Roughly fifty percent of the population is Catholic, and the second and third main religious groups in Haiti, Pentecostalism and Islam, also tend to have negative views about same-sex sexuality and cross-dressing. As a result of these attitudes and viewpoints, LGBT people often feel the need to be discreet about their sexual orientation or gender identity for fear of being targeted for discrimination or harassment. While the Haiti government has allowed a LGBT rights movement to exist, public support is almost nonexistent.

While home in the summer of 1829, Lee had apparently courted Mary Custis whom he had known as a child. Lee obtained permission to write to her before leaving for Georgia, though Mary Custis warned Lee to be "discreet" in his writing, as her mother read her letters, especially from men. Custis refused Lee the first time he asked to marry her; her father did not believe the son of the disgraced Light Horse Harry Lee was a suitable man for his daughter. She accepted him with her father's consent in September 1830, while he was on summer leave, and the two were wed on June 30, 1831.

At the time asylum in the United Kingdom was controlled by the UK Border Agency as part of the Home Office, which refused asylum in both cases. Both men appealed their individual decisions without success, arriving in a conjoined appeal to the Court of Appeal (Pill and Keene LJJ and Sir Paul Kennedy), turned down on 10 March 2009. The Court of Appeal found that the Asylum and Immigration Tribunal had been entitled to find that HJ could reasonably be expected to tolerate the need for discretion on his return to Iran, and therefore was not entitled to asylum. The Court found that HT would be discreet on his return to Cameroon, and that he had not therefore established that there was a real risk of persecution.

The history of gay cruising is sparsely documented, as the illegality of gay sex meant that those who used such cruising grounds were likely to be discreet about them. Rictor Norton, author of Mother Clap's Molly House (a reference to Margaret Clap), is one of the few historians to address the topic. He believes that the first gay cruising grounds and gay brothels in London may have sprung up in the early 17th century; theatres were sometimes denounced as such by moralists of the time. So-called "cruising grounds" or "cruising sites", where gay and bisexual men meet at a public place to cruise for sex, originated in the late 1600s (from the earliest known records, although it most likely originated much earlier) and has continued to the present day.
