The Real Property Act 1860 (23 & 24 Vict. c. 11), "An Act to consolidate and amend certain Acts relating to the transfer ad encumbrance of freehold and other interests in land" (17 October 1860) (metadata record) and the Real Property Act 1861 (24 & 25 Vict. c. 22), "An Act to amend the Real Property Act of 1860"(3 December l861) (metadata record) were the main amendments to the Act. In South Australia, the Act was substantially revised in 1886, and this version remains in force in South Australia.
Jonathan Fairbanks came from Heptonstall in the West Riding of Yorkshire, England, to Boston, Massachusetts, in the year 1633, and in 1636/37 acquired land and settled in Dedham, Massachusetts, where he built the house on his farm land. The house is likely the oldest dwelling house in New England and the oldest house continuously owned by the builder and his lineal descendants. It is also regarded as the oldest surviving timber frame structure in North America. Since the original purchase, the estate has never had a mortgage encumbrance upon it.
The class was originally designed and built with barque-rigged sails, although some pictures show ships of the class with a barquentine rig. Condor was lost in a gale during her first commission, and the contemporary gunnery pioneer Admiral Percy Scott ascribes her sinking to the encumbrance of sails, and furthermore believed that her loss finally convinced that Admiralty to abandon sails entirely.Fifty Years in the Royal Navy , Admiral Sir Percy Scott, Bt., John Murray, London, 1919, p.37 All other ships of the class had their sails removed during the first few years of the twentieth century.

Paragraph XXVI. Exemptions from levy and sale. The General Assembly shall protect by law from levy and sale by virtue of any process under the laws of this state a portion of the property of each person in an amount of not less than $1,600.00 and shall have authority to define to whom any such additional exemptions shall be allowed; to specify the amount of such exemptions; to provide for the manner of exempting such property and for the sale, alienation, and encumbrance thereof; and to provide for the waiver of said exemptions by the debtor. Paragraph XXVII.
The Russian cavalry (except for the Cossacks) discarded the lance in the late 19th century, but in 1907, it was reissued for use by the front line of each squadron when charging in open formation. In its final form, the Russian lance was a long metal tube with a steel head and leather arm strap. It was intended as a shock weapon in the charge, to be dropped after impact and replaced by the sword for close combat in a melee. While demoralizing to an opponent, the lance was recognized as being an awkward encumbrance in forested regions.

Treasury Working Paper 01/17, Geography and the Inclusive Economy, p 10. After the closure, the majority of buildings making up the Waitara freezing works were demolished, significantly changing the townscape (the area on the right on the far side of the river in the image of Waitara below, was the site of the freezing works). ANZCO Foods Group subsequently built a plant to manufacture smallgoods such as salami, sausages and hamburger patties on the site of the freezing works. However, AFFCO went to court to enforce a 20-year encumbrance which restricts meat processing and associated activities on the site.
Entitled "Metamorphosis", the story maintained the character's anti-authoritarian sentiments, but was instead based on the philosophy of Neo-Tech, an offshoot of Objectivism. During the climax of the "Anarky" storyline of Batman: Shadow of the Bat #41-42, it is implied that Anarky dies in a large explosion. In turn, the Anarky limited series resolved this event by revealing that Anarky survives, but chooses to shed the encumbrance of his double life by faking his death. Anarky works in seclusion to further his goal of achieving a utopian society, briefly hiring Legs and other homeless men to monitor Batman's movements.
More generally, the state's compelling interest in prosecuting crimes allows the encumbrance of the right to travel created by the tolling; since it applied to anyone who committed crimes in Tennessee and then left the state regardless of whether they lived in Tennessee or not it met the equal protection burden. Nor had Perry shown any evidence that it was enforced against him prejudicially. Since the court had ruled against Perry on every issue he raised, it did not feel there had been any cumulative effect. In July 2011 it denied him permission to appeal the case to the Tennessee Supreme Court.
