The explosions devastated the town of San Juan Ixhuatepec, and resulted in 500-600 deaths and 7,000 people with severe injuries. The subrogration right of the bond surety against the contractor (i.e., the right to sue for indemnification) is a deterrent to non-performance.

Stein was from an old Franconian family. He was born on the family estate near Nassau, studied at Göttingen, and entered the civil service.

Part of the Florida SunRail project involved the purchase of tracks owned by CSX Transportation. The $1.2 billion bill was written by FDOT with major input from CSX, and a major issue involved liability and indemnification for incidents on Amtrak trains operating on tracks owned by SunRail. Months before the issue came to a vote, Florida Senator Paula Dockery, an opponent of the legislation, made a public records request for all emails to and from the FDOT concerning SunRail, CSX and Amtrak. After a long delay, the FDOT responded that no emails had the subject lines "rail," "SunRail" or "CSX".
On October 29, 2009, BVU received US$3.5 million in grant funding from the Virginia Tobacco Indemnification and Community Revitalization Commission. On 1 May 1865, at the opening ceremonies for the Ringstraße, the Emperor declared that he would present the Kaiserbrunnen to the city as a gift. The Ministry of Finance, however, made demands for indemnification and negotiations ensued. A decision on 29 November 1867 was followed by another audience with the Emperor, followed by more negotiations, which led to a contract being signed on 6 March 1868.

Time Warner Cable later began carrying Al Jazeera America in December 2013. In August 2014, Gore and fellow shareholder Joel Hyatt launched a lawsuit against Al Jazeera claiming a residual payment of $65 million of the sale proceeds, due in 2014, remained unpaid. Ravenscroft was born in 1772 on his family plantation near Petersburg in Prince George County, Virginia, to parents (physician John Ravenscroft and the former Lilias Miller) who were both descendants of the powerful Colonel Robert Bolling. Because their Loyalist sympathies made the political situation unstable, when John was an infant his family moved to Scotland, where he received his earliest education. Upon his father's death in 1788, Ravenscroft returned to Virginia to manage the family lands, as well as pursue their Loyalist indemnification claims. The Rebellion Losses Bill (full name: An Act to provide for the Indemnification of Parties in Lower Canada whose Property was destroyed during the Rebellion in the years 1837 and 1838) was a controversial law enacted by the legislature of the Province of Canada in 1849. Its passage and subsequent assent by the Governor General, James Bruce, 8th Earl of Elgin makes the bill a landmark piece of legislation in Canadian political history. The bill was enacted to compensate Lower Canadians who lost property during the Rebellions of 1837 with measures similar to those providing compensation in Upper Canada. Two factors made this measure controversial.
As cars become more interconnected and autonomous, the potential for hacking a car system to acquire data and cause harm poses a serious risk. For manufacturers and developers of autonomous technology, liability exposures arise from the collection and storage of data and personal information in the vehicle and the cloud. Currently, manufacturers require indemnification from vendors and subcontractors (dealerships, repair/installation facilities, etc.), and this practice will likely be extended to autonomous technology developers. Transportation systems are vital for the autonomous vehicle as they serve as the commander, and with multiple autonomous vehicles systems used to increase efficiency, the risk of exposure to malicious attacks will dramatically increase.

