In 1911, the police prefect Lépine authorises "houses of rendezvous" where prostitutes do not live, but where they come only to work. The issue is compounded by widespread indifference to enforcing copyright law, both with governments and the public at large. To steal a car is seen as a crime in most people's eyes, but to obtain unauthorized copies of music or a game is not. Additionally, not all people agree with 'copyright laws', as it unfairly criminalises competition, allowing the copyright-holder to effectively monopolise related industries. It also authorises copyright-holders to use region-coding to discriminate against selected populations price-wise and availability-wise.

Section 13(8) of the South African Police Services Act, for example, authorises roadblocks and searches. Most of the case authority in this topic deals, therefore, with the constitutionality of searches and seizures.

These donation based seats have come under heavy criticism because this makes effectively India the only country that authorises, as official policy, the sale of medical seats by private medical colleges, implicitly accepting the principle that the ability to pay, and not merit, is what counts. These illegal capitation fees range from Rs.50 lakh to Rs.1 crore for a MBBS seat. For any medical seat a student from general category should minimum have scored 50 percentile in NEET UG to get seat in UG courses. But medical colleges in states like Kerala, require minimum marks / ranks in their respective competitive entrance exams even for the management seats.

This precedent set by the Chief Justice became a benchmark for sentences in molest cases, where the court is expected to sentence a molester to at least nine months' imprisonment and three strokes of the cane if the offence involves touching the victim's private parts. In some cases, male employees can be sentenced to caning for offences committed by the company they work for. For instance, the Dangerous Fireworks Act states that caning is mandatory for a manager or owner of a company which imports, delivers or sells dangerous fireworks. Another example is the transporting of illegal immigrants; a manager of a company who authorises or participates in such activity can be sentenced to caning.

The militarization of these camps led to the invasion of Zaire by Rwanda and Uganda, known as the First Congo War. The area of French influence, known as Zone Turquoise, within the Cyangugu-Kibuye-Gikongoro triangle, was spread across a fifth of the country. Rwanda: ‘Genocidal slaughter’ claims as many as 1 million — UN authorises ‘Operation Turquoise’ to protect displaced persons, UN Chronicle, Vol 4 (1994) Although it was meant to save lives and stop the mass killings, killings did occur. When the Hutu government moved the Radio Télévision Libre des Mille-Collines radio transmitter, a key tool in encouraging Hutus to kill their Tutsi neighbors, into the Zone Turquoise, the French did not seize it.
Council authorises enhanced cooperation for EU Patent Two days earlier, on 8 March 2011, the Court of Justice of the European Union had issued its opinion, stating that the draft Agreement creating the European and Community Patent Court would be incompatible with EU law.ECJ Press release of 8 March The same day, the Hungarian Presidency of the Council insisted that this opinion would not affect the enhanced co-operation procedure.Press release of 8 March In November 2011, negotiations on the enhanced co-operation system were reportedly advancing rapidly—too fast, in some views. It was announced that implementation required an enabling European Regulation, and a Court agreement between the states that elect to take part.

228 The granting of planning permission does not constitute immunity from a claim in nuisance, however; in Wheeler v Saunders Ltd. the Court of Appeal said that it would be "a misuse of language to describe what has happened in the present case as a change in the character of the neighbourhood. It is a change of use of a very small piece of land... it is not a strategic planning decision affected by considerations of public interest. Unless one is prepared to accept that any planning decision authorises any nuisance which must inevitably come from it, the argument that the nuisance was authorised by planning permission in this case must fail".
But those oppose these amendments say that in Indian situation competition can not bring down the cost. Some electricity finance experts are of the opinion that it will weaken the public sector discoms and can damage power sector industry in the country.Amendment to Act will change power sector Section 25 of the electricity act, 2003 authorises the central government to demarcate the country into regions necessary for the efficient, economical and integrated transmission and supply of electricity, and in particular to facilitate voluntary interconnections and co-ordination of facilities for the inter-State, regional and interregional generation and transmission of electricity. Electricity is listed in the concurrent list (entry 38 of list III).