Since its publication, the prose style and dialogue in Hemingway's novel have been the source of controversy and some negative critical reaction. For example, Edmund Wilson, in a tepid review, noted the encumbrance of "a strange atmosphere of literary medievalism" in the relationship between Robert Jordan and Maria.Edmund Wilson, " Return of Ernest Hemingway" (Review of For Whom the Bell Tolls) New Republic, CIII (Oct. 28, 1940) This stems in part from a distinctive feature of the novel, namely Hemingway's extensive use of archaisms, implied literal translations, and false friends to convey the "feel" of the Spanish spoken by his characters.
They decided to have a Bentley 3½ Litre (chassis number B187BL) fitted with a Vanvooren body featuring a pillarless sedan body, another Vanvooren patented speciality. The car body had no B-pillar, and the rear door hinges were at the rear edge of the doors, so that when both front and rear doors were opened the entire passenger area could be accessed without the encumbrance of a central pillar. The "Pillarless saloon" was subsequently made available to the leading British coach builders so that they could study it in detail. Collaboration with Rolls-Royce also led to a cooperative relationship with their leading UK based car-body builder, Park Ward.
Liberalism, the belief in freedom, equality, democracy and human rights, is historically associated with thinkers such as John Locke and Montesquieu. constitutionally limiting the power of the monarch, affirming parliamentary supremacy, passing the Bill of Rights and establishing the principle of "consent of the governed". The 1776 Declaration of Independence of the United States founded the nascent republic on liberal principles without the encumbrance of hereditary aristocracy—the declaration stated that "all men are created equal and endowed by their creator with certain unalienable rights, among these life, liberty, and the pursuit of happiness","The Constitution of the United States" (PDF). echoing John Locke's phrase "life, liberty, and property".
In The Sims 2,The Sims 3 and The Sims 4, the Sims make extensive use of hammerspace, regularly pulling items out of their back pockets which could not possibly fit there. Examples include rakes, hairdryers, watering cans and bags of flour. Similarly, in the sandbox game Minecraft, a player character can carry thousands of tonnes of material such as gold in the character's inventory without encumbrance, as if an empty inventory were the same as a full one. In reality, even one block of most materials in Minecraft would weigh hundreds or thousands of kilograms, and the player can carry up to 2304 blocks in their inventory.
The Real Property Act 1858, 21 Vict. c. 15, is the short title of an Act of the Parliament of South Australia, with the long title "An Act to simplify the Laws relating to the transfer and encumbrance of freehold and other interests in Land". After being introduced as a private member's bill by Sir Robert Richard Torrens, it was passed by both houses and assented to by the Governor of South Australia, on 27 January 1858. It was the first law in the world to institute what has become known as the Torrens Title system of property law, and is sometimes referred to as the "Torrens Title" Act 1858.
In the Dungeons & Dragons role-playing game, the cleric is one of the four base character classes. Clerics are versatile figures, both capable in combat and skilled in the use of divine magic, which they employ without any restriction despite encumbrance of their armour. In earlier versions of the games they were restricted to using bludgeoning weapons, such as maces, staffs, and war- hammers. In later additions this limit was lifted depending on the symbolic weapon of their deity, although other martial (non-simple) weapons were still alien to them - requiring a costly feat in the latest edition of the game to employ them.
The druid, first introduced in the Greyhawk supplement as a monster, is expanded in Eldritch Wizardry as a clerical sub-class, a priest of a neutral-type nature worship. The book introduces seven distinct types of demons, as well as creatures that have psionic attack capabilities and/or astral or ethereal creatures, such as brain moles, thought eaters, su-monsters, and intellect devourers. Eldritch Wizardry includes a modified combat system which takes into account a player's armor type, readiness of weapons, encumbrance, level of spell being used, and more. The over twenty artifacts and relics included have tremendous powers unknown to the players, who must rely on rumor or trial and error.
The Title Conditions (Scotland) Act 2003 is an Act of the Scottish Parliament. It came into force on 28 November 2004, and is one element of a three part land reform abolishing feudal tenure and modernising Scottish property law, the other two elements being the Abolition of Feudal Tenure etc. (Scotland) Act 2000 and Tenements (Scotland) Act 2004 which came into effect on the same date. The legislation primarily relates to real burdens, a key aspect of property law in Scotland, and defines them in section 1 of the Act as "an encumbrance on land constituted in favour of the owner of other land in that person’s capacity as owner of that other land".