The investigative committee formed by Mayor Lyman had recommended that the city of Charlestown or the county of Middlesex indemnify the diocese of Boston for the loss of the convent property; or, if they did not act, that the Massachusetts legislature investigate the matter and provide compensation. Roughly 15% of the Sabres' business comes from residents of the area of Ontario between Hamilton and Buffalo, and the Sabres or the Leafs could require "an enormous indemnification payment" to allow an additional team to be established within a 50-mile radius. An unnamed bidder made a bid for the Sabres in February 2011, offering $259 million for the team to move it out of Buffalo, which would either mean the team would relocate to Hamilton or it would clear the way for another team to make such a move. Oosterdijk was a commercial cargo ship, with limited passenger accommodation, built as Irvine's Shipbuilding and Dry Docks Company Ltd.'s Yard No.522 at Middleton, West Hartlepool, England for Holland America Line (NV Nederlandsch- Amerikaansche Stoomvaart-Maatschappij - NASM) of Rotterdam. Launched on 21 February 1913, she entered service in May 1913. On 20 March 1918, President Woodrow Wilson signed a proclamation declaring the American seizure of neutral ships under the right of angary — which in wartime allowed a belligerent power to use the property of a neutral country subject to full indemnification — and at Baltimore, Maryland, that day Oosterdijk became one of the first Dutch vessels so seized.
For AHPs that solely offer health insurance coverage, or provide additional non-coverage benefits, reserves are to be established and maintained. These reserves must be sufficient for unearned contributions, for benefit liabilities which have been incurred, have not been satisfied, for which risk of loss has not yet been transferred, for administrative costs with respect to such liabilities, for any other plan obligations, and for fluctuations and a margin of error. Each plan must establish and maintain excess/stop loss insurance, and indemnification insurance for any claims the plan is unable to satisfy because of plan termination. For coverage plans that have additional benefits, a minimum reserve surplus of $500,000 to $2,000,000 must be established.
However, adoption of RPKI remains at an impasse largely due to legal factors. This project supports an independent assessment of the proper allocation of liability for uses of RPKI by related parties, such as network operators, that can serve as the basis for the parties to discuss resolving the impasse over the indemnification clauses in the Relaying Party Agreement (RPA). If those discussions are successful, the research will ultimately promote more widespread use of RPKI in North America and enable a more secure Internet. If the project is insured to the extent of the reported values, and that value was left out to compute the premium, the company may decline that cost in the indemnification. Soft costs differ from hard costs in both labor and materials; they are generally not considered to be exclusively related to physical construction. The Dutch ambassador in France, Schimmelpenninck, who acted as the Dutch plenipotentiary, vainly protested that the Treaty of The Hague had guaranteed the Dutch colonies, and that France had promised not to make a separate peace. After this separate peace had been concluded, the British were left to negotiate with the minor French allies separately. This did not mean that the Dutch were completely left to their own devices: whenever French interests seemed to be in danger, France decisively intervened on its own behalf, as in the attempt to deduct the value of the Dutch fleet, surrendered in 1799, that the British had purchased from the Stadtholder, from the indemnification of the Prince of Orange.Schama, pp. 437–438.
The event increased the tension between Greece and Turkey when the Turkish Consul in Komotini was declared "persona non grata" and expelled from the country for having referred to the minority as "our kinsmen" in a letter he wrote to Greek authorities demanding the indemnification of damaged shops. Turkey retaliated by expelling the Greek Consul in Istanbul. When a group from Synaspismos (Coalition of the Left) led by Maria Damanaki a member of Greek parliament visited the destroyed shops of the city two days after the events, they were verbally attacked by some Greek nationalists. Outside of the United States and Canada, liability insurers generally do not assume a duty to defend, in the sense of assuming a direct responsibility for hiring and paying a lawyer to defend the insured. Many write policies which promise to reimburse the insured for reasonable defense costs incurred with the insurer's consent, but this is essentially a form of indemnification (covered in the next section below), under which the insured remains primarily responsible for hiring a lawyer to defend themselves. Such insurers often expressly reserve a right to defend the insured, presumably so they can intervene to protect their own interests if the insured's counsel of choice is not providing an adequate defense against the underlying claim.
Hazen served in the Battle of Quebec, and was one of two men (the other was Edward Antill) sent to report the devastating loss to the Second Continental Congress in Philadelphia. The Congress, in recognition for his efforts, gave Hazen a commission as a colonel, leading the Continental Army's 2nd Canadian Regiment. (Antill was commissioned the regiment's lieutenant colonel.) The regiment was often referred to as "Hazen's" or "Congress' Own", the latter because the regiment was established by Congress and was not part of any state quotas. Hazen was initially offered a position as brigadier general, but he refused, requesting instead a colonel's commission, and indemnification against losses caused by the conflict.
In response, the Guard was disbanded. Pamphlets continued to be proliferated, which included accusations in September that Charles, on a trip to the northern départments, was holed up in Saint-Omer, was colluding with the Pope and planned to reinstate the tithe, and had suspended the Charter under the protection of a loyal garrison army. Tekere was represented by Louis Blom-Cooper QC, a flamboyant English counsel, and there were many confrontations between him and the presiding judge. The court was unanimous that Tekere was guilty of murder. However, by a majority, it found that as he had acted in "good faith" at the time, he was entitled to indemnification under a law that Ian Smith, the previous Rhodesian Prime Minister, had ironically enacted despite widespread opposition to protect his security forces during the Bush War. Any member of the country's security forces was exempt from conviction in respect of any crime committed if, at the time of commission, such member was acting in "good faith", acting in terms of a genuinely held conviction that the State's security interests were being served.
Paullin, p. 435 Previously named Indien, she was chartered from the Chevalier de Luxembourg for a three-year period. The charter agreement provided that prize money was to be divided between the officers and crew (½), South Carolina (¼), and the Chevalier Luxembourg (¼). On her way from Europe to South Carolina she captured several prizes, and she participated in the 1782 capturing of the Bahamas with the Spanish fleet. She was captured in December 1782, and the financial terms Gillon agreed to concerning prize distribution and indemnification of the Chevalier de Luxembourg for its loss bedeviled the state's finances for years. Additionally, the Navy included frigates, Rattlesnake, Bricole, and Truite (26), the brigs Notre Dame (16), and Comet; also General Moultrie (20).

