GlaxoSmithKline and Pfizer plan to merge their consumer-health divisions in a joint venture that the companies said would be the world's largest maker of over-the-counter products like pain relievers, toothpastes, cold treatments, vitamins and dietary supplements.
WASHINGTON, Feb 24 (Reuters) - The U.S. Senate voted overwhelmingly on Wednesday to confirm Dr. Robert Califf as head of the Food and Drug Administration, an agency that regulates everything from food and drugs to tobacco, cosmetics and dietary supplements.
Because Uqora's products are dietary supplements and not drugs, these claims fall into a legal and ethical gray area: Bold claims like that are meant to be reserved for drugs that have been FDA-approved, which Uqora's products haven't.
The results offer a glimpse into the loosely regulated field of dietary supplements, and a case study of how businesses are capitalizing on efforts by addicts eager to break their habits amid what has become a national opioid epidemic.
"Because Uqora's products are dietary supplements and not drugs, these claims fall into a legal and ethical gray area: Bold claims like that are meant to be reserved for drugs that have been FDA-approved, which Uqora's products haven't," Watson explained.
The company, which makes treatments against skin diseases, insect bites and hair loss, as well as allergy drugs and dietary supplements, is expected to post earnings before interest, taxes, depreciation and amortization of more than 100 million euros this year.
It argues that, despite the company labeling its products as dietary supplements (which are not regulated by the FDA), what they've really done is introduce unapproved new drugs into the marketplace and promote the products as alternatives to recreational drugs.

The CBD wellness industry is suffering from the same hype and lack of regulation as the supplements industry (a lack of regulation that leads to "dietary supplements" including dangerous simulants.) When contacted for comment about the specific posts on Anxiety Hack and Whimsy Soul, Michelle Alfaro of Covet PR, a public-relations representative responding on behalf of Sunday Scaries, pointed out that dietary supplements are legally allowed to make claims around "structure/function," which is true.
CBD oils, creams, foods and beverages have seen an explosion in availability following the passage of the 2018 Farm Bill, which legalized hemp but left plenty of discretion to the US Food and Drug Administration, which regulates pharmaceutical drugs, most food items, additives and dietary supplements.
The FDA isn't interested in immediately doing away with that restriction, because both "CBD and THC are active ingredients in FDA-approved drugs and were the subject of substantial clinical investigations before they were marketed as foods or dietary supplements," Gottlieb said in a statement in December.
"When hemp was removed as a controlled substance, this lack of research, and therefore evidence, to support CBD's broader use in FDA-regulated products, including in foods and dietary supplements, has resulted in unique complexities for its regulation, including many unanswered questions related to its safety," he said.
The FDA is committed to doing everything within its resources and authorities to identify and remove unsafe products from the market, and we continue to work collaboratively with all of our stakeholders to help ensure that products marketed as dietary supplements are safe, well-manufactured, and accurately labeled.
The Oregon Democrats asked the agency to clarify to the public several issues, including its authority in the production and marketing of hemp and its derivatives, and whether the FDA will consider issuing a regulation to allow hemp derivatives in food, beverages or dietary supplements that cross state lines.
"It is within the scope of the FDA to require manufacturers and distributors of dietary supplements to recall products that pose an imminent public health concern or safety issue," Oliver Grundmann, clinical associate professor of medicinal chemistry at the University of Florida in Gainesville, told BuzzFeed News by email.
"When hemp was removed as a controlled substance, this lack of research, and therefore evidence, to support CBD's broader use in FDA-regulated products, including in foods and dietary supplements, has resulted in unique complexities for its regulation, including many unanswered questions related to its safety," Sharpless said.
"The drug ingredients in these dietary supplements have the potential to cause serious adverse health effects owing to accidental misuse, overuse, or interaction with other medications, underlying health conditions, or other pharmaceuticals within the supplement," researchers from the California Department of Food and Agriculture, Sacramento, explain in their paper.