Wassell, ubi supra, a bill, filed during the owner's lifetime by the condemned's children to protect the property from any encumbrance arising from the owner's failure to pay taxes was sustained. The court declared that in the absence of any other steward, the children might act in that capacity. These decisions apparently sustain the plaintiff's contention that foreclosing the mortgage was without the necessary parties, and was therefore void for want of jurisdiction. The defendants responded that because Avegno's mortgage contained the pact de non alienando (in which the mortgagor agrees not to alienate/encumber the premises to the prejudice of the mortgage), he was the only necessary party to Morgan's suit.
In 1899, Louise Masset was tried for the murder of her young son Manfred, whose body was found in the ladies' lavatory at Dalston Junction railway station. Circumstantial evidence suggested that Louise was the murderer, and the killing was to be rid of a supposed encumbrance due to her wanting to marry a man named Lucas. However, in her claims of innocence, Louise said she had taken Manfred out of the care of one woman to give him to two ladies she met who had an establishment for the care of growing children. The police claimed they made some effort in looking for the two women, but the extent of their investigation is unknown.
Waller was in no position to resist an attack by Sandys on his front and by Maurice on his flank and rear, besides having the River Avon to cross in case of disaster. So Waller determined to retreat while he could. To get rid of the encumbrance of his wounded Waller collected all the boats round Worcester, and placing his wounded, baggage, and guns on board, sent them by water to Gloucester. He searched round Worcester to get horses, and is said to have been careful to send out as far north as Ombersley to carry off all those belonging to Colonel Sandys, the Governor of Worcester, and Martin Sandys, who was helping him.
In the spring of 1982 (as featured in the June issue of Time Magazine that year), short skirts began to re-emerge, notably in the form of "rah-rahs", which were modeled on those worn by female cheerleaders at sporting and other events. In 1985, the British designer Vivienne Westwood offered her first "mini-crini", an abbreviated version of the Victorian crinoline. Its mini-length, bouffant silhouette inspired the puffball skirts widely presented by more established designers such as Christian Lacroix. In 1989, Westwood's mini-crini was described as having combined two conflicting ideals – the crinoline, representing a "mythology of restriction and encumbrance in woman's dress", and the "equally dubious mythology of liberation" associated with the miniskirt.
He also began writing through the media agency Reuters in the late 1920s by means of a syndicated weekly newspaper column, with a selection of his political pieces featuring in Time Magazine and a plethora of other noted publications. By the time Eggleston had resigned from the Toronto Star in 1936, he had risen to become the newspaper's parliamentary correspondent; he'd finished reporting through Reuters within the same year. Whilst maintaining his journalistic status as a freelance reporter, he began governmental service in 1937. He was a member of the secretariat in the Rowell–Sirois Commission, which sought to ease the encumbrance of the Great Depression by analyzing perceived flaws in the Canadian constitution.
If antlers functioned only in male–male competition for mates, the best evolutionary strategy would be to shed them immediately after the rutting season, both to free the male from a heavy encumbrance and to give him more time to regrow a larger new pair. Yet antlers are commonly retained through the winter and into the spring, suggesting that they have another use. Wolves in Yellowstone National Park are 3.6 times more likely to attack individual male elk without antlers, or groups of elk in which at least one male is without antlers. Half of all male elk killed by wolves lack antlers, at times in which only one quarter of all males have shed antlers.
For safety and efficiency, divers may need to communicate with others diving with them, or with their surface support team. The interface between air and water is an effective barrier to direct sound transmission, and the natural water surface is also a barrier to visual communication across the interface due to internal reflection, particularly when not perfectly smooth. The equipment used by divers and the pressurised environment are also hindrances to sound-based communication, and the encumbrance of diving equipment, relatively low light levels, and low visibility of many diving environments also hinders visual communication. Communication is most critical in an emergency, where high stress levels make effective communication more difficult, and the circumstances of the emergency may make the communication physically more difficult.