Stradella, CFF 229, Op.033 is an 1841 opera by César FranckIn Venice, with the carnival in full swing, Spadoni, lieutenant of the Duke of Pesaro – a leading figure in the City and a member of the Council of Ten – and his henchmen abduct the beautiful Leonor. To make the young girl love him, the Duke has hired Stradella, a singer and singing teacher. He is, however, completely unaware of the love affair between Stradella and Leonor. Stradella will, therefore, use the mandate that authorises him to visit Leonor to help her escape from the palace of the Duke, who, furious at having been duped, pursues them all the way to Rome, charging Spadoni with hiring some gangsters.
NHS England authorises and pays for sodium oxybate by means of individual funding requests on the basis of exceptional circumstances. The British Department of Health pays for the medication for 80 patients who are taking legal action over problems linked to the use of the swine flu vaccine Pandemrix at a cost of £12,000 a year. As of 2016 there were many areas in the UK where NHS did not pay for it. In May 2016 they were ordered by the High Court to provide funding to treat a teenager with severe narcolepsy. The judge criticised their “thoroughly bad decision” and “absurd” policy discriminating against the girl when hundreds of other NHS patients already receive the drug.
The phrase "Malaysian Malaysia" was originally used in the early 1960s as the rallying motto of the Malaysian Solidarity Council, a confederation of political parties formed to oppose Article 153 of the Constitution of Malaysia. This article specifically provides special quotas for the Malay and other indigenous peoples of Malaysia in admission to the public service, awarding of public scholarships, admission to public education institutions and the awarding of trade licences. It also authorises the government to create Malay monopolies in particular trades. The given reason for this affirmative action was carried out because the Malays and other aborigines were discriminated against in employment during over 100 years of British colonial rule.
The working diver will generally exit through the lock, while the bellman pays out the umbilical. The first task of the diver after locking out is to check bell integrity, to ensure that no damage has occurred during the deployment, and the bell is not in any obvious risk of snagging on the bottom. The diver will report back on the bell integrity inspection and the bellman will confirm the bell status before the supervisor authorises the diver to proceed to the worksite. During normal lockout the bellman will tend the working diver's umbilical, ensuring that there is neither excessive slack nor tension on it, so that the diver can work in comfort with low risk of snagging.
This law repeals the earlier Emergency Regulations (Requisition of Property) Law, 5709-1948. The law authorises the requisition of land when (Article 3): > ...the making of the order is necessary for the defence of the state, public > security, the maintenance of essential supplies or essential public > services, the absorption of immigrants or the rehabilitation of ex-soldiers > or war invalids. The law includes clauses concerning the requisition of houses (chapter three), and states (Article 22b) that: > A competent authority may use force to the extent required for the carrying > into effect of an order made by a competent authority or a decision given by > an appeal committee under this Law. According to COHRE and BADIL (p.
On 31 March 2015, Prayut announced that he had taken the required step of asking the king's permission to revoke martial law, which had been in place since the coup of May 2014, to be replaced with Article 44 of the interim constitution. Article 44 authorises the junta chairman to issue "any order to suppress" any act that "undermines public peace and order or national security, the monarchy, national economics, or the administration of state affairs, whether that act emerges inside or outside the Kingdom." The Bangkok Post commented, "The section has no constraint, no oversight, no checks or balances, and no retribution. It says forthrightly that anything done by the NCPO chief is 'legal, constitutional and conclusive'".
In response the Western Australian state government at the time, led by Premier Colin Barnett and Fisheries Minister Troy Buswell, developed a policy that authorises and funds the deployment of drum lines near popular beaches: baited mid-water hooks designed to catch and kill great white sharks, bull sharks and tiger sharks. All sharks found hooked but still alive and measuring over in length are to be shot and their bodies disposed of at sea. The principle behind the policy is to reduce the threat of shark attacks at popular coastal locations. It aims to achieve this by reducing the number of potentially life-threatening sharks by attracting them to baited hooks, rather than to human activity.
