bantayan, which is near Cebu, are actually > descendants of the people living on Samar Island and on the western side or > opposite that of Ibabao. Today, they admit that they are related by blood > due to the fact that the latter were populated in more recent times." > (translation by editors) The substratum of Bantayanon is that Old Waray dialect that moved across Bantayan and eventually onto Panay Island, and later Bantayanon was heavily influenced in its lexicon by Cebuano.
Banerjea, 1966, page 20 According to an opinion of some scholars in Patanjali's time identification of Krishna with Vasudeva is an established fact as is surmised from a passage of the Mahabhasya – (jaghana kamsam kila vasudevah).A Corpus of Indian Studies: Essays in Honour of Professor Gaurinath Sastri, Page 150, 1980 – 416 pages. This "supposed earliest phase is thought to have been established from the sixth to the fifth centuries BCE at the time of Pāṇini, who in his Astadhyayi explained the word vasudevaka as a bhakta, devotee, of Vasudeva and its believed that Bhagavata religion with the worship od Vasudeva Krishna were at the root of the Vaishnavism in Indian history."Page 76 of 386 pages: The Bhagavata religion with the worship of Vasudeva Krishna as the ... of Vasudeva Krishna and they are the direct forerunners of Vaisnavism in India.
One contemporary newspaper led its account of the event with the headline "Britain is no longer an island", and the flight caused a reassessment of Britain's strategic reliance on the Navy for defence. Blériot became world-famous, and the publicity resulted in over a hundred orders for copies of his design within a few weeks. Wright Biplane flies in front of the grandstand at the Grande Semaine d'Aviation held in Reims in 1909 The year also saw the Grande Semaine d'Aviation de la Champagne at Rheims, attended by half a million people, including Armand Fallières, the President of France; the King of Belgium and senior British political figures including David Lloyd George, who afterwards commented "Flying machines are no longer toys and dreams; they are an established fact"Gibbs-Smith 2003 p.175 A second aircraft exhibition held in October at the Grand Palais in Paris attracted 100,000 visitors.
If by this is meant that a railroad > may in some instances carry freight at or below actual cost, the truth of > the statement may be conceded, but before arriving at a conclusion that such > is the fact it is necessary to know what the cost is. And furthermore they cited Whitmore about the uncertainties in cost accounting, and how to deal with it: > It should be unnecessary to point out that if cost accounting can be > successfully applied to the varying business activities in connection with > which it is now an established fact, it can with equal success be applied to > railroad accounts. No one pretends that in any case the showing is correct > to the utmost degree of mathematical accuracy; that the accounts are not > balanced with the accuracy of an engineer's instrument or of the scales > which register the weight of a hair will be admitted by all. > Mr. John Whitmore in an article on “Factory accounting as applied to machine > shops,” vol.
Finally, it claimed that a burial mound "forty feet high and four hundred feet in circumference" near Gasparilla Island had been found to contain "ornaments of gold and silver" along with "hundreds of human skeletons", but that the bulk of the buccaneer's vast cache of buried treasure "still lies unmoved" nearby, in the vicinity of the Gasparilla Inn. Though the brochure presents its history of the pirate Gaspar as established fact, there is no evidence to support the story. For example, local place names supposedly inspired by José Gaspar appeared on maps drawn long before the pirate was said to have arrived in the area, with historical documents stating that Gasparilla Island was named for Friar Gaspar, a Spanish missionary who visited the native Calusa in the 1600s. It claimed that the nickname "Gasparilla" means "Gaspar, the outlaw" in Spanish when it is actually a feminine diminuation meaning "little Gaspar", an unlikely moniker for a bloodthirsty buccaneer.
Following Albeck's challenge, four prominent German rabbis (David Zvi Hoffmann, Abraham Berliner, Jacob Schor and Hanokh Ehrentreu) wrote a booklet published in Berlin in 1910 containing a defense of Auerbach named Tzidkat HaTzaddik – (literally "the righteousness of the saint"). Albeck did not leave this response unanswered and published a further booklet named Kofer HaEshkol – (literally "the denial of the Eshkol") (Warsaw, 1911), in which he explained his reasons for declaring the work a forgery. Although a further defense of Auerbach was written as late as 1974 by Bernard Bergman in an essay in the Joshua Finkel Festschrift (New York, 1974), it can be fairly said that Albeck's arguments became accepted and the dubious nature of Auerbach's "Eshkol" is now considered an established fact in academic circles as well as many rabbinic ones. Neither Rabbi Auerbach or his heirs ever produced the original manuscript from which he worked to transcribe his "Eshkol" and no reasonable explanations have ever been given for the discrepancies in the work.
3 of art. 365 of the Criminal Code of Ukraine were forwarded to court under supervision of Renat Kuzmin. Renat Kuzmin initiated criminal proceedings against former President of Ukraine Leonid Kuchma according to the fact of exceeding authority and official powers that caused grave consequences for the protected by law rights and interests of citizens H.R. Gongadze and O.I. Podolskyi under p. 3 of art. 166 of the Criminal Code of Ukraine (in edition of the Criminal Code of Ukraine of 1960). Renat Kuzmin supervised the pre- trial investigation into the criminal case of criminal activity of Serhiy Tkach who committed a number of premeditated killings and attempted murders combined with raping of women, underage and minor girls in 1984–2005, for which 8 persons were illegally convicted as the investigation found out. The investigation of newly found circumstances was conducted according to every established fact of illegal conviction of persons in given case and in 2008-2010 the courts repealed the judgments concerning illegal conviction.
Her origins are rather obscure and the data on her birth are very dubious: she is thought to have been born in Crema, Lombardy, but some sources say she may have been born in Monticelli d'Ongina, a village in the province of Piacenza, which is located nearer to Cremona, in 1756This is Carr's version; according to Caruselli editor's encyclopaedia (I, p. 97) and to the Concise Oxford Dictionary of Opera, the correct data are the ones reported in the present article, whereas Staccioli and Genesi date her birth at Monticelli d'Ongina back to 1755. or possibly in 1758. She is the daughter of Carlo Giorgi, a street mandolin player; she too started her career as a street singer, either following her father around, or, according to different accounts, joining in with the double-bassist Domenico Dragonetti, when he was still a boy.. The only established fact is that, in 1777–1778, on her travels around southern Europe, she reached Paris where a meeting with an important person in the profession completely was to change her life.
The IHR refused to pay the reward, stating that Mermelstein's notarized account was "not sufficient proof". Represented by public interest attorney William John Cox, Mermelstein subsequently sued the IHR in the Superior Court of Los Angeles County for breach of contract, anticipatory repudiation, libel, injurious denial of established fact, intentional infliction of emotional distress, and declaratory relief (see case no. C 356 542). On October 9, 1981, both parties in the Mermelstein case filed motions for summary judgment in consideration of which Judge Thomas T. Johnson of the Superior Court of Los Angeles County took "judicial notice of the fact that Jews were gassed to death at the Auschwitz Concentration Camp in Poland during the summer of 1944," judicial notice meaning that the court treated the gas chambers as common knowledge, and therefore did not require evidence that the gas chambers existed. On August 5, 1985, Judge Robert A. Wenke entered a judgment based upon the Stipulation for Entry of Judgment agreed upon by the parties on July 22, 1985.