The Hôtel de Condé formed a vast ensemble of structures, with wings separated by narrow interior courtyards, with awkward intrusions and party walls; however, the main corps de logis opened upon an extensive parterre garden in the French manner, separated from the cour d'honneur by a fine wrought-iron railing. A series of three terraces descended to rue de Vaugirard, facing the Palais du Luxembourg. The garden was so spacious that, when it was necessary to close the Luxembourg Garden to the public, the gates of the princely residence could be opened, and the crowd could be admitted without the least encumbrance. Germain Brice, in Description nouvelle de la ville de Paris (1707)Brice, Description nouvelle de la ville de Paris, Paris, 1707, vol. II:291.
Carl Sargent reviewed Wilderness Survival Guide for White Dwarf No. 85, stating that a good wilderness adventure rulebook is hard to write, because of the lack of sharp discontinuities as opposed to dungeon adventures, although "Mohan has pulled it off brilliantly." Sargent called the weather system "splendid", and felt that the rules on encumbrance and movement rates "make sense and work easily". He noted some odd details, such as a draft horse being able to carry 80% of the load of an elephant, and the fact that druids gain wilderness proficiencies slower than any other class. However, he felt that "for every error there are a dozen good points of details; the WSG gets proficiency checks 'right', correcting a major DSG error".
The KODAK camera introduced in 1888 was the first box camera to become widely adopted by the public and its design became the archetype for box camera designs introduced by many different manufacturers. The use of flexible roll film meant that the cameras were light and portable and could be used without the encumbrance of tripods and the attendant difficulty of using glass photographic plates which were typical of professional cameras. Before the introduction of the Kodak, photographers were responsible for making their own arrangements for the development and printing of their pictures. The first Kodak came pre-loaded with film and the customer returned the camera to Kodak for processing and to be reloaded with film for the customer.
In 2000, two weeks after the Human Rights Act 1998 came into force, a court martial was challenged that all swords should be removed from court as it was claimed to be "degrading". The Judge Advocate at the trial agreed for all present to remove their swords but did so under common law practice, describing them as an "unnecessary encumbrance". The European Court of Human Rights case of Grieves v United Kingdom, which concerned the independence of members of courts martial, referred to the use of swords but this was not part of the issues for determination by the court. In 2004 Her Majesty's Government declared that it would no longer require the accused to be marched in with an armed escort nor would any members present wear sheathed swords.
Surface-supplied diver at the Monterey Bay Aquarium, Monterey, California US Navy Diver using Kirby Morgan Superlight 37 diving helmet Surface-supplied diving is diving using equipment supplied with breathing gas using a diver's umbilical from the surface, either from the shore or from a diving support vessel, sometimes indirectly via a diving bell. This is different from scuba diving, where the diver's breathing equipment is completely self-contained and there is no link to the surface. The primary advantages of conventional surface supplied diving are lower risk of drowning and considerably larger breathing gas supply than scuba, allowing longer working periods and safer decompression. Disadvantages are the absolute limitation on diver mobility imposed by the length of the umbilical, encumbrance by the umbilical, and high logistical and equipment costs compared with scuba.
Thayer in his "Peacock in the Woods" (1907) suggested that the function of the ornate tail was camouflage The colours of the peacock and the contrast with the much duller peahen were a puzzle to early thinkers. Charles Darwin wrote to Asa Gray that the "sight of a feather in a peacock's tail, whenever I gaze at it, makes me sick!" as he failed to see an adaptive advantage for the extravagant tail which seemed only to be an encumbrance. Darwin developed a second principle of sexual selection to resolve the problem, though in the prevailing intellectual trends of Victorian Britain, the theory failed to gain widespread attention. The American artist Abbott Handerson Thayer tried to show, from his own imagination, the value of the eyespots as disruptive camouflage in a 1907 painting.