When World War I broke out, Stinnes secured an enormous share in the war profits which enlarged the fortunes of the great industrialists. In enemy countries, his enterprises were sequestrated, and his firm at Rotterdam placed on the Allies' "black list". But, apart from the regular indemnification paid by the German government, he was richly compensated when he was called in by Erich Ludendorff as the most competent expert to give advice, to organize the coal and the industrial production of occupied Belgium and to help to set in motion the gigantic production of war material which the German general headquarters demanded.

Due to indemnification of nuclear contractors, without some form of settlement being arrived at between the U.S. Justice Department and Rockwell, the cost of paying any civil penalties would ultimately have been borne by U.S. taxpayers. While any criminal penalties allotted to Rockwell would not have been covered, for its part Rockwell claimed that the Department of Energy had specifically exempted them from most environmental laws, including hazardous waste. Regardless, and as forewarned by the prosecuting U.S. Attorney, Ken Fimberg/Scott,Prosecuting U.S. attorney Fimberg changed his last name to Scott after the Rocky Flats deliberations were finalized; see The Ambushed Grand Jury, page 118. the Department of Justice's stated findings and plea agreement with Rockwell were heavily contested by its own, 23-member special grand jury.

The company has been in talks with Banro, a Canadian gold mining company, to form a joint venture to develop mines and the supporting electricity supply in the Democratic Republic of Congo. Preliminary talks between the miners were reported in April 2011 when the companies signed a non-binding memorandum of understanding (MOU). China Gold made a bid at the end of 2012 for the Tanzania operations of Barrick Gold in a deal that would have exceed $2 billion. However the deal didn't go through because of disagreements that included the sharing of surprise tax increases levied by Tanzania to take advantage of the capital gains bonanza from a successful deal and indemnification for a past violent episodes between Barrick and villagers.