The new law authorises the death penalty and fines of up to 400,000 baht for human traffickers if their "customers" die. Some observers believe that the continued trafficking exists only because of official corruption, a state of affairs that tougher laws do nothing to remedy. The discovery in early-May 2015 of two dozen bodies from shallow graves in the mountains of southern Thailand, a discovery that has exposed a network of jungle camps run by traffickers who allegedly held migrants captive while they extorted ransoms from their families, has seemingly galvanised Thailand into action. A total of 33 bodies, believed to be migrants from Myanmar and Bangladesh, have now been exhumed from various jungle camps.
A draft Bill was scrutinised in detail by the Joint Committee on the Draft Civil Contingencies Bill, which was very influential in shaping the legislation though several of its proposals (notably creation of a new agency) were rejected. The Act guides and authorises the creation of a Local Resilience Forum to consider such matters within an existing police force boundary and requires responders to undertake risk assessments, maintain them in a Community Risk Register and to publish this register. Risks in this context are those that could result in a major emergency. This Community Risk Register is the first step in the emergency planning process; it ensures that the plans that are developed are proportionate to the risk.

The word "months" means calendar months. The Interpretation Act 1978, section 5 and Schedule 1 The day (that is to say, 12 November 2009) on which the Act was passed (that is to say, received royal assent) is included in the period of two months.Hare v Gocher [1962] 2 QB 641, [1962] 2 All ER 673; Trow v Ind Coope (West Midlands) Ltd [1967] 2 QB 899 at 909, [1967] 2 All ER 900, CA. This means that the Act came into force on 12 January 2010.
The law authorises a continuation of the exemption to yeshiva students subject to the conditions within the law. According to the law, at the age of 22, yeshiva students have a "decision year" and can choose between one-year civilian national service alongside a paying job or a shortened 16-month military service and future service in the reserves as an alternative to continuing to study. Five motions against the law were filed with the High Court of Justice claiming it violated the principle of equality. In 2005, the state admitted, in a response to a Supreme Court petition, that the Tal Law had failed to change enlistment arrangements for ultra-Orthodox Jews, as only a few dozen had enlisted in the army as a result.
Despite strict instructions to avoid provoking unnecessary confrontations with the ANC's armed wing, the Umkhonto we Sizwe (MK), Karl Vorster, the South African Minister of Law and Order, authorises a raid by the 44 Parachute Brigade on suspected MK bases in Zimbabwe. Vorster--a hardline conservative and secret Afrikaner Weerstandsbeweging sympathiser--is roundly criticised by President Haymans and his reformist Cabinet for his actions. However, the paratroopers succeed in recovering valuable intelligence on "Broken Covenant", a proposed MK operation to assassinate Haymans as he travels to Pretoria from Cape Town aboard the Blue Train for the parliament's summer recess. This incident comes at a time when negotiations between Haymans and the ANC are approaching a major breakthrough, so MK decides to abort the attack.
Sections 7-14 create a series of offences carrying penalties ranging from the imposition of a fine to imprisonment of up to five years. The offence creating provisions of the Act provide a comprehensive code designed to protect the privacy of the general population. Exceptions to criminal liability arise where a warrant or Commonwealth law authorises the use of a surveillance device or where a person is protecting their lawful interests. Section 8 makes it an offence carrying a maximum penalty of five years imprisonment to use a listening device ‘to overhear, record, monitor or listen to’ a private conversation to which the person is not a party or to record a private conversation to which there person is a party.
Some racket sports clubs have a reigning champion who may be challenged by any other club member; a ladder tournament extends the challenge concept to all players, not just the reigning champion. At élite-level competition, there is usually some governing body which authorises and regulates challenges, such as FIDE in chess. In some cases there is a challengers' tournament, the winner of which gains the right to play the challenge round against the reigning champion; in tennis this was the case at Wimbledon until 1922 and in the Davis Cup until 1972. The FA Cup's official name remains the "Football Association Challenge Cup", although not since its second season in 1873 has the reigning champion receive a bye to the final.