A structured settlement factoring transaction is a means to raise liquidity where there is no other viable means, via the transfer of structured settlement payment rights, for items such as unforeseen medical expenses, the need for improved housing or transportation, education expenses and the like, or in a situation where the individual has simply spent all his or her cash. To meet this need, the structured settlement recipient may involve the sale (or, less commonly, the encumbrance) of all or part of certain future periodic payments for a lump sum. Generally such lump sums are discounted. If a person sells the structured settlement payment rights, he or she will never receive the full amount of the payments originally contracted for when the individual settled his or her case and the structured settlement was established.
Calmasho is a more serious form of courtship and typically involves a view towards marriage. The calmasho process may place a greater level if encumbrance upon the male than the female due to the meher stipulation whereby money is exchanged from man to woman, whereby the woman can set any price; or for introverted men, the doonasho, soo doonis or geedh fadhiisi process, whereby a man is required to inquire about his courtee to her male relative, usually her father. A common tradition is for a senior elder from the groom's side to act on behalf of the groom. Once an agreement exists, another occasion is set for this to be formalised during the nikah procession wherein instead a "male guardian" or imam enacts the giving away of the bride.
The book also covers PC resources, such as: adding to the proficiency system introduced in the Dungeoneer's Survival Guide; appropriate clothing for different climates; clarifying normal vision, infravision and ultravision; details on mounts; and rules on encumbrance and movement rates in the wilderness. The book also details how the environment affects PC activities, and includes new information on survival techniques, air and waterborne travel, combat in unusual circumstances, and magic. In addition to new abilities, the Wilderness Survival Guide introduces difficulties and handicaps that players will have to cope with, such as the effects of sleeping in armor and the ease with which a fire can get out of hand. The book includes a short section entitled Starting from Scratch that shows how to design a bit of topography using a step-by-step method of creating a viable environment.
A contract is covered if it is either (i) currently in foreclosure or on a tax lien sale list; or (ii) the owner is in default (behind on mortgage payments by 2+ months) and the sale involves a reconveyance agreement. A reconveyance arrangement has two elements: (i) A sale, mortgage, lien, encumbrance or any other method which allows an "equity purchaser" to obtain legal or equitable title to all or part of the property; and (ii) Some agreement or promise to the "equity seller" that he/she can regain ownership of the property (e.g., the purchase agreement, option to purchase, lease, etc.) There are some key requirements for a valid reconveyance agreement. The equity purchaser needs the equity seller's permission to resell the property to anyone else for so long as the equity seller has a right to buy the property back.
The party had to lay up for a week for Brunner to recover some use of his body. With the aid of Kehu (Pitewate and his wife abandoned the party when Brunner became ill), he was able to reach Nelson in June 1848, thus ending after 550 days what he described as his 'Great Journey'. In Nelson, many people had thought Brunner dead and he readily recognised that he would not have survived his endeavours without the aid of Kehu, writing: "... I found my native Ekehu of much use - invaluable indeed, but the other three rather an encumbrance - I could have made better progress without them; but to Ekehu I owe my life - he is a faithful and attached servant." As well as further information about the West Coast, Brunner informed the colony that coal was to be found in the Grey River valley.
It is, therefore, possible for a grantee to receive no actual interest, and - because a quitclaim deed offers no warranty - have no legal recourse to recover any losses. Further, if the grantor should acquire the property at a later date, the grantee is not entitled to take possession, because the grantee can receive only the interest that the grantor held at the time the transfer occurred. In contrast, other deeds often used for real estate sales (called grant deeds or warranty deeds, depending on the jurisdiction) contain warranties from the grantor to the grantee that the title is clear or that the grantor has not placed any encumbrance against the title. Because of this lack of warranty, quitclaim deeds are most often used to transfer property between family members, as gifts, placing personal property into a business entity (and vice versa) or in other special or unique circumstances.