Haiti was required to pay an indemnity of 150,000,000 francs to France in order to atone for the loss suffered by the French slave owners. In Peru, Antonio Salinas y Castañeda (1810–1874), a wealthy Peruvian landowner and conservative politician, led the meeting of the main landowners of the country for an indemnity after slavery abolition and ruled the commission who promoted the immigration of Asians to replace former slaves as a workforce during Ramón Castilla government.
The bases of the new rule as indicated by the Supreme Court are two: 1) If an enterprise is permitted to carry on any hazardous or inherently dangerous activity for its profit, the law must presume that such permission is conditional on the enterprise absorbing the cost of any accident (including indemnification of all those who suffer harm in the accident) arising on account of such hazardous or inherently dangerous activity as an appropriate item of its overheads; and 2) The enterprise alone has the resource to discover and guard against hazards or danger and to provide warning against potential hazards. The Spanish Ambassador to the United States Luis de Onís y Gonzalez-Vara submitted on 2 November to the United States Secretary of State a protest and request for indemnification for the seizure of Triton by the American vessel Regent (aka Trepacamara). de Onís made the essentially the same point that Proudfoot had made, and also pointed out that the US and Spain had signed a treaty in which the signatories had bound themselves not to permit third-party privateers to arm, equip, and operate from each other's ports. Spain claimed an indemnity of 701,980 dollars for the cargoes on Triton and another Royal Philippine Company, Esmerelda, that too had been captured by an American privateer operating under the Buenos Aires flag.

William Frederick, Prince of Orange in 1805–1810 When Napoleon invaded Germany in 1806 and war broke out between the French Empire and Prussia, William supported his Prussian relatives, though he was nominally a French vassal. He received command of a Prussian division which took part in the Battle of Jena–Auerstedt.

Hall, Casualty Insurance, Fourth Edition, 1968, page 35 # An "indemnification" policy From an insured's standpoint, the result is usually the same: the insurer pays the loss and claims expenses. If the Insured has a "reimbursement" policy, the insured can be required to pay for a loss and then be "reimbursed" by the insurance carrier for the loss and out of pocket costs including, with the permission of the insurer, claim expenses. Under a "pay on behalf" policy, the insurance carrier would defend and pay a claim on behalf of the insured who would not be out of pocket for anything. Most modern liability insurance is written on the basis of "pay on behalf" language which enables the insurance carrier to manage and control the claim.
Under an "indemnification" policy, the insurance carrier can generally either "reimburse" or "pay on behalf of", whichever is more beneficial to it and the insured in the claim handling process. An entity seeking to transfer risk (an individual, corporation, or association of any type, etc.) becomes the "insured" party once risk is assumed by an "insurer", the insuring party, by means of a contract, called an insurance policy. German military economic negotiators had hoped for success in the negotiations, in part, because they felt this would strengthen their arguments against Hitler's then increasingly anti-Soviet policy. The parties came closer to agreements on German 38-cm turrets, but the Soviets continued to resist demands for a full reimbursement of Volksdeutsche property. Instead of permitting full indemnification, the Soviets put restrictions on the wealth that the Volksdeutsche could take with them and limited the totals that the Soviets would apply to the Reich's clearing accounts. In November, negotiations proceeded well for Germany on potential modifications for year two of the German-Soviet Commercial Agreement, with the Soviets first increasing their grain offer from 1.2 million tons to 1.5 million, and then up to Germany's demand for 2.5 million tons.

Zaanland made her last commercial trip in September 1917 to South America and from there proceeded to North America for coaling and remained there for several months. On 20 March 1918 Zaanland was seized at Newport News by the United States Government under the right of angary, which allowed a belligerent power to use the property of a neutral nation if necessary, subject to full indemnification. United States Shipping Board and its Emergency Fleet Corporation were put in charge of the freighter, which chartered the vessel to the United States Navy to be used by the Naval Overseas Transportation Service (NOTS) on 25 March 1918.

In 2008, Adams returned to Richmond, serving as an assistant U.S. Attorney for the Eastern District of Virginia. Among his cases, Adams prosecuted John W. Forbes, a former state finance secretary who pleaded guilty and in late 2010 was sentenced to serve 10 years in prison for diverting about $4 million of a $5 million grant from the state Tobacco Indemnification and Community Revitalization Commission (which had intended to improve literacy in Southside Virginia and southwestern Virginia) to shell companies he controlled and his personal benefit.

The fuselage on display at the Gianni Caproni Museum of Aeronautics belongs to the only D.VIII to have survived to the present day; it entered service in the last days of October 1918 but didn't see any combat action before the Armistice. It was handed to the Italian armed forces in 1919–1920 as a part of the postwar indemnification programme.

