Despite the strict liability nature of the offence, a person will not be deemed to have engaged in misleading or deceptive conduct where: # the circumstances make it apparent that the person is not the source of the information and that it expressly or impliedly disclaims any belief in its truth or falsity and is merely passing on the information for what it is worth;. # the person, while believing the information, expressly or impliedly disclaims personal responsibility for what it conveys, for example, by disclaiming personal knowledge; or # the person, while believing the information, ensures that its name is not used in association with the information.

On , Huang and his brother-in-law, Cheng Tzu-tsai, both members of the World United Formosans for Independence, were involved in the of then-Vice Premier Chiang Ching-kuo (Chiang Kai-shek's son) in New York City. Huang approached Chiang with a gun at the Plaza Hotel, but a Diplomatic Security Service special agent pushed him out of the way, causing the bullet to strike the hotel's revolving doors. The World United Formosans for Independence later issued a statement disclaiming involvement. He pleaded guilty in a 1971 trial to charges of attempted murder and illegal possession of a firearm, but was granted bail before sentencing, and fled the United States.

Following the ouster of Andros as Rhode Island's governor, Clarke refused to resume as the governor of the colony, reading a paper before the Assembly disclaiming the present government, and Henry Bull was elected in his place. His position changed several years later, however, when in December 1695 Governor Caleb Carr died in office, and Clarke was chosen as governor in his place, probably during an extra session of the General Assembly held in January 1696, though there is no record of such a meeting. A plot to assassinate England's Protestant King William III was revealed, and the colonies were preparing for an invasion by France. Governor Fletcher of New York wrote Clarke for a quota of men which had not been provided by his predecessor.

Escheat can still occur in England and Wales, if a person is made bankrupt or a corporation is liquidated. Usually this means that all the property held by that person is 'vested in' (transferred to) the Official Receiver or Trustee in Bankruptcy. Before CRA it was treated differently; in Ashdown v Samuel Williams & Sons Ltd [1957] 1 QB 409 the Court of Appeal held that an occupier could exclude liability by displaying a notice disclaiming as such, even if the claimant had not read the notice.

Under this test, the court will accept the pled amount unless it is legally certain that the pleading party cannot recover more than $75,000.