Although Soviet and East German forces threaten to invade West Berlin if the US does not withdraw, the US does not acquiesce to communist demands and the invasion takes place; two US Army divisions attempt to fight their way into Berlin to counter this, but the Russian and East German forces overwhelm them in conventional battle. In order to turn the tide, President Johnson authorises the NATO commanders to use their tactical nuclear weapons, and they soon do so. An escalating nuclear war results, during which larger Soviet strategic IRBMs are launched at Britain. The film remarks that many Soviet missiles were, at the time, believed to be liquid-fuelled and stored above ground, making them vulnerable to attack and bombings.
There they recognise Varenka Debroslova, the late Geofrey Albert Woodville-Gentle's live-in nurse, who attacks them. When Nightingale hears Peter's account and examines the massive property damage she inflicted, he identifies Debroslava as Nochnye Koldunyi or a Night Witch. Follow-up of leads at Southwark Council convinces the team that there is a connection to Skygarden Tower, so Nightingale informally authorises Peter and Lesley to infiltrate the tower. When Peter finally manages to get into the tower's garden, he discovers river spirit Nicky gamboling with an impish girl wearing a Mary Quant dress and a battered straw hat who plays hide and seek, generally acting more like a child than a woman, who the bemused Peter is convinced is some kind of fey but exactly what kind he can't work out.
Section 78 gives the Secretary of State power to implement the provisions of this Act through the use of one or more Statutory Instruments, and defines how any such instruments are to be approved. Section 79 provides detailed citations of preceding Acts of Parliament that are referenced in the Act, Section 80 allows for any charges incurred in the implementation of the Act to be paid for by Parliament, whilst Section 81 details the territorial extent of the Act within the United Kingdom. Section 82 details when and how the provisions of the Act are to be implemented, whilst Section 83 authorises the Act to be called the Education Act 2011, and for it to be included in the official list of Education Acts maintained in Section 578 of the Education Act 1996.
The Crossrail Act 2008 (c 18) is an Act of the Parliament of the United Kingdom that authorises the construction of the Crossrail railway from Maidenhead and Heathrow Airport to Shenfield and Abbey Wood. The legislation was introduced by the then Secretary of State for Transport Douglas Alexander and received Royal Assent on 22 July 2008.Lords Hansard Royal Assent Statement The Crossrail bill was introduced on 22 February 2005 and was carried over between sessions of Parliament on three occasions.Bills and Legislation Although public Bills generally pass through Parliament in a single session, this was a Hybrid Bill, which has the characteristics of both public and private bills and is subject to scrutiny in the same way as both a public and private bill, and generally takes longer to be considered.
When granting assent by commission, the Sovereign authorises three or more (normally five) lords who are Privy Counsellors to declare assent in his or her name. The Lords Commissioners, as the Monarch's representatives are known, wear scarlet parliamentary robes and sit on a bench between the throne and the Woolsack. The Lords Reading Clerk reads the commission aloud; the senior commissioner then states, "My Lords, in obedience to Her Majesty's Commands, and by virtue of the Commission which has been now read, We do declare and notify to you, the Lords Spiritual and Temporal and Commons in Parliament assembled, that Her Majesty has given Her Royal Assent to the several Acts in the Commission mentioned.""Companion to the Standing Orders and guide to the Proceedings of the House of Lords".

At least five of the 50 jirga committees raised objections to the article addressing "status of personnel" which "authorises the United States to hold [civil and criminal] trial … or take other disciplinary action, as appropriate, in the territory of Afghanistan" when a US soldier is accused of criminal activity. Spokespeople from at least two committees directly stated that Afghanistan should have jurisdiction over any US soldiers accused of crimes on Afghan soil. Several committees also stated that if trials are held in the United States, families of victims should have access to and presence in US-held trials at the expense of Washington. As allied forces proceed to withdrawal troops, the international community wants to help and ensure that Afghanistan has security, political, and economic progress and to instill transparency and fairness of the elections.