A soft cost to a contractor, such as his administration costs, can be a hard cost to the owner because what the contractor invoices the owner is the owner's direct cost. If the owner employs engineers to overlook construction as the project is executed, this will be a continuing expense during repair if the repair is done after the original completion date and would be reported in the delay in completion values. If the engineer cost was a one time charge for a design, he may need to be consulted in order for the loss to be repaired. This expense does not occur because of a delay, but is incurred to repair property damage and hence should be included in the construction costs if the intention is for that expense to be covered in the indemnification depending on policy wording.

Abitibi's power operations were further extended after 1926, when the Ferguson government gave its approval for the development of the Abitibi Canyon, the largest such development since the Niagara River, in preference to incurring more debt for Ontario Hydro. The development was encouraged through secret commitments for long-term purchases of electricity and indemnification of Hydro against any losses.

Directors and officers liability Insurance (also written "directors’ and officers’ liability insurance"; often called "D&O;") is liability insurance payable to the directors and officers of a company, or to the organization(s) itself, as indemnification (reimbursement) for losses or advancement of defense costs in the event an insured suffers such a loss as a result of a legal action brought for alleged wrongful acts in their capacity as directors and officers. Such coverage can extend to defense costs arising out of criminal and regulatory investigations/trials as well; in fact, often civil and criminal actions are brought against directors/officers simultaneously. Intentional illegal acts, however, are typically not covered under D&O; policies. It has become closely associated with broader management liability insurance, which covers liabilities of the corporation itself as well as the personal liabilities for the directors and officers of the corporation.
The main income of the piaohao, namely interest‐free deposits to the government of the Qing dynasty and intergovernmental transfers between different departments and provinces, disappeared overnight as there was no longer a Chinese government. The only institutional change brought to the Chinese financial system by the late Qing dynasty, the standardisation of currency, had completely ended the domestic money exchange business in which the piaohao were operating. As more chaos affected China, the borrowers of the piaohao defaulted. As they lacked any collateral, this was because their reputation had always been enough to get a lain, and because the shareholders were completely unprotected due to their unlimited liability, the capital shareholders and the managers of the piaohao, due to the indemnification clauses which were present in their employment contracts, had to face the full losses causing many fortunes to be lost in the chaos.
Knowing that its defense and settlement costs are being borne by the indemnitor, the indemnitee may be encouraged to engage a more expensive legal team or pursue a riskier defense strategy than it would otherwise. For this reason, most indemnitors are unwilling to indemnify against claims when they do not control the defense of the claim." The American Bar Association has published advice on negotiations of construction contracts: that (1) owners try to get contractors to indemnify as much as possible, while (2) contractors (a) only indemnify for their own negligence and (b) "establish a right but not a duty for the contractor to defend under an indemnification claim." In 1879 Sir John Coode declared that the Falls must be demolished in order to prevent a repeat of previous floods by allowing free discharge of upstream water during heavy rains. After a delay of almost four years, this process was begun by the Harbour Trust by removing the previously constructed dam, but the removal of the natural obstructions through the use of dynamite was delayed by another month due to the trust being unwilling to risk accidental damage to the Prince's Bridge without formal indemnification from the Department of Public Works. The plan was to clear the reef to a uniform depth of 15 feet 6 inches, at an estimate cost of £20,000, with the existing depth being varied, with the highest points touching the surface of the water and the lowest reaching down to 15 feet, and the demolition was complete by 1883, having been funded by a combination of the Victorian Government and the Harbour Trust.
Corvetto, Louis-Emmanuel, by Quaglia The Caisse des Dépôts et Consignations was established in 1816 by Louis-Emmanuel Corvetto, Finance Minister under King Louis XVIII, to safeguard public funds, including the country's civil servants' pension funds and retirement accounts. According to article 110 of the French law of 28 April 1816: "Deposits, consignments and services relating to the Legion of Honour, to the channel company and to pension funds […] will be administered by a special body under the name Caisse des Dépôts et Consignations." The three rulings of 3 July 1816 defined the major areas of activity of the new body: consignments; voluntary deposits from individuals or public bodies and funds from the legal professions; pension funds: since 1853, Caisse des Dépôts has been managing pension funds of civil servants. Other activities include the indemnification of settlers of Santo Domingo (1825), the management of Compagnie des quatre canaux, the management of the accounts for the Legion of Honour and financial services for the army.