Some debate exists as to whether the sale was due to a financial over encumbrance, or fear that a more senior claim might be made. The elder Sir James, continued his ministry at Keith until he was deprived of his living by the Privy Council in 1689, because he refused to pray for King William and Mary, but instead prayed for the restoration of King James II. Sir James Strachan (the elder) died at Inverness in 1715. His son and heir, also named Sir James entrusted their three daughters and their tutorship to the father of his wife, Barbara Forbes' father. Sir James joined the Highland force that Calverhouse, for the Viscount Dundee, in support of the deposed King James II. It is thus apparent the Royalist sentiments passed from father to son. On 27 July 1689 Bonnie Dundee’s Highlanders met and defeated General Mackay’s army at the Battle of Killiecrankie.
Hoplitodromos from an Attic black-figure Panathenaic amphora, 323–322 BC The hoplitodromos or hoplitodromia (Greek: , English translation: "race of soldiers") was an ancient foot race, part of the Olympic Games and the other Panhellenic Games. It was the last foot race to be added to the Olympics, first appearing at the 65th Olympics in 520 BC, and was traditionally the last foot race to be held. Unlike the other races, which were generally run in the nude, the hoplitodromos required competitors to run wearing the helmet and greaves of the hoplite infantryman from which the race took its name. Runners also carried the aspis, the hoplites' bronze-covered wooden shield, bringing the total encumbrance to at least 6 kg (12 pounds).Peter Krentz, “A Cup by Douris and the Battle of Marathon,” in Garrett G. Fagan and Matthew Trundle (eds.), New Perspectives on Ancient Warfare (Brill: Leiden, 2010) pp. 190ff.
The Real Property Act 1858, with the long title "An Act to simplify the Laws relating to the transfer and encumbrance of freehold and other interests in Land", was assented to on 27 January 1858. At the head of the first page of the transcript, is "Anno vicesimo primo Victoriae Reginae, No. 15", meaning the 21st year of Queen Victoria's reign, although the first page of the original document says "1857–8, No. 15". The Act, eagerly anticipated by many, came into effect on 2 July 1858 and was on the whole well-received, apart from some lawyers who would have noted that the ease and clarity of the process would mean less in earnings for them in the future. (Incorrect naming of "Colonel Robert Torrens" reported to site.) Torrens was to be appointed Registrar-General in order to assist with the Act's application.
Those who acquire title as follows are excluded from HETPA: (i) To use, and then actually uses, the property as his/her primary residence; (ii) By a deed from a referee in a foreclosure sale; (iii) At any sale of property authorized by statute; (iv) By order or judgment of any court; (v) From a spouse, or from a parent, grandparent, child, grandchild or sibling of such person or such person's spouse; (vi) As a not-for-profit housing organization or as a public housing agency; or (vii) As a bona fide purchaser or encumbrancer for value (e.g. a lienholder) What is a Bona Fide Purchaser? One who (i) acts in good faith; (ii) purchases for valuable consideration or provide a mortgage; (iii) has no notice of the equity seller's continuing right to, or equity in, the property prior to the acquisition of title or encumbrance; (iv) has no notice of any violation of HETPA by the equity purchaser as related to the property. Generally, this is one who either purchases from or provides a loan to the equity purchaser.
In 1906 the Burke Act (also known as the forced patenting act) amended the GAA to give the Secretary of the Interior the power to issue allottees a patent in fee simple to people classified "competent and capable." The criteria for this determination is unclear but meant that allottees deemed "competent" by the Secretary of the Interior would have their land taken out of trust status, subject to taxation, and could be sold by the allottee. The allotted lands of Native Americans determined to be incompetent by the Secretary of the Interior were automatically leased out by the federal government. The act reads: > ... the Secretary of the Interior may, in his discretion, and he is hereby > authorized, whenever he shall be satisfied that any Native American allottee > is competent and capable of managing his or her affairs at any time to cause > to be issued to such allottee a patent in fee simple, and thereafter all > restrictions as to sale, encumbrance, or taxation of said land shall be > removed.