There is a gravitational incline in this dimension which leads to a horrifying place called the Mélange, a liquid nitrogen-cold sea of beings trapped in this continuum, unable to accumulate enough energy to escape. Dariat escapes from Valisk in an escape pod with Tolton before it hits the Mélange and explodes, but they ponder that it is only a matter of time until the pod runs out of fuel and dissolves, forcing them to join the tortured beings outside. The Confederation Navy research team discovers a possible way of killing the possessed, an 'anti- memory' device that will eradicate both the possessed and the possessing soul. The First Admiral is horrified about the weapon and even more horrified when President Haakar, panicking as the possession crisis spreads to more worlds, authorises its development.
The People's Union for Democratic Rights pointed out that although this act was ostensibly meant to combat growing Maoist violence, all the Maoist groups operating in Chhattisgarh were already banned and declared unlawful organisations after the 2004 amendment to the Unlawful Activities - Act, 1967 It authorises the police to detain a person for committing acts, which among other things, show a "tendency to pose an obstacle to the administration of law". The act also states any person whose actions "encourage(s) the disobedience of the established law" will be considered "unlawful". Commonwealth Human Rights Initiative, in a statement, said that the present definition of "unlawful activities" imperils free exercise of fundamental freedoms set out under Article 19 of the Constitution and illustratively it appears to restrict the right to hold public meetings; organise public protests; and oppose government policies through the media.
Several other statutes which define offences likewise state "any person may arrest" someone committing the offence; relevant offences include making off without payment, hawking revenue stamps, and property damage — this last permits arrest for a past crime as well as one in progress. In addition, the Criminal Law (Jurisdiction) Act 1976 schedules offences associated with the Troubles in Northern Ireland, and authorises anyone to arrest someone for committing or having committed such an offence, whether in the Republic of Ireland or Northern Ireland. The 1976 act, and a similar Westminster act giving reciprocal extraterritorial jurisdiction, obviated the need for extradition between the jurisdictions, which would have been more controversial. If the arrester lacks reasonable cause to believe the arrested person to have committed the offence, the latter may sue the former for defamation, wrongful arrest, or trespass.
Sister Estonia upheld the high standards of the school but despite her vigilant efforts, there were still loopholes that were successfully exploited to ensure Lucy's entry into the esteemed educational institution. Manville has received multiple BAFTA TV Award nominations throughout her career but her breakthrough came in theatre, where she was the recipient of the Critics Circle Award for Best Actress and Olivier Award for Best Actress. David Warner as Father Thomas/Catholic Priest In this film, he is an English actor that played the role of Father Thomas, the Catholic priest that fraudulently authorises a letter to verify the Catholic faith of Stuart and Alison to enable their successful application to the Catholic school for their daughter Lucy. He represents the recent subversion of ethical values in the Catholic institution, which is a religion that prides itself on absolute standards of morality.
In particular, Certificate level qualification does not qualify a veterinary surgeon as a specialist. With further training, extensive professional experience and by publishing articles in a particular subject area, it is possible to gain Royal College of Veterinary Surgeons (RCVS) Recognised Specialist Status. In 2012, the ruling council of the RCVS adopted a report from the Calman Committee into specialisation in the UK veterinary profession, accepting that only those veterinary surgeons recognised by the RCVS as specialists and placed on a register held by the RCVS could be truly held up as "Specialist". Vets may undertake the training to become an Official Veterinarian (OV) which authorises them to carry out tasks on behalf of the Department for Environment, Food and Rural Affairs, such as testing cattle for tuberculosis or issuing of documentation for the export of animals and animal products.
His collection of the Robin Hood ballads is perhaps his greatest single achievement. However, unlike the other works he edited, he gave in to his own political prejudices as a Jacobin when he included the idea, uncommon until then, that Robin Hood robbed the rich and gave to the poor rather than simply robbing the bishops and the Sheriff of Nottingham.Prof. Sir J. C. Holt, Robin Hood, Thames and Hudson, 1989, pp.184-185. When Ritson was asked who gave Robin Hood a commission to rob from the rich and give to the poor, his response was:Myth and National Identity in Nineteenth-Century Britain: The Legends of King Arthur and Robin Hood, Oxford University Press > That same power which authorises kings to take it where it can be worst > spared, and give it where it is least wanted.