Another set of legal disputes rising from issues related to the protracted sale order case in Delaware, TransPerfect and Shawe had claimed that Skadden Arps had been billing excessively for work it would not explain, and the Chancellor granted the law firm's fee requests without Transperfect having an opportunity to review it.
Historian Georges Lefebvre summarizes the night's work: :Without debate the Assembly enthusiastically adopted equality of taxation and redemption of all manorial rights except for those involving personal servitude – which were to be abolished without indemnification. Towns, provinces, companies, and cities also sacrificed their special privileges.
Reacting belatedly to the National League's July 1960 announcement that it would expand to New York and Houston to begin play 20 months later, in April 1962, the American League declared in October 1960 it would add two new teams as well—and that the AL's new teams would take the field in only six months, in time for the 1961 season. The National Pastime 2011, Society for American Baseball Research to replace the recently-relocated Minnesota Twins. Because it also intended to enter the Los Angeles metropolitan market, then controlled by Walter O'Malley, majority owner of the Dodgers, the American League was compelled to negotiate an indemnification agreement with O'Malley before the Los Angeles franchise could be granted.
Companies whose business center on the development of open-source software employ a variety of business models to solve the challenge of how to make money providing software that is by definition licensed free of charge. Each of these business strategies rests on the premise that users of open-source technologies are willing to purchase additional software features under proprietary licenses, or purchase other services or elements of value that complement the open-source software that is core to the business. This additional value can be, but not limited to, enterprise-grade features and up- time guarantees (often via a service-level agreement) to satisfy business or compliance requirements, performance and efficiency gains by features not yet available in the open source version, legal protection (e.g., indemnification from copyright or patent infringement), or professional support/training/consulting that are typical of proprietary software applications. Historically, these business models started in the late 1990s and early 2000s as “dual-licensing” models, for example MySQL, and have matured over time to include many variations, as described in the sections below.

In 2015, improvements to warehousing and logistics capabilities were carried out in partnership with multiple local organizations, including The Virginia Economic Development Partnership, Martinsville-Henry County Economic Development Corporation, The Governor’s Opportunity Fund, and The Virginia Tobacco Indemnification and Community Revitalization Commission.
Charles III of Spain (afterwards the emperor Charles VI) then had his court at Barcelona, and Norris stationed some ships off the coast of Catalonia, the command of which was assigned to Forbes, who was directed to co-operate as much as possible with the Spanish court, and was permitted to reside on shore. Two Genoese ships of war, of 50 and 70 guns respectively, were at Cadiz taking in specie, alleged to be for the use of the French faction in Italy. The Spanish king proposed that Forbes should put out to sea and seize the vessels on their return voyage. Forbes explained that England was at peace with the Genoese republic; but being pressed by the king, and the queen offering him her sign-manual for his indemnification, he started with his own ship, the Grafton of 70 guns, and the Chatham of 50 guns, Captain Nicholas Haddock, took the Genoese ships into Port Mahon, discharged the officers and crews to shore, landed the specie, amounting to 1,600,000 dollars, and returned with the ships to Barcelona.

Commenting on the bill, state senator Paula Dockery said, "I don't envision a time anytime soon where thoughtful senators are going to say that there's some kind of good public policy involved in taking liability away from somebody who was at fault and putting it on the taxpayers of the state of Florida." Progress continued to move slowly forward on the project until the state legislative session on April 30, 2009, when the project was once again defeated by a 23-17 vote.
In January 2006, Genoa signed Forestieri on a three-year contract. Boca tried to keep the young player, but failed to do so. In March, Boca contested the regularity of the transfer and, refusing a €300,000 indemnification from Genoa, the Argentine club submitted the case to the AFA.