An 1824 land deed for Upper Canada Crown land policy to 1825 was multi-fold in the use of a "free" resource that had value to people who themselves may have little or no money for its purchase and for the price of settling upon it to support themselves and a create a new society. First, the cash-strapped Crown government in Canada could pay and reward the services and loyalty of the "United Empire Loyalists" who, originated outside of Canada, without encumbrance of debt by being awarded with small portions of land (under ) with the proviso that it be settled by those to which it was granted; Second, portions would be reserved for the future use of the Crown and the clergy that did not require settlement by which to gain control. Lt. Governor Simcoe saw this as the mechanism by which an aristocracy might be created, and that compact settlement could be avoided with the grants of large tracts of land to those Loyalists not required to settle on it as the means of gaining control.
This should be observed for the following reason, namely: in order that if a separation takes place, the property of each of the parties may be returned to them, free and without encumbrance, to dispose of at their pleasure, or, where the marriage is dissolved by death, that it may descend intact to their heirs. Part IV, Title XI, Law xvii: Concerning Separate Property Belonging to the Wife, Which is Not Given as Dowry, and Which is Called in Latin, Paraphernalia. (return) All property and possessions, whether personal or real, which women keep separately for themselves, and do not enter in the account of a dowry, are called in Greek parapherna, and this derived its name from para, which means, in Greek, the same as near, and pherna which takes the place of dowry, in Greek, the same as things which are joined to, or connected with a dowry. All the articles called, in Greek, parapherna, when they are given by a wife to her husband with the intention that he shall have control of them as long as the marriage lasts, he has the right to keep, just as those which are given him by way of dowry.
Part 1 of Borgmann's book gave background information and began to argue that how the modern world relates to technology follows a pattern, which he calls the device paradigm. Part 2, starting with chapters 8-12, goes into more depth regarding this phenomenon. Chapter 8, “The Promise of Technology,” describes the beginnings of how the world began to rely so heavily on technology to begin with. Through the Enlightenment and then the Industrial Revolution, humanity began to believe that technology was the key to “liberation from toil and the advancement of literacy, eating, and health” (38). With technology's “promise” thus in place—and he's careful to note some value and truth in said promise—it gradually took the prominence that led to the pattern in question. Chapter 9, “The Device Paradigm,” consequently spells out the first main part of Borgmann's entire thesis directly: we now operate according to the device paradigm, where things have become devices. By this, he means that whereas we once acquired goods via use of things, which are “inseparable from . . . engagement,” we now get commodities via devices, which remove the “encumbrance of or the engagement with a context” (41, 47).
But the excess of light with which she had been impregnated was more than she could contain, and while Christ her right-hand birth was borne upward with his mother, forming with the First and Second Man the True and Holy Church, a drop of light fell on the left hand downwards into the world of matter, and was called Sophia (Wisdom) or Prunikos, an androgynous being. By this arrival the still waters were set in motion, all things rushing to embrace the Light, and Prunikos wantonly playing with the waters, assumed to herself a body, without the protection of which the light was in danger of being completely absorbed by matter. Yet when oppressed by the grossness of her surroundings, she strove to escape the waters and ascend to her mother, the body weighed her down, and she could do no more than arch herself above the waters, constituting thus the visible heaven. In process of time, however, by intensity of desire she was able to free herself from the encumbrance of the body, and leaving it behind to ascend to the region immediately above, called in the language of another sect the middle region.
Francisca de Montejo y del Castillo married cavalry captain Carlos de Arellano, an uncle of Martín Cortés. Although the union is mentioned in passing by Bishop de Landa (who knew the family personally) in his Relación (ca. 1566), it is Fray Diego López de Cogolludo who relates in his Historia de Yucatán (1688) that Montejo y León died insolvent, bequeathing to his son Juan the encumbrance of paying his significant remaining debts, and causing his widow to petition the King of Spain, with both unusual assertiveness and effectiveness,"I am no less a conquistadora than are the conquistadores...often the leading women of my quality when they are found present in wars and conquests...with their special vision invigorate themselves and work well and serve their monarchs and lords with more energy and valour [than the men]." (As cited in Hugh Thomas's work The Conquest.) for a pension and the right of retaining ownership of the complex of properties (solares) on the plaza mayor of Mérida (part of which, the Casa de Montejo, would continue to be lived in by her descendants into the 19th-century).