Where a credit reporter collects credit information, it must collect the information directly from the individual concerned, unless the credit reporter believes, on reasonable grounds: (a) that the information is publicly available information; (b) that the individual concerned authorises collection of the information from another source; (c) that it is required for any investigation under the law by any public sector agency, including the prevention, detection, investigation, prosecution, and punishment of offences; (d) that it is required for the collection of fines or taxes (e) for the conduct of proceedings before any court or tribunal (being proceedings that have been commenced or are reasonably in contemplation); (f) the collection is from a debt collector that is enforcing a debt owed by the individual concerned This Rule effectively lets the credit reporter to update someone's new address if it is supplied by other sources than from a normal credit inquiry.
The Director of Public Prosecutions is granted discretionary powers under the Constitution to conduct, take over, and discontinue criminal prosecutions in the courts of Fiji, except for proceedings undertaken by the Fiji Independent Commission Against Corruption. The 2013 Constitution under section 117 authorises the DPP to independently govern all matters concerning public prosecutions and ensures its independence not only for prosecution but also to determine all matters pertaining to the employment of all staff and prosecutors. The ODPP plays a key role in supporting the enforcement of criminal laws in Fiji, international laws, treaties and conventions that the Fijian Government has ratified, as well as contributing towards the continued development and maintenance of a just and fair criminal justice system. The 2013 Constitution, for the first time ever, provides the DPP full control over a parliamentary-approved budget as well as control over administrative staff and the appointment of legal staff.
In Wales the helicopter carrying Howard crashes, and he is found near a group of plants over 8 feet tall - far taller than any others and with correspondingly higher oxygen output. Analysis shows that these "giant" plants are in fact the norm, and all other plants are stunted - the Exon strain requires a high copper content in the soil to grow, which is naturally scarce in English soil. Flinders persuades the government to commandeer a European satellite that has similar sensors to that of his spectroscope, and has its orbit reduced low enough to scan the country - but also so low that it will burn up in the high atmosphere, possibly before a full scan is complete, and also dropping its miniature nuclear reactor back onto the planet. The government decides that nuclear contamination is a lesser evil to the carpet bombing and authorises its use.
The amendment reads: The amendment authorises the eurozone countries to establish a stability mechanism to protect the common currency, within EU law. This mean, that the existing intergovernmental treaty having established ESM outside of the EU framework with entry into force 27 September 2012, might subsequently be transposed to become part of the EU framework once this TFEU article 136 amendment enters into force. The ESM established by the intergovernmental treaty was designed to be fully compatible with existing EU law, and the European Court of Justice ruled in November 2012 - that "the right of a Member State to conclude and ratify the ESM Treaty is not subject to the entry into force" of the TFEU amendment. The TFEU amendment came into force on 1 May 2013, after the Czech Republic became the last member state to ratify the agreement according to its respective constitutional requirements.
A joint privilege holder may assert the privilege against third parties, may have access to the privileged material, may require the other holders not to disclose the privileged material, and may be ordered by a Judge not to disclose the privileged material. Personal representatives of deceased privilege holders and persons who acquire property related to a privilege have similar rights except that the right of access is limited to the extent that a Judge considers it justified. Section 67 requires a Judge to disallow a claim of privilege if satisfied there is a prima facie case that the privileged material was communicated or prepared for a dishonest purpose or to enable the commission of an offence. The section authorises a Judge to disallow a privilege if the Judge thinks that evidence of the privileged material is necessary to enable the defendant in a criminal proceeding to present an effective defence.