Take away the shiny packaging and celebrity endorsers, though, and you're left with products plagued by the same problems as dietary supplements: There's no good evidence that they can deliver on the results they promise, and a lack of government oversight and clear standards puts consumers at risk.
"There are real risks associated with [THC and CBD] and critical questions remain about the safety of their widespread use in foods and dietary supplements, as well as other consumer products — including cosmetics, which are subject to a separate regulatory framework," Sharpless said, according to a transcript of his prepared remarks.
The dietary supplements that are the backbone of wellness make up a $30 billion a year business despite studies showing they have no value for longevity (only a few vitamins have proven medical benefits, like folic acid before and during pregnancy and vitamin D for older people at risk of falling).
Collagen supplements are also marketed to athletes, but "there's no evidence to show that taking collagen protein improves your ability to rebuild or heal," said Stuart Phillips, professor of kinesiology at McMaster University in Ontario, Canada, and an author of a recent International Olympic Committee consensus statement on dietary supplements.
"Unfortunately, unscrupulous vendors are trying to capitalize on the opioid epidemic by illegally marketing products as dietary supplements, with unproven claims about their ability to help in the treatment of opioid use disorder, or as all-natural alternatives to prescription opioids," said Theresa Eisenman, a spokeswoman for the drug agency.
"But with the observational studies — especially when you're dealing with dietary supplements and diet — taking supplements is also associated with many other confounding factors that predict the outcome: being wealthier, being health-conscious, having health insurance and access to the health care system, low smoking prevalence, increased physical exercise," said Kramer.
"Despite multiple actions against these products in the past, we've seen a continued trend of products containing highly concentrated or pure caffeine being marketed directly to consumers as dietary supplements and sold in bulk quantities, with up to thousands of recommended servings per container," FDA Commissioner Scott Gottlieb said in a statement.
"One thing to keep in mind is that our bodies can store vitamin D in the liver and fat tissues, so there are ample opportunities to make vitamin D in spring, summer and fall," said Carol Haggans, a registered dietitian and spokeswoman for the National Institutes of Health Office of Dietary Supplements.
Under the law and Food and Drug Administration (FDA) regulations, dietary supplements that make certain claims about what their products do must include a disclaimer that the product is not intended to "diagnose, treat, cure or prevent any disease," because "only a drug can legally make such a claim," according to the FDA.
In February the FDA posted 12 warning letters and five online advisory letters to overseas and domestic companies that are illegally selling nearly 60 products — many sold as dietary supplements — that are unapproved new drugs or misbranded drugs that claim to prevent, treat or cure Alzheimer's and other serious diseases and health conditions.
"This research further shows that despite extensive sales and use of different dietary supplements, there is a lack of scientific evidence supporting the use of many supplements," said Dr. Bruce Y. Lee, an associate professor of international health at the Johns Hopkins Bloomberg School of Public Health, who was not involved in the research.
Meyer says the the FDA is well aware of these teatox companies, and Federal Trade Commission attorney Michael Ostheimer says that 21 cases involving dietary supplements were brought by the FTC over the last few years, though he would not disclose any further information, including how many of those cases related to teatoxes specifically.
According to Natural Medicines, a database that provides monographs for dietary supplements, herbal medicines, and complementary and integrative therapies, while some clinical evidence shows that curcumin might be beneficial for depression, hay fever, hyperlipidemia, ulcerative colitis, osteoarthritis and nonalcoholic fatty liver disease, it's still too early to recommend the compound for any of these conditions.
At those levels, "you're giving it in doses that could not possibly be obtained from food without extraordinary effort or special selection, so this is kind of using it as somewhat of a drug," said Dr. Paul Thomas, a registered dietitian and scientific consultant at the National Institutes of Health's Office of Dietary Supplements.

"While the Agency continues to believe that the drug approval process is the best way to ensure the safety of new drugs, including those made with CBD, the Agency is committed to evaluating the regulatory frameworks for non-drug uses, including products marketed as foods and dietary supplements," FDA officials wrote in a June 19 blog post.
"It's critical that we address these unanswered questions about CBD and other cannabis and cannabis-derived products to help inform the FDA's regulatory oversight of these products — especially as the agency considers whether it could be appropriate to exercise its authority to allow the use of CBD in dietary supplements and other foods," Gottlieb said in a statement Tuesday.
The Office of Dietary Supplements says that "most people in the United States get enough vitamin B12 from the foods they eat" although anywhere from 23 percent to 15 percent of the population could be suffering from a vitamin deficiency, mainly due to conditions such as aging that prevent the body from absorbing B12 from food.
Again using data from the National Health and Nutrititon Examination Survey of 2007-10 that included 11,703 adults, Regan L. Bailey of the National Institutes of Health Office of Dietary Supplements and co-authors reported in 2013 these reasons given by the survey participants: 45 percent said they took them to "improve" and 33 percent to "maintain" overall health.
While many scientists would disagree with that conclusion, vitamins and other dietary supplements are a $30 billion industry in the US. Though supplements are popular among all age groups, they are most popular among older demographics — 78 percent of adults older than 55 take vitamin supplements, and about 29 percent of them take four or more.
However, critics note that supplements are largely unregulated, leading to potentially dangerous health risks to unknowing consumers: Indeed, according to a 2015 study published in the New England Journal of Medicine, injuries caused by dietary supplements lead to over 20,000 emergency room visits in the US per year—many of them related to cardiovascular issues, as was the case with Penney.
"The negative recommendation, advocating that people do not use vitamin or dietary supplements (unless they are needed for a clinical problem) is welcome, and it is to be hoped that it saves lots of people from wasting their money," said professor Tom Dening, director of the Centre for Old Age and Dementia, Institute of Mental Health at the University of Nottingham.
" When I asked Uqora about how it can make claims that are directly contradictory to the FDA disclaimer printed at the bottom of their site, co-founder Spencer Gordon told me that "dietary supplements sit in sort of a gray area between two regulatory bodies, the FDA and the FTC," with "the FDA regulating product packaging and labeling, specifically, and the FTC regulating actual marketing claims.
"I don't think a marketplace would be good for us, but I admire the business so much," she tells CNBC Make It.
