Rawlins, Grant's attorney and Asst. Adjt. Gen., strongly warned Grant not to issue the order. Grant refused to take Rawlin's advise concerning the order and told him: "Well, they can countermand this from Washington if they like, but we will issue it anyhow." The controversial order was revoked by President Abraham Lincoln.

Succeeding Henry G. Staples as major were Adjt. Burt and Capt. William C. Morgan. Of the original companies of the regiment Co. A (Bath City Greys) had existed under former militia laws and the others were new organizations. The regiment was mustered into the United States service on June 4, 1861, and left the state for the front the next day.

Cotter was born in Valletta, Malta, the second of three children born to John Cotter (1823–1882) and his first wife Jane Maria née Hickey (1830–1857). John Cotter was a career soldier who had enlisted in the 3rd Foot 'The Buffs' aged 17 in 1840. At the time of Edmond's birth, John Cotter was a sergeant. During the Crimean War (1853–1856), he was promoted to Colour Sergeant and Acting Adjt.

This regiment was composed principally of the hardy lumbermen of the Penobscot Valley and the eastern portion of the state, who were quick to respond to the first call to arms. Before its organization it was made up of two battalions of five companies each, rendezvousing respectively at the state arsenal, Bangor, and Fort Sullivan, Eastport. Under a general order from Adjt.-Gen. Hodsdon, June 28, 1861, both battalions were removed to Portland and organized into a regiment for active service. On July 12-15, 1861, it was mustered into the service of the United States and on the 17th left for Washington.