Section 21 sets out the detail of the things that a surveillance device may authorise: :(a) The use of a surveillance device on or in specified premises or a vehicle; :(b) The use of a surveillance device in or on a specified object or class of object; :(c) The use of a surveillance device in respect of the conversations, activities or geographical location of a specified person or a person whose identity is unknown; :(d) The use of a surveillance device on or about the body of a specified person. The warrant also authorises the installation, use and maintenance of the surveillance device and the entry, by force if necessary, onto or into the premises or vehicle subject of the warrant. It may also authorise entry (by force) onto adjoining premises or premises through which access to the subject premises or vehicle might be obtained.
An enactment that authorises an advisory referendum (which does not trigger a legislative change or bind the government to do something) becomes spent once the referendum has taken place. Hence the Referendum Act 1975 became spent after the 1975 United Kingdom European Communities membership referendum took place, and was subsequently repealed by the Statute Law (Repeals) Act 1986. Likewise the parts of the European Union Referendum Act 2015 that authorised the 2016 EU membership referendum and regulated its execution are now spent. However, this Act also contains provisions regulating funding of and expenditure by political campaign groups under the framework of the Political Parties, Elections and Referendums Act 2000, which has the potential to lead to criminal convictions under the 2000 Act, and as such those provisions continue to be relevant until such time as Parliament decides no more such offences will be discovered or prosecuted.
On troop immunity, it says that Afghanistan agrees "that the United States shall have the exclusive right to exercise jurisdiction" over members of the force and its civilian component "in respect of any criminal or civil offenses committed in the territory of Afghanistan", and that "Afghanistan authorises the United States to hold [civil and criminal] trial in such cases, or take other disciplinary action, as appropriate, in the territory of Afghanistan", but Afghan authorities can ask that anyone be taken out of the country. Afghan authorities are prohibited from detaining American troops or U.S. civilians working with them. In the event that happens "for any reason," however, those personnel "shall be immediately handed over to United States forces authorities." The agreement also specifies that American troops and civilians cannot be surrendered to any "international tribunal or any other entity or state" without express U.S. consent.
All communications intercepted and obtained under MCOCA must be recorded, wherever possible and the recordings have to be made available to the Competent Authority that authorised the surveillance. The Competent Authority retains custody of the recordings and must preserve them for at least ten years, and can make the recordings available to any person if they determine that it is in the interests of justice. The Competent Authority is also required to keep an archive of surveillance applications and orders for a period of ten years. MCOCA provides that no evidence, including recordings, obtained under these MCOCA provisions are admissible in evidence unless they have been provided to all parties concerned in the trial at least ten days in advance, along with copies of the surveillance application and authorising order; however, MCOCA also authorises judges to waive the ten-day period for evidence review if they feel that the investigators and prosecutors cannot comply with it, and that the delay will not prejudice the trial.
In the British Virgin Islands a company has separate legal personality from its members (unlike, for example, a partnership registered under the Partnership Act, 1996). The liability of the members of a company is limited to their shares or the amount of their guarantee.BVI Business Companies Act, section 80 Similarly, directors or officers of a company are not normally liable for the company's debts except insofar as they may otherwise be liable for their own conduct or actions.BVI Business Companies Act, section 30 The primary circumstances where liability may be imposed upon directors in relation to their acts as directors are (1) where the company has no members, (2) where a person acts as a director despite being disqualified, (3) where the director authorises payment of an unlawful distribution which cannot be recovered, (4) where the director is guilty of trading whilst insolvent, misfeasance or fraudulent trading, or (5) where the director undertakes personal responsibility or liability for certain actions.
A 2005 Human Rights Watch document criticizes "Parallel Institutions" (nahad-e movazi) in the Islamic Republic, "the quasi-official organs of repression that have become increasingly open in crushing student protests, detaining activists, writers, and journalists in secret prisons, and threatening pro-democracy speakers and audiences at public events." Under the control of the Office of the Supreme Leader, these groups set up arbitrary checkpoints around Tehran, uniformed police often refraining from directly confronting these plainclothes agents. "Illegal prisons, which are outside of the oversight of the National Prisons Office, are sites where political prisoners are abused, intimidated, and tortured with impunity."Overview of human rights issues in Iran, January 2005 According to dissident Akbar Ganji, what might appear to be "extra-legal" killings in Iran are actually not outside the penal code of the Islamic Republic since the code "authorises a citizen to assassinate another if he is judged to be ‘impious’,"Interview with Akbar Ganji, Le Monde, 6 June 2006.
The great practical effectiveness of the saisie-contrefaçon also lies in its restrictive nature, since the judge, by granting an order to perform a saisie-contrefaçon, authorises the requesting party to call upon a bailiff to enter the premises of the targeted person or even of third parties (if evidence is likely to be found there) to perform the saisie-contrefaçon investigations, regardless of whether or not the premises are normally open to the public. The saisie- contrefaçon is generally decisive in the success or failure of the action for infringement. If it is correctly performed and cannot be challenged or remains unchallenged, it will provide evidence of an infringement for which the judge ruling on the merits in the infringement proceedings cannot but pronounce civil or criminal sanctions, thereby ensuring the success of the holder of the intellectual property right over the infringer. If it is incorrectly performed, challenged and declared void, it generally leads to the failure of the infringement action on the merits as it fails to produce evidence of the infringement.
Justice Cooke noted on the right to silence, "The starting point for any attempt to explore a little deeper must be the principle that, unless an Act of Parliament imposes or authorises the imposition of a duty to the contrary, every citizen has in general a right to refuse to answer questions from anyone, including an official."Taylor v New Zealand Poultry Board [1984] 1 NZLR 394 at 398. Cooke then said, "Nor is it in dispute that, if the meaning of the statutory language is sufficiently clear, the New Zealand Parliament can make a person compellable to answer questions on certain subjects from an official - again in the sense that a refusal to answer may result in penalties." It was at this point, Cooke went on to make one of his most famous judicial comments, Cooke considers leading common law decisions from the High Court of Australia and the House of Lords on "whether the privilege against self-incrimination applies outside Court proceedings";Taylor v New Zealand Poultry Board [1984] 1 NZLR 394 at 398-401.
In a paranoid delusion, moribund US Air Force general Quinten unilaterally launches an airborne preventive nuclear attack upon the Soviet Union from his command at the Sonora, Texas, Strategic Air Command (SAC) bomber base by ordering the 843rd Bomb Wing to attack using war plan "Wing Attack Plan R", which authorises a lower-echelon SAC commander to retaliate after an enemy first strike has decapitated the US government. He attacks with the entire B-52 bomber wing of new aircraft, each armed with two nuclear weapons and protected with electronic countermeasures to prevent the Soviets from shooting them down. When the US President and cabinet become aware the attack is underway, they assist the Soviet defence interception of the USAF bombers, to little effect, because the Soviets destroy only two bombers and damage one, the Alabama Angel, which remains airborne and en route to its target. The US government reestablishes the SAC airbase chain of command, but the general who launched the attack, the only man knowing the recall code, kills himself before capture and interrogation.
Licensing notice displayed above the entrance of a pub (no longer required since November 2005) The alcohol licensing laws of the United Kingdom regulate the sale and consumption of alcohol, with separate legislation for England, Wales Northern Ireland and Scotland being passed, as necessary, by the UK parliament, the Senedd in Wales, the Northern Ireland Assembly, and the Scottish Parliament respectively. Throughout the United Kingdom, the sale of alcohol is restricted—pubs, restaurants, shops and other premises must be licensed by the local authority. In England, Wales and Scotland the authority to sell alcohol is divided into two parts – the Premises Licence, which prescribes the times and conditions under which alcohol can be sold, and a Personal Licence which allows individuals to sell alcohol or authorise its sale by others. Every Premises Licence which authorises the sale of alcohol must also name a Designated Premises Supervisor (Designated Premises Manager in Scotland) ("DPS" or "DPM" for short) who must hold a valid Personal Licence – otherwise alcohol cannot be sold at those premises.
